PERMITS
A construction permit shall be required prior to the erection or alteration of or addition to any building or other structure or portion thereof, and it shall be unlawful for any person to commence work for such until a construction permit has been duly issued by the construction official.

A use and occupancy permit shall be required prior to any of the following:
(1)
The use and occupancy of any building or other structure hereafter erected or altered for which a construction permit is required.
(2)
A change in use of a building or lot; however, the placing of land into cultivation, where it was previously unused, shall not be deemed a change in use.

A zoning permit shall be required prior to the erection of any fence, patio, driveway, sidewalk or other impervious bulk coverage, and it shall be unlawful for any person to commence work for such until a zoning permit has been duly issued by the zoning officer within the joint land use office.

If the construction official receives certain approvals from the planning board or from the board of adjustment or otherwise determines that an application is in conformity with the regulations of this chapter, it shall be his duty to issue applicable permits; however, if he finds that the application is not in compliance with the provisions of this chapter, it shall be his duty to refuse the issuance of an applicable permit, in which case he shall instruct the applicant in how to appeal if the applicant so desires.
