02. - Zones and Zoning Map

23.02.01. - Designation of zones.

For the purposes of this title the city is divided into the following zone categories:

(A)

R-1 Residential Zone (One-Family)

(B)

R-2 Residential Zone (One and Two-Family)

(C)

R-3 Residential Zone (Multi-Family)

(D)

B-1 Business Zone

(E)

B-2D Downtown Business Zone

(F)

B-2 General Business Zone

(G)

M Industrial Zone

(H)

OS Open Space Zone

(I)

EI Educational Zone

(J)

OL Overlay Zones

23.02.02. - Zoning map.

The zones are shown on the zoning map of the city. The map, together with all notations, references, data, zoning boundaries and other information shown thereon, shall be and are made a part of the zoning code. The official zoning map, properly attested, shall be dated and remain on file in the Athens City Code Enforcement Office.

23.02.03. - Interpretation of boundaries.

(A)

Designation of zone boundaries. Except where referenced on the zoning map to a street or alley line or other designated line by dimensions shown on the zoning map, the boundary lines follow lot lines or the center lines of streets or alleys as they existed at the time of the adoption of the zoning code.

(B)

Lot divided; extension, of zone. Where a boundary as shown on the zoning map divides a lot which was in single ownership at the time of enactment of the zoning code, the use authorized thereon and the other zone requirements applying to the least restricted portion of the lot under the zoning code shall be considered as extending to the entire lot, provided the more restricted portion of such lot is entirely within 25 feet of said dividing boundary line. The use so extended shall be deemed to be conforming.

(C)

Location of boundaries. All questions concerning the exact location of zone boundary lines shall be determined by the Athens city planning commission (hereafter referred to as the commission).

(D)

Vacated street or alley. Whenever any street, alley or other public way is vacated by official action as provided by law, the zone of the area adjoining the side of such public way shall be extended automatically, depending on the side or sides to which such lands revert, to include the right-of-way thus vacated, which, shall thence-forth be subject to all zoning regulations of the lot to which it has been added.

(E)

Annexations. Property annexed to or consolidated with the city shall receive zoning designation by the commission prior to forwarding to city council. The county commissioners shall forward a copy of the petitioner's annexation petition filed pursuant to Ohio Revised Code Section 709.03 to the city auditor. The city auditor then shall forward the petition to the commission. Within 20 days following the receipt of said petition, the commission shall notify the annexation petitioner that an application to amend the zoning map pursuant to Chapter 23.09 must be filed. The commission shall review said application or, if it receives no application, shall review the subject upon its own motion and a recommendation to city council the zoning of said proposed annexed property as an amendment to the zoning map, pursuant to procedural requirements of Chapter 23.09. Athens City Code Section 23.11.01. The commission shall transmit its recommendation to city council for amendment of the zoning map prior to the council session in which, pursuant to Ohio Revised Code Section 709.04, city council considers the annexation of the property in question.
