DISTRICT REGULATIONS

§ 153.035 COMPLIANCE WITH REGULATIONS.

   The regulations for each district set forth by this Zoning Code shall be the minimum regulations and shall apply uniformly to each class or kind of structure or land, except as hereinafter provided.
   (A)   No building, structure, or land shall be used or occupied and no building, structure, or part thereof shall be erected, constructed, reconstructed, moved, or structurally altered except in conformity with all of the regulations specified for the district in which it is located.
   (B)   Except as otherwise provided in this Zoning Code, no building or other structure shall be erected or altered to:
      (1)   Provide for greater height or bulk;
      (2)   Accommodate or house a greater number of families;
      (3)   Occupy a greater percentage of lot area; or
      (4)   Have narrower or smaller rear yards, front yards, side yards or other open spaces than required in its district, or in any other manner be contrary to the provisions of this Zoning Code.
   (C)   Except as otherwise provided in this Zoning Code, no yard or lot existing at the time of passage of this Zoning Code shall be reduced in dimension or area below the minimum requirements set forth in the district. Yards or lots created after the effective date of this Zoning Code shall meet at least the minimum requirements set forth in the district.

§ 153.038 R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT.

   (A)   Intent. The intent of this District is to provide low to medium-density, single-family detached dwellings, plus those public and private facilities serving the residents of the area.
   (B)   Principal permitted uses.
      (1)   Residential uses.
         (a)   Single-family detached dwellings, including modular homes; and
         (b)   Home occupations.
      (2)   Public and recreational uses.
         (a)   Educational institutions, elementary, junior high and high schools;
         (b)   Places of worship;
         (c)   Libraries;
         (d)   Non-commercial recreational facilities; and
         (e)   Museums.
   (C)   Conditional uses. A building or premises may be used for the following purposes in the R-l Single-Family Residential District if a conditional use permit for the use has been obtained in conformance with the provisions of this Zoning Code - conditional use permits.
      (1)   Residential uses.
         (a)   Residential planned unit development; and
         (b)   Elderly housing facilities.
      (2)   Public and recreational uses.
         (a)   Public buildings of all types (Fire Department and Police Department);
         (b)   Cemeteries;
         (c)   Nursing homes; and
         (d)   Hospitals.
      (3)   Business offices. Medical offices and clinics.
   (D)   Height and area regulations. The maximum height and minimum lot requirements within the R-1 Single-Family Residential District shall be as follows.

§ 153.039 R-2 SINGLE-/TWO-FAMILY RESIDENTIAL DISTRICT.

   (A)   Intent. The intent of this District is to provide a sound housing mix. This District provides for an approximate medium density and recognizes the development of other than single-family dwelling units on average size lots.
   (B)   Principal permitted uses.
      (1)   Residential uses.
         (a)   Single-family detached dwellings;
         (b)   Two-family dwellings; and
         (c)   Home occupations.
      (2)   Public and recreational uses.
         (a)   Educational institutions, elementary, junior high and high schools;
         (b)   Places of worship;
         (c)   Libraries;
         (d)   Non-commercial recreational facilities; and
         (e)   Museums.
   (C)   Conditional uses. A building or premises may be used for the following purposes in the R-2 Two-Family Residential District if a conditional use permit for the use has been obtained in conformance with the provisions of this Zoning Code - conditional use permits.
      (1)   Residential uses.
         (a)   Residential planned unit development; and
         (b)   Elderly housing facilities.
      (2)   Public and recreational uses.
         (a)   Public buildings of all types (Fire Department and Police Department);
         (b)   Cemeteries;

   (A)   Intent. The intent of this District is to provide a full range of residential dwelling types. The requirements allow a more complete use of land in the District and provide more flexible guidelines for development and redevelopment efforts at a medium to high density.
   (B)   Principal permitted uses.
      (1)   Residential uses.
         (a)   Single-/two-family detached dwellings, including modular homes;
         (b)   Multi-family dwellings;
         (c)   Boarding or lodging houses;
         (d)   Bed and breakfast inns;
         (e)   Community-oriented residential social service facilities/group home; and
         (f)   Home occupations.
      (2)   Public and recreational uses.
         (a)   Educational institutions, elementary, junior high and high schools;
         (b)   Places of worship;
         (c)   Libraries;
         (d)   Non-commercial recreational facilities; and
         (e)   Museums.
   (C)   Conditional uses. A building or premises may be used for the following purposes in the R-3 Multi-Family Residential District if a conditional use permit for the use has been obtained in conformance with the provisions of this Zoning Code - conditional use permits.

   (A)   Intent. This District is intended to provide an integrated collection of structures and uses designed to supply a majority of the daily needs of village residents.
   (B)   Principal permitted uses.

         (a)   Places of worship;
         (b)   Libraries;
         (c)   Public buildings of all types (Fire Department and Police Department);
         (d)   Non-commercial recreational facilities;
         (e)   Museums;
         (f)   Child day care centers, commercial or professional; and
         (g)   Private clubs.
      (2)   Business office uses.
         (a)   Business, professional and administrative offices; and
         (b)   Medical offices and clinics.
      (3)   Retail commercial and service uses.
         (a)   General merchandise stores;

   (A)   Intent. This District is intended to provide specific zoning for commercial use properties in the village along State Street and Main Street.
   (B)   Principal permitted uses.
      (1)   Public and recreational uses.
         (a)   Places of worship;
         (b)   Libraries;
         (c)   Public buildings of all types (Fire Department and Police Department);
         (d)   Non-commercial recreational facilities;
         (e)   Museums;
         (f)   Child day care centers, commercial or professional; and
         (g)   Private clubs.
      (2)   Business office uses.
         (a)   Business, professional and administrative offices; and
         (b)   Medical offices and clinics.
      (3)   Retail commercial and service uses.
         (a)   General merchandise stores;

§ 153.044 C-4 SPECIAL BUSINESS DISTRICT.

   (A)   Intent. This District is intended to provide specific zoning for the sale and cultivation of adult use cannabis and medical marijuana.
   (B)   Principal permitted uses for retail, commercial and service.
      (1)   Adult use cannabis sales;
      (2)   Medical marijuana sales;
      (3)   Adult use cannabis cultivation; and
      (4)   Medical marijuana cultivation.
   (C)   Conditional uses. There are no conditional uses for this District.
   (D)   Height and area regulations.
      (1)   The maximum height and minimum lot requirements within the C-4 Special Business District shall be as follows.

§ 153.043 I INDUSTRIAL DISTRICT.

   (A)   Intent. The purpose of this District is to provide for industrial and other uses that by virtue of their characteristics should be isolated from residential uses. These uses perform essential functions for the village including employment and should be provided for in areas that are best suited for industrial development by reasons of location, topography, soil conditions, and the availability of adequate utilities and transportation systems.
   (B)   Principal permitted uses.
      (1)   Public and recreational uses. Educational institutions, elementary, junior high and high schools.
      (2)   Road service and commercial entertainment uses. Adult entertainment facilities (see § 153.069).
      (3)   Light industrial.
         (a)   Grain bins and grain elevators;

         (c)   Utility service companies.
      (4)   Heavy industrial uses.
         (a)   Planned industrial developments; and
         (b)   Enclosed industrial.
   (C)   Conditional uses.
      (1)   Generally. A building or premises may be used for the following purposes in the I Industrial District if a conditional use permit for the use has been obtained in conformance with the provisions of this Zoning Code - conditional use permits.
      (2)   Light industrial uses. Wireless telecommunications facilities (see § 153.073).
   (D)   Height and area regulations. The maximum height and minimum lot requirements within the I Industrial District shall be as follows.
