- IN GENERAL
Open space is defined as lots 21, 43 and 66, Belleair Beach Unit #1, owned by the town, suitable for beach access or municipal purposes.

(a)
All restrictions as to the location and erection of buildings now on record according to plats of subdivision in the town and existing at the time of the passage of the ordinance from which this chapter is derived are to remain in force and effect, except where such restrictions are altered or changed by the provisions of this chapter, in which case, such restrictions shall be abrogated to the extent necessary to conform to the provisions of this chapter.
(b)
The lawful use of any structure on land existing at the time of the adoption of the ordinance from which this chapter is derived may be continued although such use does not conform with the provisions of this chapter; such nonconforming structure or use may be maintained and repaired, but no structural alterations shall be made except those allowed or required by this Code of Ordinances.

Any person found to be in violation of this chapter shall be subject to the penalty provisions relative thereto, and as provided in section 1-13 and section 26-1.

The board of commissioners is authorized and empowered to enforce the terms of this chapter through institution of any appropriate action or proceeding in any of the courts of the state to prevent the unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance, or unlawful or improper use of any building or structure, or to restrain, correct, or abate such violation or use, or any other violations of this chapter.
