ENFORCEMENT

§ 153.130 ENFORCEMENT.

   (A)   This chapter shall be administered and enforced by the City Administrator/Clerk-Treasurer who is hereby designated as the Zoning Official.
   (B)   The City Administrator/Clerk-Treasurer may authorize other employees or agents of the city to perform the various duties of the Zoning Official, including the enforcement of this chapter.

§ 153.131 VALIDITY.

   Failure to give mailed notice as may be required by this chapter or any defects in the notice shall not invalidate the proceedings.

§ 153.132 INTERPRETATION.

   In their interpretation, the provisions of this chapter shall be held to be the minimum requirements necessary to promote and preserve the public health, safety, morals and welfare.

§ 153.133 SUPREMACY.

   When any condition imposed by any provision of this chapter upon the use of land or buildings or upon the bulk of buildings is either more restrictive or less restrictive than similar conditions imposed by the provisions of this chapter or other city code provisions, the more restrictive condition shall prevail. This chapter is not intended to abrogate any easements, covenants or any other private agreement, providing that where the provisions of this chapter are more restrictive than the easements, covenants or other private agreements, the provisions of this chapter shall prevail.

§ 153.999 PENALTY.

   (A)   Every person violates a section, division, paragraph or provision of this chapter when he or she performs an act thereby prohibited or declared unlawful, or fails to act when the failure is thereby prohibited or declared unlawful, and upon conviction thereof, shall be punished as for a misdemeanor except as otherwise stated in specific provisions hereof.

   (B)   It is unlawful for any person to conduct a garage or rummage sale in violation of any of the provisions of § 153.077. A violation of § 153.077 is a misdemeanor, to be punished as provided in division (A) above.
   (C)   Any person who violates, neglects, refuses to comply with or assists or participates in any way in the violation of any of the provisions or requirements of §§ 153.110 through 153.117 is guilty of a misdemeanor and for each violation is subject to the maximum penalty prescribed by state law for a misdemeanor. Each day the violation continues shall constitute a separate offense.
