ARTICLE XIII

Penalties

§ 161-73 Penalties for offenses.

A. 
Any person, firm, association or corporation violating any provision of this chapter shall be guilty of an offense, punishable by a fine not exceeding $250 or imprisonment for a period not to exceed 15 days, or both such fine and imprisonment. Each week's continued violation shall constitute a separate additional violation. In case any building or structure is erected, constructed, reconstructed, altered, converted or maintained or any building structure or land is used in violation of this chapter or any other ordinance or regulation made by the Town pursuant to law, the Town may, by direction of the Town Board, in addition to other remedies provided, institute appropriate action or proceedings to prevent such lawful erection, construction, reconstruction, alteration, conversion, maintenance or use; to restrain, correct or abate such violation; or to prevent any illegal act, conduct, business or use in or about such premises.
B. 
Whenever a violation of this chapter occurs, any person may file a complaint in regard thereto. All such complaints must be in writing and shall be filed with the Code Enforcement Officer, who shall properly record such complaint and immediately investigate and report thereon to the Town Board.
C. 
In addition to the remedy or remedies hereinbefore provided any person, persons, company or corporation violating this chapter or any provision or section thereof may be proceeded against by the Town or by the Code Enforcement Officer of the Town or by the owner of any property in the Town by appropriate action or by proceeding in equity or otherwise to prevent and enjoin any threatened violation of this chapter.
