ADULT BOOK

STORE AND ADULT MOTION PICTURE THEATER Cr. #96-8

17.60 - FINDINGS AND PURPOSE. (Am. #99-12)

The City Council finds that, due to their nature, the existence of adult book stores, adult motion picture theaters, and adult cabarets has serious objectionable operational characteristics, such as an effect upon property values, local commerce, crime, and spread of disease. Due to the deleterious combined effect on adjacent areas when such uses are concentrated, they should not be permitted to be located in close proximity to each other. Special regulation of these uses is necessary to ensure that these adverse effects will not contribute to the blighting or downgrading of the surrounding neighborhood. Such regulations are contained in these standards. These standards are designed to protect the City's retail trade, maintain property values, health, prevent crime, and in general, protect and preserve the quality of the City's neighborhoods, commercial districts and the quality of urban life.

(1)

STANDARDS. An adult book store, an adult motion picture theater, and an adult cabaret are permitted only in the C-2 district, provided in each case that:

(a)

Such use shall not be located within 750 feet of any residential district.

(b)

Such use shall not be located within 750 feet of a public or private school, church, nursery, day care center, or park.

(c)

Such use shall not be located within 1,000 feet of another adult book store, adult motion picture theater, or adult cabaret.

(d)

The distances provided in this subsection shall be measured by following a straight line, without regard to intervening buildings, from the nearest point of the lot upon which the proposed use is to be located, to the nearest point of the residential zoning district boundary line.

(e)

Such use shall not be located in a structure that has a door, window, or opening that is constructed in such a way that the public can view the interior contents and/or activities without entering the structure.

(f)

Such use shall not have an exterior sign or advertising information that combined occupies more than 9 square feet. All exterior sing(s) or advertising information shall to be illuminated and shall not depict "specified sexual activities" or "specified anatomical areas" (as defined herein) or be offensive to any person.

(g)

Such use shall display a 2-foot by 2-foot sign located within 3 feet of the structure entrance in such a position that any person approaching to enter will be able to read the following:

"Must be 18 years old to enter"

"Material beyond this door may be offensive"

(h)

Violation of these provisions is declared to be a public nuisance per se.

(i)

Nothing in this subsection is intended to authorize, legalize or permit the establishment, operation, or maintenance of any business, building, or use which violates any City ordinances or statute of the state of Wisconsin regarding public nuisances, sexual conduct, lewdness, or obscene or harmful matter or the exhibition or public display thereof.
