10 Land Use Districts

20.10.010 Purpose of land use districts.

The City is divided into land use districts established in this Code with the intent to provide for the geographic distribution of land uses as contemplated by the City’s goals, policies, master plans and programs; to maintain stability in land use commitments through the provision of harmonious groupings of uses possessing compatible characteristics and levels of activity; to maintain commitments in public service facilities such as transportation systems, parks and utilities; and to provide an efficient and compatible relationship of land uses and land use districts.

20.10.020 Establishment of land use districts.

Land use districts in the City are hereby established as follows:

20.10.040 Land use district map.

The designation, location, and boundaries of the land use districts and Shoreline Overlay District established by this Code are as shown and depicted on the official land use map(s) of the City, which shall be administratively maintained by the Director and made available on the City’s website. 20.10.050 Property classified.

Each property in the City of Bellevue is hereby classified pursuant to this Code and is subject to the requirements of this Code.

20.10.060 Interpretation of map boundaries.

When uncertainty exists as to the boundaries of any use district established on the City’s land use map(s), the following rules of construction shall apply:

A. Where district boundaries are indicated as approximately following the centerline of streets, alleys or highways, the actual centerline shall be construed to be the boundary.

B. Where district boundaries are indicated as running approximately parallel to the centerline of a street, the boundary line shall be construed to be parallel to the centerline of the street.

C. Where district boundaries are indicated as approximately following lot or tract lines, the actual lot or tract lines shall be construed to be the boundary lines of such use district.

D. Unmapped shorelands shall automatically be assigned an Urban Conservancy environment designation.

E. Where a public street or alley is officially vacated or abandoned, the regulations applicable to the abutting property to which the vacated portion shall revert shall apply to such vacated or abandoned street or alley.

F. In case uncertainty exists which cannot be determined by application of the foregoing rules, the Planning Commission shall recommend, and the City Council shall determine, the location of such use district boundaries.

G. Shoreline Overlay (S-O) District boundaries are as described in LUC 20.25E.010.C.1, and, with the exception of subsection D of this section, are not subject to these rules of construction. (Ord. 6417, 5-21-18, § 1; Ord. 4654, 6-6-94, § 2; Ord. 3145, 9-27-82, § 3)

20.10.080 Newly annexed territory – Procedures for classification.

All territory annexed to the City shall receive a land use designation by the City in a timely manner upon fulfillment of the procedures and requirements for reclassification, contained in Part 20.30A LUC. (Ord. 3530, 8-12-85, § 1)

20.10.100 District descriptions.

LUC 20.10.180 through 20.10.398 describe the purpose and scope of the City’s land use districts. These sections may be used to guide the interpretation of the regulations associated with each district. 20.10.180 Residential Districts (LL-1 through MDR-2).

Residential districts provide for a range of low to high density residential environments and associated compatible activities depending on location and scale of residential density. 20.10.240 Professional Office District (PO).

Professional Office Districts provide areas for low-intensity office uses. Structures shall have exterior designs which are compatible with surrounding developments, vegetation and topography. The Professional Office District may act as a buffer between residential and more intensively developed properties. (Ord. 4654, 6-6-94, § 10; Ord. 3145, 9-27-82, § 11)

20.10.260 Office District (O).

Office Districts provide areas for business, financial and professional service offices, located on arterial or commercial access streets. In the proximity of other major business and commercial districts, this district may serve as a buffer between residential areas and more intensive commercial districts. 20.10.280 Office and Limited Business District (OLB).

Office and Limited Business Districts provide areas for the location of integrated complexes made up of offices, hotels or motels, eating establishments and retail sales accessory to permitted uses. Such districts are located in areas that abut and have convenient access to freeways and major highways. (Ord. 4654, 6-6-94, § 12; Ord. 3145, 9-27-82, § 13)

20.10.285 Office and Limited Business District 2 (OLB 2).

The purpose of the OLB 2 District is to provide an area of integrated complexes made up of offices, hotels, or motels, eating and drinking establishments, and retail sales within walking distance to support business and employees. The OLB 2 District has greater intensity and a larger mix of uses than the OLB District. Such districts are located in areas that abut and have convenient access to freeways, major highways, and transit. (Ord. 6366, 8-7-17, § 2)

20.10.290 Office and Limited Business-Open Space District (OLB-OS).

Office and Limited Business-Open Space Districts provide for significant amounts of open space and for offices, hotels, or motels, and other uses permitted in the Office and Limited Business District, except for residential uses. The OLB-OS properties are developed as a cohesive site with unified building design. The open space area is reserved for public use and access and may include active and passive recreational uses. OLB-OS properties are at least 25 acres in size with at least 40 percent of the total site area reserved as a contiguous open space area. (Ord. 5403, 8-5-02, § 2)

20.10.300 Light Industrial District (LI).

Light Industrial Districts provide for the location of a broad array of activities, including manufacturing, wholesale trade and distribution activities. Offices are discouraged unless they support the primary functions of the LI District. Sales of goods and services subordinate to permitted activities and sales of bulky or large scale items are appropriate, except for auto sales and rentals which are appropriate only in certain locations. 20.10.320 General Commercial District (GC).

General Commercial is a mixed retail and commercial designation that provides for the location of a wide variety of business activities that provide goods and services to other businesses and the general public. (Ord. 5434, 1-21-03, § 1; Ord. 4176, 11-26-90, § 2; Ord. 3145, 9-27-82, § 15)

20.10.340 Neighborhood Business District (NB).

Neighborhood Business Districts are small scale, mixed-use commercial areas that provide housing opportunities and retail and service businesses for the surrounding residential community. These sites may also accommodate a limited amount of administrative office space, provided that the office use does not interfere with the site’s primary neighborhood-serving function. NB Districts front on designated primary or minor arterials and are generally 1,000 feet or more apart along the arterials. It is the intent of the City that any such district be located adjacent to existing or proposed residential areas. The maximum size of an NB District, composed of contiguous properties and located on one side of a street, is four and one-half acres. The maximum size is expanded to six acres for NB sites separated by a street. (Ord. 5430, 1-21-03, § 1; Ord. 4654, 6-6-94, § 13; Ord. 4422, 9-28-92, § 1; Ord. 3145, 9-27-82, § 16)

20.10.350 Neighborhood Mixed Use District (NMU).

The purpose of the NMU District is to provide an area with a mix of retail, service, office and residential uses with an emphasis on neighborhood retail and service uses. This district is designed to be compatible with nearby neighborhoods and is easily accessible from the nearby office and residential uses. (Ord. 6366, 8-7-17, § 3)

20.10.360 Community Business District (CB).

Community Business Districts serve community markets and provide areas for the location of services and retail outlets, other than Downtown. (Ord. 4654, 6-6-94, § 14; Ord. 3145, 9-27-82, § 17)

20.10.365 Eastgate Transit Oriented Development District (EG-TOD).

The purpose of the EG-TOD District is to provide an area for a mix of housing, retail, office, and service uses, with an emphasis on housing. The district is limited in area so that there is an appropriate level of density nearest the highest levels of transit service. (Ord. 6366, 8-7-17, § 4)

20.10.370 Downtown (DT).

The purpose, permitted uses, and general development requirements for land use districts within Downtown are provided in Part 20.25A LUC. (Ord. 6425, 10-1-18, § 2; Ord. 5496, 11-17-03, § 1; Ord. 4654, 6-6-94, § 15; Ord. 2945, 2-2-81, § 2)

20.10.375 BelRed.

A. Purpose and Intent. BelRed is a major mixed use employment and residential area characterized by a transit-oriented, nodal development pattern, over time replacing the area’s original low intensity light industrial and commercial past. The City will encourage land uses in the BelRed area which promote employment, retail and residential opportunities. More intense uses and greater heights are concentrated in designated nodal development areas along the NE 15th/16th corridor; these areas are intended to be served by high capacity transit. New development in these designated nodal areas is expected to have a transit-supportive and pedestrian-friendly form. The entire BelRed area will be distinguished by environmental and community amenities that serve residents and employees in the area, as well as nearby neighborhoods and the entire city. New development is expected to make significant contributions to these amenities, and to the infrastructure needed to support redevelopment.

Redevelopment of the BelRed area will occur over decades, and the City encourages a graceful transition of land use over time. Therefore special provisions are appropriate for existing uses that may not be part of the area’s long-term envisioned future.

1. BelRed-Medical Office (BelRed-MO). The purpose of the BelRed-MO Land Use District is to provide an area for office uses, with an emphasis on medical office.

2. BelRed-Medical Office Node (BelRed-MO-1). The purpose of the BelRed-MO-1 Land Use District is to provide an area for the most intense medical office uses. The district is located within the core of a nodal area, and is limited in extent in order to provide the level of intensity appropriate for areas in close proximity to the highest levels of transit service within the BelRed area.

3. BelRed Office/Residential (BelRed-OR). The purpose of the BelRed-OR Land Use District is to provide an area for a mix of office, housing and retail uses, with office as the predominant use.

4. BelRed-Office/Residential Node 1 (BelRed-OR-1). The purpose of the BelRed-OR-1 Land Use District is to provide an area for a mix of office, housing and retail uses within the core of a nodal area, with offices as the predominant use. The district is limited in extent in order to provide the level of intensity appropriate for areas in close proximity to the highest levels of transit service within the BelRed area.

5. BelRed-Office/Residential Node 2 (BelRed-OR-2). The purpose of the BelRed-OR-2 Land Use District is to provide an area for a mix of office, housing and retail uses, with office as the predominant use. The district is located within a node but outside the node’s core, and building heights provide for a transition between the node’s core and areas outside the node.

6. BelRed-Residential/Commercial Node 1 (BelRed-RC-1). The purpose of the BelRed-RC-1 Land Use District is to provide an area for a mix of housing, retail, office and service uses within the core of a nodal area, with an emphasis on housing. The district is limited in extent in order to provide the level of intensity appropriate for areas in close proximity to the highest levels of transit service within the BelRed area.

7. BelRed-Residential/Commercial Node 2 (BelRed-RC-2). The purpose of the BelRed-RC-2 Land Use District is to provide an area for a mix of housing, retail, office and service uses. The district is located within a node but outside the node’s core, and building heights provide for a transition between the node’s core and areas outside the node.

8. BelRed-Residential/Commercial (BelRed-RC-3). The purpose of the BelRed-RC-3 Land Use District is to provide an area for a mix of housing, retail, office and service uses, with an emphasis on housing. The district is located within a node but in close proximity to mature, stable neighborhoods, and is thus appropriate for transitional heights.

9. BelRed-Commercial/Residential (BelRed-CR). The purpose of the BelRed-CR Land Use District is to provide an area for a mix of housing, retail, office and services. Multiple uses are encouraged on individual sites, in individual buildings, and in the district as a whole.

10. BelRed-Residential (BelRed-R). The purpose of the BelRed-R Land Use District is to provide an area for residential uses. Limited retail and service uses are permitted secondary to residential use, in order to provide the amenity of shopping and services within easy walking distance of residential structures.

11. BelRed-General Commercial (BelRed-GC). The purpose of the BelRed-GC Land Use District is to provide an area for a wide variety of business activities that provide goods and services to other businesses and the general public.

12. BelRed-Office/Residential Transition (BelRed-ORT). The purpose of the BelRed-ORT Land Use District is to provide an area for low-intensity offices and uses and low density multifamily residential dwellings, developed in such a manner as to provide a buffer between residential and more intensively developed properties.

B. Permitted Uses. Specific categories of uses are listed in Chart 20.25D.070. LUC 20.25D.050 explains Chart 20.25D.070 and describes the applicable review procedures for BelRed. The description of the use chart contained in LUC 20.10.400 and the categories of uses contained in LUC 20.10.440 do not apply to the BelRed Land Use Districts.

C. General Development Requirements.

1. Regulations applying to specific structures or activities are found listed alphabetically in Chapter 20.20 LUC; consult the alphabetical Key Word Index in the beginning of that chapter.

2. BelRed specific standards and guidelines are found in Chapter 20.25D LUC. All development in BelRed shall conform to these requirements. (Ord. 5876, 5-18-09, § 2)

20.10.380 Evergreen Highlands Design District (EH).

A. Purpose. The Evergreen Highlands Design District provides an area for the location of high technology research and development facilities; associated light assembly and warehousing; other manufacturing uses with similar character, intensity and impact; support service and retail uses; office uses; corporate headquarters and residential uses. It represents a unique land resource, and is to be developed as a well integrated, mixed-use district sensitive to natural constraints and surrounding established development patterns. All development should exhibit high quality design, and maintain high performance levels.

B. The Evergreen Highlands Design District is divided into four performance areas as delineated by the Evergreen Highlands Zoning Map. These performance areas constitute separate land use districts and permit variation in use and development standards in order to implement the goals and policies of the Evergreen Highlands Subarea Plan, and to insure attention to specific environmental features of the various performance areas.

1. Evergreen Highlands Performance Area A (EH-A). The purpose of this performance area is to provide a location for Medium Density Multifamily development, not exceeding 11 units per gross acre. This performance area is intended to provide housing opportunities, and to serve as a transition to the lower density residential housing adjacent to the Evergreen Highlands Design District.

2. Evergreen Highlands Performance Area B (EH-B). The purpose of this performance area is to provide a location for lower intensity office uses. It serves as a transition between the residential development in Performance Area A and the higher intensity nonresidential uses in Performance Area C. This performance area constitutes the area of highest environmental sensitivity within the Design District, and development must reflect the natural limitations of the land.

3. Evergreen Highlands Performance Area C (EH-C). The purpose of this performance area is to provide a location for research and development activity, office uses, and convenience retail and service uses. This performance area will serve as the focal point for the entire Design District. It must be developed in a campus-like research and development park theme, and should be compatible with nearby less intense areas.

4. Evergreen Highlands Performance Area D (EH-D). The purpose of this performance area is to provide a location for office uses. It serves as a transition between the concentration of research and development and office uses to the north and the surrounding land use districts. 20.10.390 Medical Institution District (MI).

The Medical Institution (MI) District provides for the location of hospital uses and ancillary uses to the primary hospital use located on the same site or on sites in close proximity. The purpose of the district is to encourage comprehensive long-term master development planning for the properties designated MI and to allow flexible dimensional standards to facilitate development of major medical institutions and provision of the vital public services offered by these institutions. Specific development areas have been established in order to implement the objectives of the Medical Institution District.

A. Hospital Center Development Area (DA1). The purpose of the Hospital Center Development Area is to provide an area for the primary hospital and the most intensive ambulatory health care center uses to be located within close proximity. The tallest heights and largest floor plates in the MI district are appropriate in this area. The Hospital Center Development Area is located on the topographically lowest portion of the district adjacent to the freeway where pedestrian orientation is low and heights of the tallest campus structures and largest floor plates are most appropriate. The tallest heights are necessary for the primary hospital towers to accommodate patient bed demand in the region within floor plates that are sized appropriately for patient care delivery. Large floor plates are necessary for hospital diagnostic and treatment uses and ambulatory health care center uses to accommodate adjacencies of multiple operating rooms, interventional radiology rooms and urgent care. The Hospital Center Development Area provides the dimensional flexibility necessary to allow the primary hospital and ambulatory health care center uses to be located in close proximity and benefit from the collocation of complementary uses. Medical office uses may also be appropriate for this area, but do not have the same proximity needs as the ambulatory health care center uses. Gateways on 116th Avenue NE at NE 8th Street and NE 10th Street identify the entry into the district and provide wayfinding cues for identification of individual institutions located within the district.

B. Medical Office Development Area (DA2). The purpose of the Medical Office Development Area is to provide an area for medical office and hospital-related uses that are less dependent on immediate access to the primary hospital emergency rooms and patient beds. Taller buildings are appropriate in this area. Building mass variations (i.e., stepbacks, floor plate limitations) create transitions to less intense land use districts. Appropriate sidewalk widths, pedestrian-sensitive design and amenities and gateways ensure pedestrian orientation to perimeter sidewalks located on 116th Avenue NE and NE 12th Street. A gateway on 116th Avenue NE at NE 12th Street identifies the entry into the district.

C. Hospital Perimeter Development Area (DA3). The purpose of the Hospital Perimeter Development Area (DA3) is to provide an area for less intense hospital and ambulatory health care center uses to be located within close proximity to the primary hospital located in the Hospital Center Development Area (DA1). The Hospital Perimeter Development Area is located on a topographically sloping portion of the district adjacent to the Burlington Northern Railroad right-of-way where parking can be accommodated under the building and is appropriately separated from pedestrian ways. More modest heights are contemplated for the less intense hospital uses in the Hospital Perimeter Development Area, but floor plates remain sized appropriately for patient care delivery. Large floor plates are necessary for hospital diagnostic and treatment uses and ambulatory health care uses to accommodate adjacencies of multiple operating rooms, interventional radiology rooms and urgent care. The Hospital Perimeter Development Area provides the dimensional flexibility necessary to allow the less intense hospital uses and ambulatory health care center uses to be located in close proximity and benefit from the collocation of complementary uses. Medical office uses may also be appropriate for this area, but do not have the same proximity needs as the ambulatory health care center uses. (Ord. 5831, 8-4-08, § 1; Ord. 5587, 3-7-05, § 1)

20.10.395 Factoria Land Use Districts (F).

A. Factoria Land Use District 1 (F1). Factoria, F1 District is a mixed-use residential and regional retail center located adjacent to freeway corridors. It is to be developed as an aesthetically attractive urban village center to serve the Factoria community as well as shoppers attracted to the retail stores. Specific development areas and design guidelines apply within the district. Total size of the district is approximately 40 acres.

B. Factoria Land Use District 2 (F2). Factoria, F2 District provides for intensive office, movie theater, and service uses adjacent to freeway corridors in the Factoria area.

C. Factoria Land Use District 3 (F3). Factoria, F3 District provides for highly intensive office use in an integrated complex adjacent to freeway corridors in the Factoria area. This is the most intensive office district outside the Downtown. (Ord. 5385, 7-15-02, § 4)

20.10.397 Camp and Conference Center (CCC).

A Camp and Conference Center (CCC) provides areas for a unified mix of group day or residence camps and professional, educational, or religious meetings, conferences, seminars, and retreats and their associated facilities and activities. These are used primarily by organizations and schools and the families and individuals they enroll.

The purpose of the designation is to maintain the compatibility of this unique mix of uses with surrounding neighborhoods by limiting the overall intensity of the site, and protect lower intensity uses from the effects of higher intensity uses. (Ord. 6190, 11-3-14, § 4)

20.10.398 Mixed-Use Land Use Districts.

A. Purpose. The Mixed-Use Land Use Districts are intended to be walkable, transit-oriented, and dense urban neighborhoods with a mix of uses that support the local and regional economy and a livable community. Refer to LUC 20.10.445 for allowed uses.

1. Goals.

a. Develop Mixed-Use Districts as livable, sustainable, viable, and memorable neighborhoods;

b. Promote sustainable and resilient development that is responsive to the climatic and regional context of Bellevue;

c. Encourage safe, functional, and attractive development that prioritizes pedestrians, and promotes sustainable transportation options;

d. Develop cohesive and contextual urban development with a strong identity and connection to adjacent neighborhoods; and

e. Foster a sense of community, pride, and stewardship of the built and natural environment.

B. District Descriptions.

1. Urban Core (UC). The purpose of the UC Land Use District is to provide for the highest-density mixed-use development near to Downtown. The district is limited in area so that the highest levels of density outside of Downtown are nearest to unique public amenities located within the districts, such as light-rail stations, the Grand Connection, and Eastrail.

2. Mixed-Use Highrise (MU-H). The purpose of the MU-H Land Use District is to provide for a mix of housing, retail, service, office, and complementary land uses at a high scale and density. The district provides a level of intensity appropriate for areas in proximity to high levels of transit and activity in mixed-use centers.

3. Mixed-Use Midrise (MU-M). The purpose of the MU-M Land Use District is to provide for a mix of housing, retail, service, office, and complementary land uses at a medium scale and density. The district provides for a transition between higher and lower density land use districts in mixed-use areas throughout the City.

4. Mixed-Use Residential Midrise (MUR-M). The purpose of the MUR-M Land Use District is to provide primarily for housing with retail, service, office, and complementary uses at lower floors at a medium scale and density. The district provides a transition between higher and lower density land use districts while providing shopping, services, and amenities close to housing. (Ord. 6846, 6-17-25, § 4)

20.10.400 Use chart described – Interpretation.

(Note: This section is not applicable in the Shoreline Overlay District.)

In Chart 20.10.440, land use classifications and standard Land Use Code reference numbers are listed on the vertical axis. City of Bellevue land use districts are shown on the horizontal axis.

A. If no symbol appears in the box at the intersection of the column and the row, the use is not allowed in that district, except for certain short-term uses (see Temporary Use Permits, Part 20.30M LUC).

20.10.410 Use prohibited in all land use districts.

Medically Supervised Consumption Centers (MSCC) designed to provide an hygienic environment where individuals are able to consume illicit drugs intravenously or by other means are prohibited in all land use districts in the City. An MSCC includes all uses established or activities undertaken for the above-defined purposes, irrespective of how the use or activity is described. An MSCC may also be referred to as a medically supervised injection center, community health engagement location, supervised injection site or facility, safe injection site, fix room, or drug consumption facility. 20.10.420 Interpretation of land use charts by Director.

(Note: This section is not applicable in the Shoreline Overlay District.)

A. Director’s Authority. In the case of a question as to the inclusion or exclusion of a particular proposed use in a particular use category, the Director shall have the authority to make the final determination. The Director shall make the determination according to the characteristics of the operation of the proposed use and based upon the Director’s interpretation of the Standard Land Use Coding Manual, the Standard Industrial Classification Manual and the North American Industry Classification System.

B. Conflict.

1. In the case of a conflict between the Land Use District descriptions contained in LUC 20.10.180 through 20.10.395 and a use chart, the use charts contained in LUC 20.10.440 or Chapter 20.25 LUC shall prevail.

2. In the case of a conflict between the Land Use District descriptions contained in LUC 20.10.398 and LUC 20.10.445, LUC 20.10.445 shall prevail.

C. Appeal. An applicant may appeal the final decision of the Director provided pursuant to subsection A of this section by requesting an interpretation of the use charts contained in LUC 20.10.440 or Chapter 20.25 LUC relating to the inclusion or exclusion of a proposed use. This request for interpretation of the Land Use Code charts will be processed pursuant to Part 20.30K LUC. (c)Nonrecreation uses in City parks in all zones outside the Downtown require conditional use approval, except that the permit requirements for wireless communication facilities shall be as set forth in LUC 20.20.195. For purposes of this requirement, “nonrecreation use” means a commercial, social service or residential use located on park property but not functionally related to City park programs and activities

(1)No more than 50 percent of the gross floor area of the structure shall be devoted to residential use in O Districts, unless Conditional Use Permit approval is obtained and the applicable Comprehensive Plan policies do not discourage multifamily uses.

(2)Five or more dwelling units per lot are only permitted where the middle housing density allows five or more units per LUC 20.20.538, or as permitted by the underlying density or other applicable code allowance.

(3)A boardinghouse or bed and breakfast is permitted in a single-family dwelling, provided the requirements of LUC 20.20.140 are met.

(4)An agreement must be recorded with the King County Recorder’s Office, or its successor agency, and filed with the Bellevue City Clerk, restricting senior citizen dwellings, congregate care senior housing, or assisted living to remain for the life of the project.

(8)These residential uses are permitted in NB and NMU Districts only if located on the second floor and above the permitted ground floor nonresidential uses.

(11)The Director may allow a departure from the requirement to provide ground floor neighborhood serving (nonresidential) uses in multifamily developments; provided, that the departure is necessary to mitigate an economic hardship that would preclude project viability. A departure may be granted where the applicant demonstrates that:

(a)The required neighborhood serving uses do not front on an arterial;

(b)Visual and physical access to the required neighborhood serving uses is limited by topography or other site-specific obstacles; and

(c)The required neighborhood serving uses would not be visible from other development located in the NMU District, adjacent neighborhoods, nearby arterials or highways.

A departure may be allowed for all sides of the building or some portion thereof; provided, that the approved departure is consistent with the NMU Land Use District definition included in the Comprehensive Plan and LUC 20.10.350. If a departure is granted, ancillary residential uses such as a meeting room, leasing office, kitchen, daycare and work-live space are preferred over occupied residential living space.

(a)On-site capacity for vehicle stacking of 10 spaces for 1 drive-up station and 20 spaces for 2 or more drive-up stations must be provided.

(b)The design of the vehicular access is compatible with high volume pedestrian walkways and parking access. The vehicular access will not disrupt established retail or service frontages designed to serve pedestrians, nor can the vehicular access lanes be located between the street and the main pedestrian access to the buildings.

(c)The vehicle stacking lanes must be contained within a structured parking area, or be otherwise screened.

(d)Landscaping or screening must be provided to mitigate any adverse effects on nearby property. Perimeter walkways and sidewalks must conform to the requirements of LUC 20.25A.060.

(e)Walk-up banking service, whether manned or electronically activated customer service stations, must be provided on site during regular daytime business hours for pedestrian business when there is no interior banking service.

(14)These uses are permitted only in Bellevue School District schools, whether under control of the School District or the City.

(a)In the review of the proposed use or uses under the Administrative Conditional Use Permit application, Part 20.30E LUC, the following criteria shall be considered:

(i)Consistency of the proposal with the goals and policies of the Comprehensive Plan.

(ii)Extent to which the physical environment will be modified by the proposal.

(iii)Ability to provide on-site parking facilities to accommodate intended uses under the proposal.

(iv)Extent of additional demand on public utilities and public services resulting from the proposal.

(v)Noise impacts of the proposal.

(vi)Traffic volumes and street classifications in the area of the proposal.

(vii)Compatibility of the proposal with surrounding land uses.

(viii)Impact of the proposal on the visual and aesthetic character of the neighborhood.

In addition, the proposed use or uses shall not be more intensive than if the school were being used as a school.

(b)A master Conditional Use Permit listing a range of permissible uses from those permitted in the land use district as listed in LUC 20.10.440 can be obtained for the entire school by using the conditional use process, Part 20.30B or LUC 20.25E.150 and 20.25E.180. Uses listed in the permit shall be permitted outright and uses not listed but permitted as conditional uses shall obtain a Conditional Use Permit.

(15) Permitted in inactive elementary school facilities: The following criteria shall be considered:

(a)Subsections a.i through viii of Note 14 – Uses in land use districts – Services.

(b)Hours of operation.

(c)Proposed signing.

(16)Other than administrative office use, each individual service use in NB Districts is limited to 5,000 square feet. Administrative office use is limited as follows: When located on the first floor of a building, administrative office use is limited to 5,000 square feet or 25 percent of the first floor footprint, whichever is less; when located above the first floor of a building, administrative office use is allowed without a limit on total aggregate square footage, so long as each individual administrative office use is limited to 5,000 square feet. In no event may administrative office uses exceed more than 50 percent of the total building square footage. Administrative conditional use approval is required for hours of operation between 12:00 midnight and 6:00 a.m. The applicant must meet the decision criteria for an Administrative Conditional Use Permit set forth in Chapter 20.30E LUC, and must demonstrate that: (a) the use shall meet the requirements of the Noise Control Ordinance, Chapter 9.18 BCC; and (b) the use shall meet the lighting standards of the Community Retail Design District in LUC 20.25I.050 and 20.25I.060 for all lighting fixtures on the premises that would be lit between the hours of 12:00 midnight and 6:00 a.m. Businesses operating between the hours of 12:00 midnight and 6:00 a.m. on the effective date of City of Bellevue Ordinance No. 4422 are exempt from the ACUP requirements.

(17)Only travel agencies are permitted in NB Districts.

(18)Rental services limited to truck, trailer and tool rentals are permitted in NB Districts with administrative conditional use approval, provided the site has two street frontages.

(19)Auto repair and washing services are permitted with administrative conditional use approval only in NB sites that have two street frontages.

(20)Personal services are permitted only when functionally integrated within a building or complex used primarily as a hotel or motel; office building; university or college; charitable, social service, professional or labor organization; or recreational facility.

(21)Uses are limited to neighborhood community police stations of 1,000 square feet or less.

(22)Uses are limited to 1,000 square feet, except for protective functions which are limited to community police stations of 1,500 square feet or less.

(23)No portion of a property on which a secure community transition facility is proposed to be located may be within 300 feet of the boundary of any land use district within which the SCTF use is prohibited. The required 300 feet shall be measured in accordance with the policy guidelines established by the Department of Social and Health Services pursuant to RCW 71.09.285(4), now or as hereafter amended.

(25)Primary and secondary educational facilities are an administrative conditional use in all land use districts; provided, that in all residential land use districts and the DNTN-R District a Conditional Use Permit is required for:

(a)The siting of such educational facility on a site not previously developed with an educational facility; or

(b)The addition to or modification of a site previously developed with an educational facility where that addition or modification involves:

(i)An increase of 20 percent or more in the number of students occupying the school. The increase shall be measured against the number of students for which the school was designed prior to the addition or modification, without regard to temporary structures that may have been added to the site over time. If there is no information establishing the number of students for which the school was originally designed, then the increase shall be measured against the average number of students occupying the school in the three academic years immediately preceding the proposed addition or modification; or

(ii)A change in the age group of students occupying the school, or the addition of an age group where such age group was not previously served at the school, except that the addition of students younger than kindergarten age consistent with the definition of school in LUC 20.50.046 shall not be considered a change in the age group of students or an addition of an age group for purposes of this subsection. For purposes of this subsection, age group refers to elementary, middle, junior or high school, as defined and used by the school district operating the school; or

(iii)The addition of facilities or programs that may result in impacts not anticipated at the time the original school was developed, including, for example: development of lighted ballfields or the addition of lighting to existing ballfields; development of an exterior sound amplification system; development of fixed outdoor seating; or a proposal to increase the height of the facility pursuant to LUC 20.20.740.A.3.b.

(26)Battery exchange stations are ancillary to auto repair and washing services, and are permitted through the applicable review process as a component of that use. Operators of battery exchange stations must comply with federal and state law regulating the handling, storage, and disposal of batteries.

The applicant must meet the decision criteria for an Administrative Conditional Use Permit set forth in Chapter 20.30E LUC, and must demonstrate that: (a) the use shall meet the requirements of the Noise Control Ordinance, Chapter 9.18 BCC; and (b) the use shall meet the lighting standards of the Community Retail Design District in LUC 20.25I.050 and 20.25I.060 for all lighting fixtures on the premises that would be lit between the hours of 12:00 midnight and 6:00 a.m. Businesses operating between the hours of 12:00 midnight and 6:00 a.m. on the effective date of the ordinance codified in this chapter are exempt from the ACUP requirements.

(6)Retail auto sales are permitted only in the following locations:

(a)The west side of 116th Avenue NE between NE 8th Street and the SE 8th Street off-ramp from northbound I-405;

(b)Along SE 36th Street west of the ravine located at the approximate alignment of 133rd Avenue SE and east of 132nd Avenue SE; and

(c)Fronting on SE 37th Street in the NMU District where the subject property was zoned General Commercial prior to the adoption of Ordinance No. 6366 on August 15, 2017.

(7)Motorcycle (retail) requires administrative conditional use approval in LI Districts.

(8)Garden supply retail and nurseries are permitted uses in these residential districts when they have been operating continuously since prior to 1955.

(11)Furniture and home furnishings are limited to uses with on-site warehousing in LI Districts.

(12)Computer supplies are permitted as a subordinate use to computer sales in LI and GC Districts.

(13)Eating and drinking establishments are excluded in transition areas in O Districts.

(14)Eating and drinking establishments are permitted in the OLB, F2 and F3 Districts subject to the following criteria:

(a)Such uses are physically integrated within a structure primarily used as a hotel or motel; office building; charitable, social, professional and labor organization; fraternal lodge; recreational facility or institution such as a public assembly (indoor).

(b)Such uses do not exceed 20 percent of the gross floor area of the structure or structures.

(c)The entire site complex has a unity of design in terms of wall and roof materials, roof slopes and window patterns.

(15)Eating and drinking establishments are permitted in LI Districts only if located in a multiple function building or complex.

(16)Eating and drinking establishments may include liquor sales only if operated under a Class A or C liquor license issued by the Washington State Liquor and Cannabis Board. Eating and drinking establishments with other classes of liquor licenses require administrative conditional use approval.

(17)Other retail trade is limited to drugstores only in O Districts.

(19)Except for drugstores, all miscellaneous retail uses combined cannot exceed 10,000 square feet and each individual use cannot exceed 3,000 square feet.

(20)The term “garden supplies” excludes items such as large trees, rock and bulk supplies which require special handling equipment in NB, CB, and F1 Districts.

(21)Limited to a maximum of 1,500 gross square feet per establishment.

(36)Retail uses in CB Districts in the following subareas, as designated in the Comprehensive Plan, are limited in size to 100,000 gross square feet or less: Bridle Trails, Evergreen Highlands, Newcastle, North Bellevue, Northeast Bellevue, Richards Valley, South Bellevue, Southeast Bellevue, and Wilburton; provided, that in CB Districts in the Wilburton Subarea, retail uses may be allowed to exceed 100,000 gross square feet through a Council-approved development agreement that is consistent with Chapter 36.70B RCW and includes design guidelines that (a) address the potential impacts of that scale of retail use, and (b) are consistent with the vision of Comprehensive Plan Policy S-WI-3 regarding the creation of a “retail village” on the commercial area west of 120th Avenue NE.

(37)Microbrewery manufacturing is permitted subordinate to an eating and drinking establishment; provided, that the manufacturing use occupies not more than 50 percent of the total square footage of the combined establishment.

(39)All wholesale and retail uses, which offer shopping carts to customers, shall (a) designate a shopping cart containment area as defined in BCC 9.10.010; (b) display signage around shopping cart corrals and at the perimeter of the shopping cart containment area that provides notice that unauthorized removal of a shopping cart from the premises constitutes theft under RCW 9A.56.270 and unauthorized abandonment of a shopping cart more than 100 feet away from the parking area of a retail establishment or shopping cart containment area is a Class 3 civil infraction as defined in RCW 7.80.120; and (c) display information on each shopping cart that is consistent with the labeling requirements of RCW 9A.56.270 and includes a 24-hour toll-free phone number to report abandoned shopping carts. Abandoned shopping carts or shopping carts located outside of a shopping cart containment area constitute a public nuisance under BCC 9.10.030(H) and may be abated through the provisions of Chapter 1.18 BCC.

(40)Battery exchange stations are ancillary to gasoline service stations, and are permitted through the applicable review process as a component of that use. Operators of battery exchange stations must comply with federal and state law regulating the handling, storage, and disposal of batteries.

(42) Marijuana retail outlet excludes medical marijuana cooperative: Medical marijuana cooperatives, as authorized under RCW 69.51A.250, now or as hereafter amended, are prohibited in Bellevue. See LUC 20.20.535 for general requirements applicable to marijuana uses.

20.10.445 Land uses in Mixed-Use Land Use Districts.

A. Applicability. This section only governs land uses in mixed-use land use districts established under LUC 20.10.020 and described in LUC 20.10.398. The provisions of this section do not apply to any other land use districts.

B. Permitted Uses.

1. All land uses are permitted outright, except as provided in this subsection B, and except those expressly prohibited under LUC 20.10.445.C and those permitted only as conditional uses under LUC 20.10.445.D.

2. Land uses may be permitted either as the principal use or a subordinate use subject to LUC 20.20.840.

3. In the case of a question as to the inclusion or exclusion of a particular proposed land use, the Director shall have the authority to make the final determination per LUC 20.10.420.

4. District-Specific Requirements. Land uses described below are permitted in the land use districts described below, but subject to specific requirements as follows:

a. In the MUR-M Land Use District, nonresidential uses may only be located within the first two stories of a building, except eating and drinking establishments may be located on the top story of a building.

5. Use-Specific Requirements. The following land uses are permitted, but structures or sites containing such uses are subject to specific requirements as follows:

a. Manufacturing Uses. Structures containing manufacturing uses shall be limited to 20,000 gross square feet. Larger structures containing manufacturing uses may be allowed through an Administrative Departure as provided in LUC 20.25R.010.D.4.

b. Uses Relating to the Sale, Lease, or Rental of Automobiles or Motorcycles.

i. Intent. The purpose of these standards is to govern future development or redevelopment of structures or sites relating to the sale, lease, or rental of automobiles or motorcycles. The intent is not for existing structures or sites relating to the sale, lease, or rental of automobiles or motorcycles that were in existence prior to June 24, 2025, to meet these standards in order to continue to operate. However, if these standards are not met, such existing structures or sites are nonconforming for the purposes of LUC 20.20.561.

ii. Standards.

(1) Outdoor storage or display of automobiles or motorcycles is prohibited between the building and any public right-of-way.

(2) Outdoor storage or display areas shall not exceed 10 percent of the total lot area. A larger outdoor storage or display area may be allowed through an Administrative Departure, as provided in LUC 20.25R.010.D.4.

(3) Surface parking areas may be located between the primary building and a public right-of-way, consistent with subsection B.5.c of this section. These areas may also be used for additional outdoor storage or display; provided, that all automobiles and motorcycles are stored indoors outside of business operating hours.

c. Surface Accessory Parking Serving a Permitted Use. Surface accessory parking located on any site may not exceed 10 percent of the lot area, or 15 percent for small sites. Larger surface accessory parking may be allowed through an Administrative Departure as provided in LUC 20.25R.010.D.4.

i. Surface accessory parking shall be measured as the area of all parking spaces and drive aisles adjacent to parking spaces.

ii. Existing nonconforming surface accessory parking may be resurfaced and restriped; provided, that:

(1) No additional hard surface coverage is added to the site; and

(2) If restriping results in a reconfigured parking area or increases the number of parking spaces, the spaces shall meet applicable requirements in LUC 20.20.590.K.

C. Prohibited Uses. The following land uses are prohibited as both principal and subordinate uses, except as otherwise noted:

1. Agricultural production of animals and animal products.

2. Agricultural processing.

3. Drive-in businesses and drive-throughs.

4. Hazardous waste treatment and storage facilities (both on or off site), unless associated with medical or life science uses and meeting all applicable standards for safe storage and handling of hazardous waste.

5. Junk yards.

6. Marijuana producers and marijuana processors, as defined in LUC 20.20.535.

7. Any use containing outdoor storage or outdoor displays, except:

a. Outdoor storage for florists and other horticultural uses, including nurseries;

b. Temporary outdoor display of retail products; and

c. As provided in subsection B.5.b of this section.

8. Recycling centers, solid waste collection areas, or solid waste disposal facilities, except those qualifying as subordinate uses under LUC 20.20.725 or meeting the requirements of LUC 20.20.820.

9. Warehousing and storage services.

10. Any land use prohibited under LUC 20.10.410.

D. Conditional Uses.

1. The following land uses shall require an Administrative Conditional Use Permit pursuant to Part 20.30E LUC:

a. Animal boarding and commercial kennels, except these uses may be permitted as subordinate to retail pet shops, pet day cares, pet grooming, and veterinary clinics or animal hospitals.

b. Electrical utility facilities.

c. Marijuana retail outlets, as defined in LUC 20.20.535, subject to the requirements of LUC 20.20.535.

d. Motor vehicle transportation, such as bus terminals and taxi headquarters.

e. Primary and secondary educational facilities, subject to the requirements of LUC 20.20.740.

2. The following land uses shall require a Conditional Use Permit pursuant to Part 20.30B LUC:

a. Essential public facilities.

b. Homeless services uses, as defined in LUC 20.20.455.

c. Regional utility system.

d. Transient lodging.

e. Utility facilities, except heat recovery systems may be permitted outright. (Ord. 6846, 6-17-25, § 6)
