Zoning Districts Established; Zoning Map

§ 26-81 Use districts.

For the purpose of this chapter, the City is divided into 11 districts, as follows:
Agriculture:
A-1 Agriculture District
Residential:
R-1 Single-Family Residential — Low Density
R-2 Single-Family Residential — High Density
R-3 Multiple Family — Low Density
R-4 Multiple Family — High Density
Commercial:
C-1 Planned Business District
C-2 General Business District
C-3 Highway Commercial District
Industrial:
I-1 Light Industrial District
I-2 Heavy Industrial District
I-3 Airport Industrial District

§ 26-82 District boundaries.

(a) 
The zoning districts are bounded and defined as shown on a map entitled "Zoning Map of the City of Butler, Missouri" and such map and all its notations, references, and other information shown thereon shall be as much a part of this chapter as if the notations, references and other matters set forth by said map were all fully described herein. Where uncertainty exists as to the boundaries of the districts as shown on the zoning map, the following rules shall apply:
(1) 
Boundaries indicated as approximately following the centerline of streets, highways, alleys or other public rights-of-way shall be construed to be the boundary.
(2) 
Boundaries indicated as approximately following platted lot lines shall be construed to be the boundary.
(3) 
Boundaries that divide a lot or parcel of property, the location of any such boundary shall be determined by the use of the scale appearing on such map.

§ 26-83 Annexation of land.

If new territory becomes a part of the area of jurisdiction of this chapter by reason of annexation, consolidation or detachment from any municipal corporation or otherwise, such territory shall automatically be classified as an A-1 district, until and unless otherwise rezoned in accordance with the amendment proceedings hereof; provided, however, that any zoning classification in effect prior to such annexation or other extension of jurisdiction shall remain in full force and effect until changed or amended in accordance with the procedures and requirements prescribed for such change or amendment by this chapter.

§ 26-84 Territory not included.

In case any territory subject to the jurisdiction of this chapter has not been specifically included in any of the aforesaid districts, such territory shall automatically be classified as an A-1 district, until and unless otherwise rezoned in accordance with the amendment proceedings hereof; provided, however, that any zoning classification in effect prior to the enactment of this chapter shall remain in full force and effect until changed or amended in accordance with the procedures and requirements prescribed for such changes or amendments by this chapter.

§ 26-85 Rights-of-way and downtown square zoning.

Except as may be preempted by applicable law, or otherwise provided by subsequent site-specific zoning enactment of the City, all rights-of-way within the City are hereby zoned R-1 single-family residential district except for any rights-of-way that are not within 1,000 feet of a property zoned residential or used for a residential dwelling. Provided no use otherwise authorized in such single-family zone shall be permitted in the rights-of-way that is not specifically authorized by the City's rights-of-way regulations. Additionally, the City of Butler historic square (Bates County Courthouse square) and including all rights-of-way and public property within the downtown historic area shown on the official zoning map as zoned C-2 shall hereby be zoned "historic" as an additional overlay zoning for purposes of all applicable laws providing special or different protections for historic areas or properties.
