Sec. 8.2. - Area modification for lots of record.

(1)

Where a lot of record at the time of the effective date of this ordinance has less area or less width than herein required for the district in which it is located, said lot may nevertheless be used as a building site upon an approval to and approval by the building and inspections department.

(2)

In residential districts, the side yard provided for a small lot of record shall not be less than one-half of the required side yard and approved by building and inspections department and fire department.

(3)

In non-residential districts, the side yard for a small lot of record shall not be less than one-half of the required side yard and approved by building and inspections department and fire department.

Sec. 8.3. - General yard requirements.

(1)

No yard, open space, or lot area required for a building or structure shall, during its life, be occupied by, or counted as open space for any other building or structure.

(2)

Every part of a required yard shall be open to the sky (except for landscaping) unobstructed by any accessory structure or part thereof and unoccupied for storage, servicing or similar use except as provided herein.

(3)

Accessory structures shall not be located in any required front yard.

(4)

More than one multiple dwelling, institutional or industrial building may be located upon a lot or tract, but such buildings shall not encroach upon the front, side, and rear yards required by the district regulations.

(5)

An attached or detached private garage which faces a street shall not be located closer than 25 feet to the street right-of-way line.

Sec. 8.4. - General yard modifications.

(1)

The following structures shall be allowed to project or be constructed in any required yard or beyond the building setback line, subject to all limitations set forth herein.

(a)

Awnings and canopies, not to exceed three feet.

(b)

Bay windows and chimneys, not to exceed two feet.

(c)

Driveways, curbs, sidewalks and steps, provided, however, steps or stairs to a dwelling, nonenclosed, not to exceed six (6) feet.

(d)

Fences, walls, and hedges, subject to the regulations as set forth in this section.

(e)

Flagpoles.

(f)

Garbage disposal equipment, nonpermanent.

(g)

Landscape features, planting boxes and recreational equipment.

(h)

Overhanging roof, eaves, gutter, cornice, or other architectural features, not to exceed three feet. Open fire escapes may extend into any required yard not more than six feet.

(i)

Parking space subject to the regulations set forth in section 10.

(j)

Signs, subject to the regulations set forth in section 11.

(k)

Terraces (open) and porches (nonenclosed) not to exceed six feet.

(l)

Trees, shrubs, flowers, and other plants subject to the vision requirements in this section.

Sec. 8.5. - Front yard modifications.

(1)

Where 40% or more of the frontage on the same side of a street between two intersecting streets is presently developed or may hereafter be developed with buildings that have a front yard greater or lesser in depth than herein required, new buildings shall not be erected closer to the street than the average front yard so established by the existing buildings.

(2)

Where 40% or more of the frontage on one side of a street between two intersecting streets is presently developed or may hereafter be developed with buildings that do not have a front yard as described above, then:

(a)

Where a building is to be erected on a parcel of land that is within 100 feet of existing buildings on both sides, the minimum front yard shall be a lien drawn between the closest front corners of the adjacent buildings, or

(b)

Where a building is to be erected on a parcel of land that is within 100 feet of an existing building on one side only, such building may be erected as close to the street as the existing adjacent building.

(3)

Through lots shall provide the required front yard on both sides.

(4)

With the exception of small lots of record, corner lots shall provide a front yard on each street side.

(5)

Outdoor displays of merchandise, where permitted, shall have a setback from the street right-of-way lien of not less than one-half of the distance of the required setback.

Sec. 8.6. - Rear yard modifications.

(1)

Accessory structures may be built in a rear yard, but such accessory structures shall not occupy more than 30 percent of the required rear yard space and shall not be closer than five feet to any side or rear lot line.

Sec. 8.7. - Walls and fences.

(1)

No fence, wall, planting or structure shall be located so as to constitute a hazard to pedestrian or vehicular traffic on the public right-of-way. The Bessemer Police Department and city engineer of public safety shall assist in the determination of the existence of a hazard.

(2)

No wall or fence in a required front yard shall exceed a height of three and one-half feet, except as required for a retaining wall. Fence shall be a decatorive fence and approved by the building official.

Sec. 8.8. - Lighting and glare.

(1)

Direct or reflected light or glare shall not be produced so as to adversely affect the visibility or tend to interfere with the safety or welfare of persons located at or beyond any property line.

Sec. 8.9. - Height modification.

(1)

Chimneys, cooling towers, elevator bulkheads, fire towers, gas tanks, steeples, penthouses, stacks, tanks, water towers and ornamental towers and spires, where permitted may be erected to any height not in conflict with existing or hereafter adopted ordinances of the City of Bessemer, except that where permitted in connection with residential uses, such structures shall be limited to a height of twenty-five feet above the average height of structures permitted in that district.

(2)

Churches, schools and other public and semi-public buildings may exceed the height limitations of the district if the minimum depth of the front, side and rear yards required in the district is increased one foot for each two feet by which the height of such public or semi-public structure exceeds the height limit.

Sec. 8.10. - Landscape and buffer requirements.

(1)

Purpose of definition of bufferyards.

Bufferyards are a permanent unit of land together with the plantings and structures required thereon. Both the amount of land and the type and amount of planting specified for each bufferyard required by this ordinance are designed to ameliorate nuisances between adjacent land uses or between a land use and a public road.

The planting units required of bufferyards/screening have been calculated to insure that they do, in fact, function to "buffer" and provide an aesthetically pleasing environment. Bufferyards/screening shall be required to separate different land uses from each other in order to eliminate or minimize potential nuisances such as dirt, litter, noise, glare of lights, signs, and unsightly buildings or parking areas, or to provide spacing or reduce adverse impacts of noise, odor, or danger from fires or explosion.

(2)

Location of bufferyards/screening. Bufferyards/screening shall be located on the outer perimeter of a lot or parcel, extending to the lot or parcel boundary line. Bufferyards/screening shall not be located on any portion of an existing public or private street or right-of-way.

(3)

Determination of bufferyard/screening requirements. To determine a bufferyard/screening required between two adjacent parcels or between a parcel and a street, the following procedure shall be followed:

(a)

Identify the proposed land use.

(b)

Identify the use of land adjacent to the proposed use.

(c)

Determine the bufferyard/screening required on each boundary (or segment thereof) of the subject parcel by referring to the following Table of Bufferyard Requirements and illustrations which specify the bufferyard/screening required between streets and adjacent land uses.

(4)

Responsibility for bufferyard/screening.

(a)

When a use is first to develop on two adjacent vacant parcels, the first use shall provide the buffer, specified by the Table of Bufferyard Requirements for vacant land.

(b)

The second use to develop shall at the time it develops, provide all additional plant material structures and/or land necessary to provide the total bufferyard/screening required between the two uses, as specified by the Table of Bufferyard Requirements.

(5)

Bufferyard/screening/landscaping specifications.

(a)

The exact placement of required plants and structures shall be the decision of the developer. Required landscaping shall be designed in such a manner as to impart its aesthetic character when viewed from any area accessible to the public or from adjacent properties.

(b)

Plant materials used for installation shall conform to the standards established by the American Association of Nurserymen in the "American Standard for Nursery Stock," for each type (i.e., canopy tree, shrub, conifer, etc.) with minimum size as appropriate for the minimum caliper/container size designated herein.

Grass sod must be healthy, clean and reasonably free of weeds, noxious pests and diseases.

(e)[(d)]

Installation - All landscaping/screening shall be installed in a sound, workman-like manner and according to accepted good planting procedures with the quantity and quality of plant materials as described. All elements of landscaping shall be installed so as to meet all other applicable ordinances and code requirements.

(f)[(e)]

Maintenance - The owner, occupant, tenant and the respective agent of each, if any, shall be jointly and severally responsible for the maintenance of all bufferyard/screening/landscaping. Landscaping shall be maintained in a good condition so as to present a healthy, neat and orderly appearance at least equal to the original installation and shall be kept free from refuse and debris. Dead vegetation and landscaping material shall be promptly replaced with healthy, living plantings.

(g)[(f)]

Grass establishment shall be:

-

Sodded, plugged, sprigged or seed.

-

Sod only in high erosion area.

-

Seed must provide coverage within 30 days (assuming appropriate growing conditions).

(6)

Bufferyard substitutions.

(a)

The following plant material substitutions shall satisfy the requirements of this ordinance.

-

Any existing healthy, well-formed plant materials which are greater than or equal to the recommended buffer and which otherwise satisfy the requirements of this section may be counted toward satisfying all such requirements.

-

Structures, where required, may be substituted with approval of the planning and zoning commission.

(7)

Use of bufferyard.

(a)

If approved by the building and inspections department, a bufferyard may be used for passive recreation; however, no plant material may be removed and such use shall not be a nuisance.

(8)

Bufferyards part of required yards.

(a)

Where front, side and rear yards are required by this ordinance, bufferyards may be established within such required yards.

(9)

Screening.

(a)

Outdoor trash receptacles and storage areas shall be screened by using an opaque fence or a masonry wall, at a minimum of 6 feet in height. The fence or wall shall be combined with evergreen shrubs planted in a 3-foot minimum planting area around the foundation of the fence or wall.

(b)

Outdoor fencing. The fence or wall shall be combined with evergreen shrubs planted in a 3 foot minimum planted area around the foundation of the fence or wall.

(c)

All fencing and masonry shall be consistent with the proposed structures.

(10)

Definitions.

(a)

Berm: A mound of earth.

(b)

Broadleaf: Leaves which are broad in basic structure.

(c)

Canopy or overstory tree: A tree with a large, broad spreading crown, usually, broadleaf and deciduous with minimum mature height of 40 feet.

(d)

Conifer: Cone bearing plants, usually having large needlelike leaves or smaller scalelike leaves. Most are evergreen but can be deciduous.

(e)

Deciduous: Leaves fall off or are shed each year.

(f)

Evergreen: A plant which has green foliage throughout the year.

(g)

Groundcover: Plants growing close to the ground which spread to form a dense covering over the ground.

(h)

Mulch: A protective covering (such as pine straw or bark) spread on the ground especially to reduce evaporation, maintain even soil temperature, prevent erosion, control weeds, or enrich the soil.

(i)

Shrub: A woody plant, usually multi-stemmed or well branched from the base, the branches being retained to the ground. When used for buffer plantings, shrubs must also reach a mature height between 4 and 15 feet.

(j)

Tree: A living, woody, self-supporting perennial 10 feet or more in height when mature, usually having a single elongated main stem and distinct crown.

(k)

Understory tree: A small (approximately 10 to 25 feet high when mature), usually shade tolerant tree, capable of thriving in the lower light intensities found under the canopy of tall trees.
