CHAPTER 1141

Districts Established; Zoning Map

1141.01 DESIGNATION OF ZONING DISTRICTS.

   For the purpose of the Zoning Ordinance, the City is hereby divided into eight zoning districts, differentiated according to permitted uses and building regulations. These eight zoning districts are designated as follows:
 
R-1   Residential District
R-2   Residential District
C-1   Central Business District
C-2   General Commercial District
C-3   Commercial Recreation District
M-1   Manufacturing District
P-1   Public and Semipublic District

1141.02 ZONING MAP.

   The location and boundaries of the zoning districts are hereby established as shown on the official Zoning District Map adopted by the City, and on file in the office of the Clerk of Council. The official Zoning District Map, together with any map inserts, amendments, notations, references or designations shown thereon is hereby made a part of the Zoning Ordinance as if the same were fully described and set forth herein.

1141.03 INTERPRETATION OF BOUNDARIES.

   (a)   Designation of Zone Boundaries. The zone boundary lines are intended to follow the right-of-way lines of streets, existing lot and property lines, and City corporation lines, all as shown on the Zoning District Map; but where a zone boundary line does not follow such a line, its position is shown on the Zoning District Map by a specific dimension expressing its distance in feet from a street line or other boundary line as indicated, or by reference to a contour line delineated on the United States Geological Survey Maps.
   (b)   Determination of Locations for Boundaries. In the event of uncertainty as to the true location of a zone boundary line in a particular instance, any decision of the Zoning Official may be appealed before the Board of Zoning Appeals by any affected property owner. It shall be the duty of the Board of Zoning Appeals to render its determination with respect thereto.
   (c)   Division of a Lot or Parcel in Single Ownership. Where a zone boundary line divides a lot or parcel in single ownership at the time of the passage of the Zoning Ordinance, any use authorized or permitted in either zone may be extended a distance not to exceed fifty feet beyond the boundary of the zone in which such use is authorized or permitted.

1141.04 LAND USAGE.

   No building, or part thereof, or other structure shall be erected, altered, added to or enlarged for any purpose other than the permitted uses, accessory uses, or special uses permitted in the zone in which such building, land or premises is located, except that a less restrictive use shall be permitted.
   For example, a residence may be erected within a commercial or manufacturing zone, and a commercial use may be allowed in a manufacturing zone.

1141.05 CLASSIFICATION OF ANNEXED LANDS.

   (a)   Any land annexed to or made a part of the City subsequent to the adoption of the Zoning Ordinance, shall immediately be classified in the zone district to which it is contiguous, as of the effective date of annexation. In the event the annexed land is contiguous to an area having more than one type of zoning district, it shall be classified as that zone district which is most predominant.
   (b)   Within sixty days from the effective date of any annexation proceedings, however, the Planning Commission shall prepare and submit to Council a report and study of its recommendations for the zoning or rezoning of the annexed territory. The Planning Commission shall hold at least one public hearing thereon before submitting its final report to Council.
   (c)    At its next regular meeting following receipt of the final report of the Planning Commission, Council shall authorize the necessary legislation affecting the annexed land to amend the Zoning Ordinance and/or Zoning District Map in accordance with Chapter 1133 .
