TITLE THREE
Subdivision Regulations
1171.01 ADOPTION.
Policy and procedure for the development and/or improvement of Village infrastructure are hereby authorized to be promulgated and to thereafter be enforced within the Village of Cardington, Ohio in the following manner.
(a) Upon the passage of this chapter and from time to time thereafter as may be deemed necessary by the Council of the Village of Cardington, proposed infrastructure development and/or improvement policies may be presented to Village Council for consideration.
(b) Such policies and procedures may be proposed by the Cardington Planning Commission, the Cardington Community Improvement Corporation, individual Village Council Member or the Village Mayor to the “Utilities, Planning, Annexation and Permits Committee” of Cardington Village Council. All such proposals shall be in writing.
(c) The Utilities, Planning, Annexation and Permits Committee shall review the proposal(s) and present same in official format to the Village Council with its recommendation at a regular Council meeting within thirty (30) days, but no later than two (2) regular meetings following receipt of such proposal(s).
(d) Upon approval of such proposed Policies and Procedures by majority vote of the Council Members at a regular meeting, said Policies and Procedures shall become effective and have the full force and effect of law.
(e) Any Policies and Procedures may be altered, changed or amended by following the same procedures as set forth in subsections (b), (c), and (d) above.

1171.02 ENFORCEMENT.
The enacted Policies and Procedures shall be enforceable by any and all legal remedies allowed by law. Intentional violation of the Policies and Procedures shall be and constitute a minor misdemeanor offense as defined in the Ohio Revised Code. Each day of violation shall constitute a separate offense. (Ord. 94-16. Passed 12-19-94.)
1171.03 CONFLICT.
Any and all prior enacted ordinances and resolutions of the Village of Cardington, Ohio which conflict with any such Policies and Procedures adopted, shall upon the effective date of such adopted Policies and Procedures, be, and hereby are, subordinated to this chapter and its properly enacted Policies and Procedures.
