CARE FACILITIES

§ 156.180 FINDINGS.

   The Village Board of Trustees of the village finds that affordable, good quality and licensed child care within the village is critical to the well-being of parents and children of the community and is a needed community service and is otherwise a benefit to the public health, safety, morals and welfare of the village. Further, it is the purpose of this subchapter to facilitate the siting of licensed home day care facilities in the village in such a manner that refines the review and approval process while ensuring harmony and conformance with surrounding land uses.

§ 156.181 DEFINITIONS.

   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   CHILD CARE FACILITY. A building or structure in which an appropriate person or persons regularly provide home day care. CHILD CARE FACILITIES include any home day care facility regulated by the Illinois Department of Children & Family Services pursuant to the laws of the State of Illinois.
   HOME DAY CARE.  
      (1)   The provision of supplemental parental care supervision in a residential environment:
         (a)   For a fee;
         (b)   For a non-related child or children;
         (c)   On a regular basis;
         (d)   For less than 24 hours a day; and
         (e)   Under license by the State of Illinois.
      (2)   Exemption: As used in this subchapter, the term, HOME DAY CARE, is not intended to include:
         (a)   Babysitting that is of a casual, non-recurring nature or which occurs in the child's own home; or
         (b)   Cooperative, reciprocal child care by a group of persons in their respective homes.

§ 156.182 AMENDMENT TO ZONING ORDINANCE REGULATION PERTAINING TO HOME DAY CARE FACILITIES.

   The appropriate sections in Chapter 156 are hereby amended to reflect the following: home day care facility shall be permitted as conditional use in all residentially zoned districts subject to demonstrating the following:
   (A)   Satisfaction of all State of Illinois Department of Children & Family Service licensing requirements;
   (B)   Compliance with all applicable building, fire safety, health codes, and business registration requirements;
   (C)   Conformance with all applicable lot size, building size, setback and lot coverage requirements, except if the structure is a legal non-conforming structure;
   (D)   Filing of a home day care registration form with the Village Comptroller' office;
   (E)   Making no structural or decorative alterations that would (i) alter the residential character of an existing or proposed residential structure or (ii) be incompatible with surrounding residences;
   (F)   Providing a safe passenger loading area;
   (G)   Conformance with the parking requirements contained in Chapter 156;
   (H)   Landscaping the site in a manner compatible with adjacent residences;
   (I)   Providing a fence of at least four feet in height around the required yard;
   (J)   Demonstrating that the proposed site is not located within 1,000 feet of another home day care and child care facility as measured nearest lot line to nearest lot line or that no more than two other home day care and child care facilities currently exist on the same block of the proposed site, block shall mean and be measured as "city block" rather than street designation;
   (K)   Demonstrating compliance with any other reasonable regulation imposed by the zoning official or the Planning Commission

§ 156.183 ADMINISTRATIVE REVIEW.

   The zoning official shall review all applications for a conditional use permit for a home day facility, upon review of the application if the zoning official may recommend one of the following to the Planning Commission:
   (A)   That a full hearing be conducted on the application and as a result of such recommendation all required notices and fees shall be made and assessed as per Chapter 156 and ordinances of the village; or
   (B)   Approval of application by zoning official:
      (1)   Upon review of the application if the zoning official has determined that the applicant has complied with and met the standards set forth in § 156.182 the zoning official may recommend approval of the application to the Planning Commission. If the zoning official makes such a determination and recommendation the zoning official shall provide public notice of the recommendation by posting notice at the proposed site and in two other public notice locations, such as the Public Notice Board in the police station lobby or the local public library, at least ten calendar days prior to final action by the Planning Commission on the application.
      (2)   Upon review of the application by the Planning Commission it may:
         (a)   Concur with the zoning official's recommendation and approve the application; or
         (b)   Require a full hearing on the application subject to the requirements and notices as provided in Chapter 156;
      (3)   The zoning official or Planning Commission, as the case may be, may include reasonable conditions to any recommendation for approval respectively, which shall include but not be limited to approval of application by the Village Board of Trustees.
