(1)

General Requirements.

(a)

Any person who uses, constructs, installs, reconstructs, replaces the liner, enlarges, or substantially alters an animal manure storage facility or transfer mechanism, or who employs or is employed by another person to do the same, on land subject to this section, shall be subject to the provisions of this section.

(b)

The Portage County LWCD may require upgrading, replacement or closure, in accordance with this section, of any storage facility that poses an imminent threat to public health, aquatic life or is causing a violation of water quality standards.

(2)

State Of Wisconsin Requirements.

(a)

Manure, commercial fertilizer and other nutrients shall be applied in conformance with a nutrient management plan using the schedule stated in Wis. Admin. Code, Section NR 151.07(4) and the compliance requirements stated in Wis. Admin. Code Section NR 151.09(3).

(3)

Compliance With Permit Requirements. A person is in compliance with this section if he or she follows the procedure of this section, receives a permit from the Portage County Land and Water Conservation Division (LWCD) of the Planning and Zoning Department before beginning activities requiring permits and complies with the standards of the Ordinance.
