GENERAL; COMPREHENSIVE

MASTER DEVELOPMENT PLAN

§ 155.001 AUTHORITY TO ESTABLISH ZONING AND PLANNING REGULATIONS.

   A city may regulate in this area pursuant to the following state statutes:
   (A)   I.C. 36-7-4-100 Series: Applicability and Rules;
   (B)   I.C. 36-7-4-200 Series: Establishment of Commission;
   (C)   I.C. 36-7-4-300 Series: Organization of Commission;
   (D)   I.C. 36-7-4-400 Series: Duties and Powers of the Commission;
   (E)   I.C. 36-7-4-500 Series: Comprehensive Plan;
   (F)   I.C. 36-7-4-600 Series: Zoning;
   (G)   I.C. 36-7-4-900 Series: Subdivision Control;
   (H)   I.C. 36-7-4-800 Series: Improvement Location Permits;
   (I)   I.C. 36-7-4-900 Series: Board of Zoning Appeals; and
   (J)   I.C. 36-7-4-1000 Series: Remedies and Enforcement.

§ 155.002 DESIGNATION, TITLE AND PURPOSE.

   This subchapter shall be known and may be cited as the Comprehensive Master Development Plan Ordinance. The purpose of this subchapter is to establish a single unified code consisting of all plans, reports and ordinances plus supplemental details as contained in the report of the City Plan Commission entitled “Comprehensive Master Development Plan, 1964, Brazil, Indiana,” that deal with the subject of planning as a comprehensive guide to the future growth and development of the city and its environs.

§ 155.003 CONTENT AND SUBJECTS.

   The Comprehensive Master Development Plan consists of a descriptive report dated 1964, entitled “Comprehensive Master Development Plan, Brazil, Indiana,” together with the provisions of the maps, charts, plans and ordinances which have heretofore or may hereafter be enacted concerning the following subjects:
   (A)   Zoning;
   (B)   Subdivision control;
   (C)   Thoroughfares;
   (D)   School;
   (E)   Park;
   (F)   Recreation;
   (G)   Public areas and public works program and budget; and
   (H)   The Comprehensive Master Development Plan.

§ 155.004 AUTHORITY OF PLAN.

   The layout, the location, relocation, extension or widening of thoroughfares; the general design of neighborhoods and their street patterns; the use of land; their street patterns; the use of land; and the location of sites for schools, parks, recreation and other public uses and community facilities shall conform to the principles, policies and provisions of the Comprehensive Master Development Plan.

§ 155.005 EFFECT OF PLAN.

   The Common Council and all municipal boards, commissions and all other agencies of the city shall be guided by and give consideration to the general policy and pattern of development set out in the Comprehensive Master Development Plan prior to the authorization, construction, alteration or abandonment of any public installation, required or necessitated in the interest of the physical development of the city and its environs.

§ 155.006 CONTINUING AUTHORITY OF THE CITY PLAN COMMISSION.

   The City Plan Commission shall from time to time consider and review proposals with respect to changes and amendments in the Comprehensive Master Development Plan and, on conclusion of consideration thereon, including a public hearing, shall certify to the Common Council its report on those matters.

§ 155.007 PLAN ON FILE.

   The maps, charts, plans and reports which comprise the Comprehensive Master Development Plan are on file in the office of the City Clerk-Treasurer and are available for public inspection during all regular office hours of the City Clerk-Treasurer.

§ 155.008 RESPONSIBILITY OF THE CITY CLERK-TREASURER.

   The City Clerk-Treasurer is ordered and directed to keep on file, for public inspection during all regular office hours, two copies of the Comprehensive Master Development Plan, including maps, charts, plans and ordinances referred to herein.

§ 155.009 AMENDMENTS.

   The Comprehensive Master Development Plan may be amended from time to time following a report thereon by the City Plan Commission, prepared either on the direction of the Common Council or on its own initiative.
