CHAPTER 8

COMMUNITY ZONES

9-8A-1: PURPOSE:

The CS zone may be used either for the purpose of implementing the public lands comprehensive plan designation, or as an overlay district for minor institutions established in any other zone. (1996 Code § 17.52.010)

9-8A-2: PERMITTED USES:

In a CS zone, the following uses and their accessory uses are permitted:
   A.   Major Institutions: "Major institutions", defined as the following:
Government office buildings.
Hospital, clinic or extended care facility.
Public or private cemetery, crematory or mausoleum.
Schools, public and private, and associated facilities. (1996 Code § 17.52.020)
   B.   Minor Institutions: "Minor institutions", defined as the following:
Church.
Daycare facilities licensed by the state of Oregon.
Dwelling for a watchman or caretaker for a permitted use.
Library.
Parks, playground, sports arena, golf course.
Police and fire station, or armory.
Private club, fraternal organization lodge, grange hall.
Utility facilities, including electric power substation, telephone switching station, sewage pumping station, sewage treatment plant, water treatment plant, water storage reservoir, public works shop, telephone microwave facility and radio or television transmission facilities.    C.   Similar Uses: Any other use determined by the planning commission to be similar in nature to the uses listed in subsections A and B of this section. (1996 Code § 17.52.020)

9-8A-3: CONDITIONAL USES:

In a CS zone, the following uses may be permitted, with conditions, by the planning commission in accordance with section 9-14-2 of this title, and after a public hearing:
Communication tower. (Ord. 605, 4-4-2001)

9-8B-1: PURPOSE:

The OS Zone is for the preservation and protection of recreational and other open spaces. (Ord. 686, 7-12-2017)

9-8B-2: PERMITTED USES:

   A.   Uses Designated: In an OS Zone, the following uses and their accessory uses are permitted:
Boat launching facilities and docks.
Golf courses.
Marinas.
Open space preservation areas.
Parks.
Paths and trails.
Playgrounds.
Public rest areas.
   B.   Similar Uses: Any other use determined by the Planning Commission to be similar in nature to the above uses. (Ord. 686, 7-12-2017)

9-8B-3: CONDITIONAL USES:

In an OS Zone, the following uses may be permitted, with conditions, by the Planning Commission in accordance with section 9-14-2 of this title, and after a public hearing:
Communication tower. (Ord. 686, 7-12-2017)

9-8B-4: URBAN FARMING:

   A.   Property use in the OS Zone for urban farming for commercial or non-profit purposes or sustenance is permitted by approval of the Planning Commission in accordance with section 9-14-2 of this title, and after a public hearing.
   B.   Produce that can be grown on this property includes fruits and vegetables. Livestock may also be raised on the property. Medical and recreational marijuana cultivation is not permitted.
   C.   Keeping of livestock and commonly domesticated animals, on these farms, including pastureland is allowed with the following requirements:
      1.   Sanitation: Proper sanitation shall be maintained for all animals at all times to prevent any condition which may be dangerous or detrimental to the health of the public or animals, or constitute a nuisance. This includes noise and order nuisances.
      2.   Fencing: Fencing is required, unless otherwise contained by a natural barrier, and shall be designed and constructed to confine all animals to the site on which the animal is kept.
      3.   Enclosures: An enclosure is required and shall be designed and constructed to provide shelter from the weather for all animals kept outdoors on the development site.
   D.   Lot area minimum: 2.5 acres.
   E.   Minimum setbacks for structures:
      1.   Front yard: Ten feet (10').
      2.   Side and rear yard: Ten feet (10').
   F.   Minimum parcel dimensions for animal husbandry, livestock, shall be determined by Best Management Practices available through the Oregon State University Extension Office.
   G.   Property in the OS Zone used for urban farming used for commercial or non-profit purposes shall meet the State requirements listed in Oregon Revised Statutes 568.900 et seq., to the extent applicable, and provide the City with a copy of the approved permits from the State Department of Agriculture for water quality and the use of herbicides, pesticides and fungicides.
