ARTICLE V
Parking And Loading Regulations
Section 410.330 Intent And Purpose.

It is the intent and purpose of this Article to establish minimum requirements as to number of spaces, design and construction for off-street parking and loading areas.
Section 410.340 General Provisions.

A.
Single-Family Dwelling And Duplexes. Shall be allowed to use the required front yard for required parking spaces.
B.
Off-Street Parking. Shall be considered as an accessory use to the use for which the parking is provided. Parking not located on the same tract on which the main use is located must be located within the zoning district in which parking or storage lots are permitted as a main use; or be located in accordance with the provisions of this Article relating to off-street parking exceptions.
C.
Required Accessory Off-Street Parking. Facilities provided for the uses hereinafter listed shall be solely for the parking of motor vehicles in operating condition of patrons, occupants or employees of such uses.
D.
Area. A required off-street parking space shall be at least nine (9) feet in width and at least eighteen and one-half (18.5) feet in length, exclusive of access drives or aisles, ramps, columns, office or work areas.
E.
Access. Each required off-street parking space shall have separate access to a public street or alley and they shall be paved according to the specifications of the City of Bolivar.
F.
Design. Off-street parking spaces shall comply with such design standards relating to curb lengths, stall depth, driveway width, island width, barriers and ingress and egress.
G.
Surfacing. As approved by the Traffic Engineer, surfacing all off-street parking lots and loading areas shall be graded and paved using one (1) of the following:
1.
Hot Mix Asphalt. Six (6) inches compacted base rock, two (2) inches asphalt surface; or
2.
Concrete. Six (6) inches thick on compacted subgrade, five and one-half (5.5) sack air-entrained concrete; or
3.
Brick Pavers. A thickness and quality that is substantially equivalent in strength and durability to asphalt or concrete and shall be installed as recommended by manufacturer; or
4.
Such other similar material that is substantially equivalent in strength and durability to asphalt or concrete.
H.
Lighting. Any lighting used to illuminate off-street parking and loading areas shall be directed away from residential properties in such a way as not to interfere with the residential use.
I.
Repair And Service. No motor vehicle repair work or service of any kind shall be permitted in association with any off-street parking facilities.
J.
Residential Driveways And Parking Spaces. All driveways and parking spaces in residential areas shall be at least one-half (1/2) the distance of the required side yards and shall conform with the specifications of the City of Bolivar.
K.
Computation. When determination of the number of off-street parking spaces required by this regulation results in a requirement of a fractional space, the fraction of one-half (1/2) or less may be disregarded and a fraction in excess of one-half (1/2) shall be counted as one (1) parking space.
L.
Off-Street Parking And Loading Spaces. Off-street parking and loading space, as required in this Article, shall be provided for all new buildings and structures and for additions to existing buildings or structures. Off-street parking and loading space shall be required for any existing building or structure which is altered in any manner so as to enlarge or increase capacity by adding or creating dwelling units, guest rooms, floor area or seats. Existing parking areas previously required shall not be used to satisfy required off-street parking for any new structures or additions to existing buildings, structures or uses of land. Such existing parking space shall be maintained and shall not be reduced so long as the main building, structure or use remains, unless an equivalent number of such spaces are provided elsewhere as provided in this Article. In no instance shall off-street parking required by this Article be located more than three hundred (300) feet (as measured along lines of public access) from the use which it serves.
M.
Plans And Approval Required. Plans showing the layout and design of all required off-street parking and loading areas shall be submitted to and approved by the Zoning Administrator prior to issuance of a zoning or building permit. Before approving any parking layout, the Zoning Administrator shall satisfy himself/herself that the spaces provided are usable and meet standard design criteria. All required off-street parking spaces shall be clearly marked.
N.
Curb Cuts. Before the issuance of a building permit, the number and location of curb cuts for all residential and commercial parcels shall be approved by the traffic engineer.
Section 410.350 Required Spaces.

A.
Off-street parking spaces shall be provided as follows:
1.
Dwelling And Lodging Uses.

a.
Boardinghouses Or Lodging Houses. One (1) parking space per each occupant.
b.
Dormitories, Fraternities, Sororities. One (1) parking space for each occupant based on the designed maximum capacity of the building.
c.
Hotels And Motels. One (1) parking space per each rental unit plus one (1) space per each two (2) employees in the largest working shift and such spaces as are required for restaurants, assembly rooms and other affiliated facilities provided.
d.
Nursing Homes, Rest Homes, Custodial Group Homes, Etc. One (1) parking space per each two (2) beds based on the designed maximum capacity of the building plus one (1) parking space for each employee, based on the largest working shift in any twenty-four (24) hour period.
e.
Single-Family. Three (3) spaces per dwelling unit, which may include garages and driveways located from the public right-of-way into the property.
f.
Two-Family. Three (3) spaces per dwelling unit, which may include garages and driveways located from the public right-of-way into the property.
g.
Multiple-Dwelling. Two (2) spaces per dwelling unit, which may include garages, but may not include any area within the required front yard setback. All entrances and exits shall be adequate for emergency vehicle movement.
h.
Short Term Rental. One (1) parking space per each rental unit.
2.
Business, Commercial And Industrial Uses.
a.
Automobile, Truck, Trailer And Mobile Home Sales And Rental Lots. One (1) parking space for each three thousand (3,000) square feet of open sales lot area devoted to the sale, display and rental of said vehicles plus one (1) parking space for each service bay and employee.
b.
Automobile Wrecking Yards. One (1) parking space for each employee plus one (1) parking space for each ten thousand (10,000) square feet of storage area.
c.
Banks, Post Office And Business And Professional Office. One (1) parking space for each three hundred (300) square feet of gross floor area.
d.
Bowling Alleys. Five (5) parking spaces for each alley.
e.
Cartage, Express, Parcel Delivery And Freight Terminal Establishments. One (1) parking space for each two (2) employees in the largest working shift in a twenty-four (24) hour period plus one (1) parking space for each vehicle maintained on the premises.
f.
Car Wash. Three (3) holding spaces for each car-washing stall plus two (2) drying spaces for each car-washing stall.
g.
Funeral Homes And Mortuaries. One (1) parking space for each ten (10) seats based upon the designed maximum capacity of the parlor plus one (1) additional parking space for each employee and each vehicle maintained on the premises.
h.
Furniture And Appliance Stores, Household Equipment Or Furniture Repair Shops. One (1) parking space for each four hundred (400) square feet of floor area.
i.
Manufacturing, Production, Processing, Assembly, Disassembly, Cleaning, Servicing, Testing Or Repairing Of Goods, Materials Or Products. One (1) parking space per three (3) employees based upon the largest working shift in any twenty-four (24) hour time period.
j.
Medical And Dental Clinics Or Offices. One (1) parking space for each two hundred fifteen (215) square feet of gross floor area.

Outpatient Treatment Centers. One (1) parking space for each two hundred fifty (250) square feet of gross floor area.
For purposes of this Section, "outpatient treatment centers" means a medical clinic or office providing specialized treatment to persons for specific diseases or disorders, with such treatment lasting less than twenty-four (24) hours; and "outpatient treatment centers" does not include medical clinics or offices designated as hospitals, urgent care clinics or any medical clinics or offices providing general medical practice care. |
k.
Restaurants, Nightclubs, Taverns And Lounges. One (1) parking space for each two and one-half (2.5) seats based on the maximum designed seating capacity; provided, however, that drive-in restaurants shall have a minimum of at least ten (10) parking spaces.
l.
Retail Stores And Shops. One (1) parking space per two hundred (200) square feet of floor area.
m.
Service Stations. One (1) parking space for each employee plus two (2) spaces for each service bay.
n.
Theaters, Auditoriums And Places Of Assembly With Fixed Seats. One (1) space for each three and one-half (3.5) seats.
o.
Theaters, Auditoriums And Places Of Assembly Without Fixed Seats. One (1) parking space for each three (3) people based upon the designed maximum capacity of the building.
p.
Warehouse, Storage And Wholesale Establishments. One (1) parking space for each two (2) employees based upon the largest working shift in any twenty-four (24) hour period.
q.
All Other Business And Commercial Establishments Not Specified Above. One (1) parking space for each three hundred (300) square feet of floor area.
3.
Other Uses.
a.
Churches. One (1) parking space for each four (4) seats based upon the maximum designed seating capacity, including choir lofts.
b.
Elementary, Junior High And Equivalent Parochial And Private Schools. Two (2) for each classroom.
c.
High School Or Equivalent Parochial And Private Schools. Ten (10) parking spaces for each classroom plus one (1) space for each two (2) employees.
d.
Hospitals. One (1) parking space for each two (2) beds plus one (1) parking space for each resident or staff doctor plus one (1) space for each two (2) employees based on the largest working shift in any twenty-four (24) hour period.
e.
Laundromats. One (1) space for each two (2) washing machines.
f.
Nursery Schools And Day-Care Centers, Public Or Private. One (1) parking space for each employee.
g.
Private Clubs, Lodges And Union Headquarters. One (1) parking space for each three (3) seats based upon the maximum designed seating capacity.
h.
Swimming Pools And Clubs. One (1) parking space for each one hundred (100) square feet of water area.
i.
College, Universities, Trade And Commercial Schools And Other Public Or Private Institutions Of Higher Learning. One (1) parking space for each student and employee.
Section 410.360 Exception (Special Permit).

A.
In order to provide off-street parking areas, the Board of Adjustment may, after public notice and hearing, grant as an exception a special permit for the establishment of parking areas in any zoning district under the provisions set forth in this Section.
B.
Location. Parking provided under this Section must be within three hundred (300) feet (along lines of public access) from the boundary of the use for which the parking is provided.
C.
Use. The parking area shall be used for passenger vehicles only and in no case shall it be used for sales, repair work, storage, dismantling or servicing of any vehicles, equipment, materials or supplies. Only such signs as are necessary for the proper operation of the parking lot shall be permitted.
D.
Improvements.
1.
Parking areas and driveways on private property providing ingress and egress to parking areas shall be surfaced with hot mix asphalt, six (6) inches compacted base rock, two (2) inches asphalt surface; or concrete, six (6) inches thick on compacted subgrade, five and one-half (5.5) inches sack air-entrained concrete; or brick pavers, a thickness and quality that is substantially equivalent in strength and durability to asphalt or concrete and shall be installed as recommended by manufacturer; or such other similar material that is substantially equivalent in strength and durability to asphalt or concrete.
2.
Parking areas shall have adequate guards to prevent extension or the overhanging of vehicles beyond property lines or parking spaces and parking areas shall have adequate markings for channelization and movement of vehicles.
3.
If lighting facilities are provided, they shall be so arranged as to deflect or direct light away from any adjacent dwelling or dwelling district.
4.
A fence, constructed and maintained as provided by Section 410.280(A)(6) and (7) of the Supplementary District Regulations not less than six (6) feet high nor more than eight (8) feet high shall be erected along any property line adjacent to or adjoining any dwelling district to eliminate the passage of light from vehicles and to prevent the blowing of debris. Whenever a fence shall be required along a front yard, such fence shall not be higher than four (4) feet and such fence shall be located within one (1) foot of the front yard setback line. Fences along said yards shall not extend nearer to the street than the front yard setback line.
5.
When located in a dwelling district, parking shall not be located within a front yard and the front yard shall remain unpaved and shall be landscaped.
6.
The Board of Adjustment shall determine the necessary improvements in order to protect adjacent property owners and the public interest. Such improvements shall include, but not be restricted to, proper setbacks, screening, grass, shrubs, trees and maintenance.
E.
Application. The application for the special use permit shall be accompanied by:
1.
An attorney's opinion or other suitable evidence certifying as to the ownership of the property or the existence of a valid lease by the applicant.
2.
A plot plan showing the proposed plan of the improvements and any other information showing the applicant's intention to comply with the provision of this Section.
F.
Permit Revocable. The Zoning Administrator shall be responsible for the enforcement of the conditions and requirements made by the Board of Adjustment in the approval of any off-street parking special permit. The Zoning Administrator, upon discovery of any violation of this regulation or the conditions and requirements established by the Board, shall notify the Board through its Secretary as to such violation. The Board of Adjustment is hereby authorized to revoke the special permit after public hearing for any of the following reasons:
Section 410.370 Loading And Unloading Regulations.

A.
Loading and unloading space shall be provided off-street and on the same premises with every building, structure or part thereof hereafter erected, established or enlarged and occupied for goods display, retail operation, department store, market, hotel, mortuary, laundry, dry cleaning, office uses, warehousing, manufacturing and other uses involving the receipt or distribution of materials or merchandise by motor vehicle. The loading and unloading space or spaces shall be so located to avoid undue interference with public use of streets, alleys and walkways.
1.
Minimum Spaces Required.
a.
For all commercial uses, loading facilities shall be provided in accordance with the following table. These numbers are accumulative.

b.
For all industrial uses, loading facilities shall be provided in accordance with the following table.

c.
For each additional one hundred thousand (100,000) square feet of gross floor area or any fraction thereof over one hundred thousand (100,000) square feet of gross floor area, one (1) additional space shall be provided. Each such additional space shall be at least ten (10) feet in width by seventy (70) feet in length.
d.
If any establishment has a loading dock regardless of its square footage, it shall be required to provide at least one (1) ten (10) foot x seventy (70) foot loading space.
