09: RULES OF CONSTRUCTION AND DEFINITIONS

Subsection 14.09.101 Rules of Construction

  • (a)
    "Shall," "will," "should," "may," and "must."
    1. (1)
      The words "shall," "must," and "will" are always mandatory.
    2. (2)
      The words "should" and "may" are discretionary.
  • (b)
    Representative of the City.  Any office referred to in this ULDO by title means the person employed or appointed by the City in that position, or their duly authorized representative, and includes any person designated to perform the duties of such office.
  • (c)
    Customary Usage.  Definitions not expressly prescribed in this ULDO are to be construed in accordance with customary usage in municipal planning and engineering practices.
  • (d)
    Most Recent Version.  All references to other county, state, or federal regulations in this ULDO refer to the most current version and citation for those regulations, unless expressly indicated otherwise.  If the referenced regulations have been repealed and not replaced by other regulations, requirements for compliance are no longer in effect.
  • (e)
    Tense and Number.  Words in the present tense include the future and vice-versa.  Words in the singular number include the plural number and vice-versa.
  • (f)
    Building and Structure.  The word "structure" includes the word "building.” 
  • (g)
    District.  The word “district” means zoning district.
  • (h)
    City.  The word "City" means Borger, Texas. 
  • (i)

    Gender.  If a feminine term is used, the masculine also applies and vice-versa. 

  • (j)

    Conjunctions.

    1. (1)

      And.  The word “and” shall be construed to include all connected items in a series or set of conditions or provisions. 

    2. (2)

      Or.  The word “or” shall be construed to include one or more of the items in a series or set of conditions or provisions unless the context clearly indicates otherwise.

  • (k)

    Lists.  The use of terms such as “including,” “such as,” or similar language is intended to provide examples, not to be exhaustive lists of all possibilities unless the context clearly indicates otherwise. 

  • (l)

    Rounding.  If any regulatory formula in this ULDO results in a non-whole number of an indivisible object or feature (for example, a bufferyard requiring 3.33 trees or a parking lot requiring 20.75 spaces), then the non-whole number shall be rounded down or up to the next lowest or highest whole number (in this case, the buffer case, 3 and in the parking lot case, 21).

  • (m)

    Days.  All references to “days” are deemed calendar days unless expressly indicated otherwise.  The time in which an act shall be completed is computed by excluding the first day and including the last day.  In computing working days, if applicable, Saturdays, Sundays, or holidays observed by the City are excluded.  A day concludes at the close of business for the Planning and Development Department, and any materials received after that time will be deemed to have been received the following day.

  • (n)

    Illustrations, Tables, and Text

    1. (1)

      Text.  The text material of this ULDO controls over tables and illustrations in cases of inconsistency.  Likewise, tables control over illustrations. 

    2. (2)

      Graphics.  Illustrations and photographs in this ULDO are provided for illustrative purposes only.  

  • (o)

    Defined and Undefined Terms.  Terms defined in Section 14.09.200, Definitions, are those having a special meaning relative to the purposes of this ULDO.  All words not defined in such Section shall be given their usual and customary meanings, according to the Director of Planning and Development, unless the context clearly indicates otherwise.

    Abandoned Sign
    Abandoned Sign means a sign which no longer identifies or advertises a bona fide business, lessor, service, owner, product, or activity, and/or for which no legal owner can be found.

    Access Sign
    Access Sign means a freestanding on-premise sign located at the entry or exit of a vehicle use area that may or may not give exit or entry directions or facility information.

    Accessory Building
    Accessory Building means in a residential district, a subordinate building, attached or detached and used for a purpose customarily incidental to the main structure such as private garage for automobile storage, tool house, lath or greenhouse as a hobby (no business), home workshop, children’s playhouse, storage house or garden shelter, but not involving the conduct of a business.  In nonresidential districts any use incidental or subordinate to the primary use and housed in a separate building or structure.  In no instance shall the use of the detached subordinate building be contrary to the land uses permitted in the zoning district in which said building is located.

    Accessory Dwelling Unit (ADU)
    Accessory Dwelling Unit (ADU) means a secondary dwelling unit that is either located in a separate accessory building on the same lot as the principal dwelling unit or as a separate, independent unit within the principal building.  The ADU provides a complete, independent living space with facilities for cooking, eating, sanitation, and sleeping.

    Accessory Use
    Accessory Use means a use subordinate to and incidental to the primary use of the main building or to the primary use of the premises.

    ADA
    ADA means the Americans with Disabilities Act.

    A
    Adult Arcade means a business which offers its customers in one or more viewing booths motion or still pictures characterized by exposure of specified anatomical areas.

    Adult Bookstore/Film/Video Store
    Adult Bookstore/Film/Video Store means a business in which a substantial portion of its stock in trade consists of books, videos, tapes, cassettes, photographs, slides, magazines, and other periodicals which are distinguished or characterized by an emphasis on specific sexual activities, specified anatomical areas, or both.

    Adult Business
    Adult Business means any business activity which offers the opportunity to view specified sexual activity, or view or touch for entertainment specified anatomical areas.  Such definition further includes but is not limited to adult arcade, adult bookstore/film/video store, adult cabaret, adult lounge, adult motel or hotel, adult retail store, adult theater, and topless business establishments.

    Adult Cabaret
    Adult Cabaret means a business which offers to customers live performances characterized by exposure of specified anatomical areas.

    Adult Day Care Center
    Adult Day Care Center means a facility that provides services under an adult day care program on a daily or regular basis, but not overnight, to four or more elderly or handicapped persons who are not related by blood, marriage, or adoption to the owner of the facility.  Adult day care centers shall be licensed by the Texas Department of Human Services and/or any other state or federal agency with jurisdiction.

    Adult Lounge
    Adult Lounge means an adult cabaret which serves alcoholic beverages.

    A
    Adult Motel or Hotel means a business which offers its customers a sleeping room or sitting room for a period of timeless than 10 hours and provides motion picture or still picture entertainment characterized by an emphasis on specific sexual activities, specified anatomical areas, or both.

    Adult Retail Store
    Adult Retail Store means a business in which a substantial portion of the stock in trade consists of items or products other than printed matter characterized by an emphasis on specified sexual activities, specified anatomical areas, or both.

    Adult Theater
    Adult Theater means a business with a capacity of more than five persons which offers customers motion or still pictures or live entertainment or performances characterized by exposure of specified anatomical areas.

    A
    Agricultural and Animal Related Use Category means a use category that contains uses related to the commercial production, storage, processing, marketing, distribution or export of floricultural, horticultural, or viticultural crops, and the small-scale keeping and treatment of animals.  

    Uses in this use category include: community garden; floriculture, horticulture, row and field crops, viticulture, or orchard; kennel; plant nursery, greenhouse, and landscaping business; stable, private and noncommercial; veterinary clinic; veterinary hospital; and any other uses that the Director of Planning and Development interprets to have the characteristics of this use category.

    Typical accessory uses include: associated office; barn, silo, stable (private) or other agricultural storage; buildings associated with agricultural uses being pursued on site; greenhouse; minor utilities; parking and storage of operable farm vehicles and farm machinery; and roadside stand.

    Airport
    Airport means any area of land or water designed and set aside for the landing and take-off of aircraft, including all necessary facilities for the housing and maintenance of aircraft.

    Alley
    Alley means a minor public right-of-way, not intended to provide the primary means of access to abutting lots, which is used primarily for installation of public utilities, solid waste collection, and for vehicular access to the back or sides of properties otherwise abutting on a street.

    Alluvial Fan Flooding
    Alluvial Fan Flooding means flooding occurring on the surface of an alluvial fan or similar landform which originates at the apex and characterized by high velocity flows; active processes of erosion, sediment transport, deposition, and unpredictable flow paths.

    Amusement Redemption Machine
    Amusement Redemption Machine means, in accordance with TLGC 234.131, any electronic, electromechanical, or mechanical contrivance designed, made, and adopted for bona fide amusement purposes that rewards the player exclusively with noncash merchandise, prizes, toys, or novelties, or a representation of value redeemable for those items, with a wholesale value available from a single play of the game or device in an amount not more than 10 times the amount charged to play the game or device once or five dollars, whichever amount is less.  A coin-operated amusement machine designed primarily for children is not an amusement redemption machine.

    Animal Slaughterhouse or Packaging Plant
    Animal Slaughterhouse or Packaging Plant means a building or structure where livestock is slaughtered and prepared for distribution to butcher shops or retail sales establishments such as grocery stores.  A slaughterhouse is designed to accommodate the confinement and slaughtering of live animals and may include packing, treating, storage, or sale of the product on the premises.

    Apex
    Apex means a point on an alluvial fan or similar landform below which the flow path of the major stream that formed the fan becomes unpredictable and alluvial fan flooding can occur.

    A
    Area of Shallow Flooding means a designated AO, AH, or VO zone on a community's flood insurance rate map (FIRM) with a one percent or greater annual chance of flooding to an average depth of one to three feet where a clearly defined channel does not exist, where the path of flooding is unpredictable, and where velocity flow maybe evident.  Such flooding is characterized by ponding or sheet flow.

    A
    Area of Special Flood Hazard means the land in the floodplain within a community subject to a one percent or greater chance of flooding in any given year.  The area may be designated as zone A on the flood hazard boundary map (FHBM). After detailed ratemaking has been completed in preparation for publication of the FIRM, zone A usually is refined into zones A, AE, AH, AO, A1-99, VO, V1-30, VE, and V.

    Assisted Living Facility
    Assisted Living Facility means a facility that provides meals and assistance with daily activities such as dressing, grooming, and bathing for the elderly or adults who are unable to manage these activities themselves.  This definition does not include a nursing home or similar institutions with professionally trained technical staff devoted primarily to the care of the chronically ill or the incurable.

    Awning
    Awning means a shelter projecting from and supported by the exterior wall of a building constructed of nonrigid materials on a supporting framework (compare “marquee”).

    Awning Sign
    Awning Sign means a sign painted on, printed on, or attached flat against the surface of an awning.

    Bank and Credit Union
    Bank and Credit Union means any of the class of business in a freestanding building, kiosk, or automated teller machine that provides financial services and the transmission of funds.  Typical accessory uses may include automatic teller machines, drive-through service, offices, and parking.

    Banner Sign
    Banner Sign means a sign made of fabric or any nonrigid material with no enclosing framework.

    Bar, Tavern, and Lounge
    Bar, Tavern, and Lounge means an eating and drinking establishment providing or dispensing by the drink for on-site consumption fermented malt beverages, and/or malt, special malt, vinous, or spirituous liquors, and in which the gross receipts of food products is less than 60 percent of the entire gross receipts of such establishment.  A bar, tavern, or lounge may include the provision of live entertainment and/or dancing; however, shall not include any adult business entertainment.  Accessory uses may include the manufacture of alcoholic beverages for on-site consumption and/or retail sales.

    Base Flood
    Base Flood means the flood having a one percent chance of being equaled or exceeded in any given year.

    Basement
    Basement means any area of the building having its floor subgrade (below ground level) on all sides.

    Batch Plant
    Batch Plant means the production of concrete or asphalt that uses a manufacturing process involving the mixing of a number of materials.

    Bed And Breakfast Inn
    Bed And Breakfast Inn means tourist lodging services within rooms of the property owner's principal residence or one separate guest house within a single property served by a single water meter and electrical meter and subject to the limitations of home occupation.  To qualify as a bed and breakfast, the owner shall provide proof of collection and payment of state and local hotel/motel occupancy tax to the City upon request.

    B
    Billboard means a poster panel, painted bulletin, or other advertising devices which promotes and advertises commodities or services not offered on the premises on which such sign is located.

    Block
    Block means an area enclosed by streets and occupied by or intended for buildings; or if said word is used as a term of measurement, it shall mean the distance along a side of a street between the nearest two streets which intersect said street on the said side.

    B
    Board of Adjustment (BOA) means the City of Borger's Zoning Board of Adjustment as provided for in Subsection 14.05.103.

    Boarding House
    Boarding House means a building other than a hotel, where lodging and meals for four or more persons are served for compensation.

    Boat and Recreational Vehicle Outdoor Storage
    Boat and Recreational Vehicle Outdoor Storage means a facility where boats and other watercraft and vehicles including, but not limited to, travel trailers, fifth wheels, or motor homes are stored outdoors.

    Building Materials Sales
    Building Materials Sales means the sale and/or storage of building materials where a minimum of 60 percent of the building materials are new products which have not previously been used in the construction of, or as a part of, any structure.

    Building
    Building means any structure built for the support, shelter and enclosure of persons, animals, chattels, or movable property of any kind.  When subdivided in a manner sufficient to prevent the spread of fire each portion so divided may be deemed a separate building.  Building includes the word “structure.”

    B
    Building Official means the person legally designated the inspection authority by the City to determine building code compliance and other similar compliance issues, or his or her authorized representative.  See Subsection 14.05.105.

    Building Permit
    Building Permit means an official permit issued by the City to allow a person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish any structure.

    Building Setback Line
    Building Setback Line means the line parallel to the street right-of-way line designating the minimum distance from the street right-of-way line that a structure may be erected.

    C
    C means the Commercial zoning district.

    Campground with Overnight Accommodations
    Campground with Overnight Accommodations means a facility that may be designed for temporary (maximum of seven nights) use by travel trailers, recreation vehicles, or tents.

    Canopy
    Canopy means a framed accessory structure or exterior architectural feature which is attached to and supported from a wall or held up by its own supports, which provides shelter from the elements to persons, vehicles, or property.

    Canopy Sign
    Canopy Sign means any sign painted, printed, attached, or otherwise applied to the surface of an attached or freestanding canopy.

    Carbon Black Manufacturing
    Carbon Black Manufacturing means an establishment that is primarily engaged in manufacturing carbon black, bone black, and lamp black.

    Car Wash
    Car Wash means a facility for the washing or cleaning of vehicles.  A car wash may be:

    • a single unit type with a single bay or a group of single bays with each bay to accommodate one vehicle only where a person uses a high-pressure hose to wash the vehicle by hand;
    • an automated single unit type that has a single bay to accommodate one vehicle at a time; or,
    • a tunnel unit type that allows washing of multiple vehicles in a tandem arrangement while moving through the structure.

    Cemetery, Columbarium, Mausoleum, and Memorial Park
    Cemetery, Columbarium, Mausoleum, and Memorial Park means land used or intended to be used for the burial of the dead, whether human or animal, including crematoriums, columbarium, mausoleums, and other buildings where funeral services may be held.  This definition includes funeral homes and/or mortuaries.

    C
    Certificate of Occupancy means an official certificate issued by the Building Inspector for the use of a building, structure, or land when it is determined by him that the building complies with all applicable City codes, ordinances, and regulations.

    Check Cashing Business
    Check Cashing Business means a person or business that for compensation engages, in whole or in part, in the business of cashing checks, warrants, drafts, money orders, or other commercial paper serving the same purpose.  “Check cashing business” does not include a state or federally chartered bank, savings association, credit union, or industrial loan company.  “Check cashing business” also does not include a retail seller engaged primarily in the business of selling consumer goods, including consumables, to retail buyers that cash checks or issue money orders for a minimum flat fee as a service that is incidental to its main purpose or business.  The term “currency exchange” expressly includes businesses known as “check cashing” facilities.

    Child Day Care Center or Pre-School
    Child Day Care Center or Pre-School means a child-care facility that provides care at a location other than the residence of the director, owner, or operator of the child-care facility for seven or more children under 14 years of age for less than 24 hours a day, but at least two hours a day, three or more days a week.

    C
    Civic Use Category contains uses including buildings, structures, or facilities to provide a service to the public. Accessory uses may include limited retail, concessions, parking, and maintenance facilities.

    Uses in this use category include: community, senior, or youth center; lodge or civic club; library, museum, or gallery; public assembly facility; and any other uses that the Director of Planning and Development interprets to have the characteristics of this use category.

    Typical accessory uses include: assembly hall; associated office and storage; associated retail sales area related to principal use; athletic facilities; auditorium or theater; before- and after-school day care; classrooms; concession; day care; dormitory; food preparation and dining facility; laboratory; library; medical clinic; minor utilities; pre-school; and recreation facility.

    C-MU
    C-MU means the Corridor-Mixed Use zoning district.

    College and University
    College and University means an institution established for educational purposes and offering a curriculum similar to the public schools or an accredited college or university but excluding trade and commercial schools.

    Commission
    Commission means the Planning and Zoning Commission of the City.  See Subsection 14.05.102.

    Community Garden
    Community Garden means a private or public facility for the cultivation of fruit, flowers, vegetables, or ornamental plants by more than one person or family.

    Community Home for Persons with Disabilities
    Community Home for Persons with Disabilities means a community-based residential home containing not more than six disabled persons with two supervisory personnel which meets the requirements of the Community Homes for the Disabled Persons Location Act, Texas Human Resources Code Chapter 123, as amended.

    C
    Community, Senior, or Youth Center means a public building to be used as a place of meeting, recreation, or social activity and not operated for profit.

    Comprehensive Plan
    Comprehensive Plan means a periodically updated series of documents that unifies all elements and aspects of city planning.  This plan reflects the best judgment of the staff, Planning and Zoning Commission, and City Council and sets a policy for zoning and subdivision decisions.  This plan indicates the general locations recommended for various land uses, transportation routes, public buildings, streets, parks, and other public and private developments and improvements.

    Council
    Council means members of the Borger City Council. See Subsection 14.05.101.

    Country Club (Private) with Golf Course
    Country Club (Private) with Golf Course means an area containing a golf course, and clubhouse and associated uses available only to private specific membership.

    Critical Root Zone
    Critical Root Zone means a circular region measured outward from a tree trunk representing the essential area of the roots that shall be maintained in order for the tree’s survival.  The critical root zone is one foot of radius from the center of the tree trunk for every inch of tree diameter at four feet above grade.  For example, a tree that is 24 inches in diameter at four feet above grade would have a critical root zone with a radius of 24 feet.

    Curb Line
    Curb Line means an imaginary line drawn along and parallel to the outermost part or back of the curb and gutter on either side of a public street; or, if there is no curb and gutter, along and parallel to the outermost portion of the paved street; or, if there is no paved street, along and parallel to the outermost edge of the traveled portion of the street.

    DA
    DA means the Downtown Area Zoning District.

    Day Care Use Category
    Day Care Use Category contains public and civic uses providing care, protection, and supervision for at least 17 children or adults on a regular basis away from their primary residence.  Care is typically provided to a given individual for fewer than 18 hours each day, although the facility may be open 24 hours each day.

    Uses in this use category include: adult day care center; child day care center; and any other uses that the Director of Planning and Development interprets to have the characteristics of this use category.

    Typical accessory uses include: associated office and storage; food preparation and dining facility; minor utilities; and recreation facility

    dBA
    dBA means decibels.

    Development
    Development means any manmade change in improved and unimproved real estate, including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations, or storage of equipment or materials.

    Director
    Director means the Director of Planning and Development or a designee, or the individual designated by the City Manager to administer the regulations and provisions of this ULDO.

    Directory Sign
    Directory Sign means an outdoor sign listing and identifying the occupants within retail centers, industrial centers, office complexes, institutional campuses (for example, medical center, hospital, etc.), and other multi-tenant, mixed-use, or nonresidential sites.

    District
    District means a section of the City for which the regulations governing the area, height, or use of the land and buildings are uniform.

    Duplex
    Duplex means a type of building that is located on its own lot and is used by two families.

    Dwelling Unit
    Dwelling Unit means a building or portion of a building which is arranged, occupied, or intended to be occupied as living quarters and includes facilities for food preparation and sleeping.

    Dwelling, Apartment
    Dwelling, Apartment means a room or suite of rooms in a building that is occupied as a home or residence of three or more families.

    Dwelling, Multiplex
    Dwelling, Multiplex means a multi-family building type that is designed to resemble a large single-family home. Units may have either private or shared access and may be arranged in a variety of configurations, including back-to-back, side-to-side, or over-under.

    Dwelling, Single-Family Attached
    Dwelling, Single-Family Attached means a type of residential building that is located on its own lot, shares a common wall with another dwelling, and is used by a single-family.

    Dwelling, Single-Family Detached
    Dwelling, Single-Family Detached means a type of residential building that is located on its own lot, is not attached to any other dwelling, is used by a single family, and does not meet the definition of a qualified manufactured home.

    D
    Dwelling, Two-Family means a detached building having separate accommodations for and occupied by not more than two families, or by two families and not more than four boarders and lodgers.

    Easement
    Easement means a right held by the City or its franchised utility companies to be used for access, drainage or the placement of utilities such as water, gas, sewer, telephone, cable television and electrical lines or other facilities.

    E
    Educational Facilities Use Category contains public and civic uses including schools at the elementary, middle, or high school level that provide basic academic education.  This category also includes colleges and other institutions of higher learning that offer courses of general or specialized study leading to a degree usually in a campus setting. 

    Uses in this use category include: college and university; school, public and private; school, vocational, and trade;  and, any other uses that the Director of Planning and Development interprets to have the characteristics of this use category.

    Typical accessory uses include:  assembly hall; associated office and storage; athletic facilities; auditorium or theater; Before- and after-school daycare; concession; dormitory; food preparation and dining facility; laboratory; library; medical clinic; minor utilities; and recreation facility

    Eight Liner Machine
    Eight Liner Machine means an electronic device, resembling a slot machine, on which a person wins by matching symbols in one of eight lines, three horizontal, three vertical, and two diagonal.

    Electrical Sign
    Electrical Sign means a sign or sign structure in which electrical wiring, connections, or fixtures are used.

    EMC
    EMC means electronic message center.

    Engineer

    Projecting Sign means a sign, other than a flat wall sign, which is attached to and projects from a building wall or other structure not specifically designed to support the sign.

    Public Assembly Facility
    Public Assembly Facility means an institution of religious or philanthropic nature.  This use includes fraternal organizations, non-profit clubs and lodges, and places of worship.  This use does not include residential buildings or conference and convention centers, which are in the Indoor Entertainment use category.  In addition, this use does not include establishments that require a club membership solely for the purpose of purchasing alcoholic beverages, as articulated in Texas Alcoholic Beverage Code, Chapter 32. Private Club Registration Permit.  Such use is considered a bar, tavern, or lounge for the purposes of this ULDO.

    Waste-Related Use Category
    Waste-Related Use Category contains industrial uses involved in the storage or movement of goods for themselves or other firms.  Goods are generally delivered to other firms or the final consumer with little on-site sales activity to customers.

    Uses in this use category include: animal waste processing; composting facility; landfill; recycling facility; tire recycling or retreading; salvage or scrap metal yard; waste transfer facility; and any other uses that the Director of Planning and Development interprets to have the characteristics of this use category. 

    Typical accessory uses include: associated office and storage; fleet maintenance; fueling facility; minor utilities; and repackaging and shipment of byproducts.

    Waste Transfer Facility
    Waste Transfer Facility means a facility for the temporary storage, transfer, and packing of solid waste from smaller collecting vehicles to larger transport vehicles.

    Water Surface Elevation
    Water Surface Elevation means the height, in relation to the National Geodetic Vertical Datum (NGVD) of 1929 (or other datum, where specified), of floods of various magnitudes and frequencies in the floodplains of coastal or riverine areas.

    Wholesale Trade Use Category means a category of commercial uses containing establishments involved in the sale, lease, or rent of products to industrial, institutional, or commercial enterprises only.  The uses emphasize on-site sales or order-taking and often include display areas.  The business may or may not be open to the general public.  Products may be picked up on-site or delivered to the customer.

    Uses in this use category include: fuel sales and storage (bulk); mail-order business; sale or rental of machinery, equipment, heavy equipment, building materials, special trade tools, welding supplies, machine parts, electrical supplies, janitorial supplies, restaurant equipment, and store fixtures; wholesale or auction of food, clothing, auto parts, or hardware; and any other uses that the Director of Planning and Development interprets to have the characteristics of this use category.

    Typical accessory uses include: associated office and storage; associated showroom; day care for children of employees; essential utilities; fleet maintenance; food preparation and dining facility; medical clinic for employees; meeting space; minor fabrication; product repair; recreation facility; repackaging of goods; single attached caretaker's quarters; and, warehouse.

    Window Sign
    Window Sign means a sign installed inside a window and intended to be viewed from the outside.  Such sign shall be made of wood, paper, paint, or vinyl and not illuminated.

    Xeriscape means landscaping and gardening in ways that reduce or eliminate the need for supplemental water from irrigation.  Xeriscape species are those listed for Region 5 in the Texas A&M AgriLife Extension publication Xeriscape™: Landscape Water Conservation.

    Yard, Front
    Yard, Front means an open, unoccupied space on a lot facing a street extended across the front of the lot between the side lot lines and from the main building to the front lot or street line with the minimum horizontal distance between the street line and the main building line as specified for the district in which it is located.

    Yard, Rear means an open, unoccupied space, except for accessory buildings as herein permitted, extending across the rear of a lot from one side lot line to the other side lot line and having a depth between the building and the rear lot line as specified in the district in which the lot is situated.

    Yard, Side
    Yard, Side means an open, unoccupied space or spaces on one or two sides of a main building and on the same lot with the building, situated between the building and a sideline of the lot and extending through from the front yard to the rear yard.  Any lot line not the rear line or a front line shall be deemed a sideline.
