COMMERCIAL DISTRICTS

§ 151.060 STATEMENT OF PURPOSE.

   The commercial districts established by this chapter are designed to promote and protect the health, safety, morals, convenience, order, prosperity and other aspects of the general welfare. These general goals include, among others, the following purposes:
   (A)   To provide space for the many and diverse types of commercial activity needed to serve the people and industry of Collierville;
   (B)   To promote the constructive improvement and orderly growth of the existing well located commercial centers;
   (C)   To prevent indiscriminate mixture of commercial activity within commercial area;
   (D)   To protect adjacent residential areas from offensive and detrimental influences;
   (E)   To promote the most efficient and desirable land use.

§ 151.061 NC NEIGHBORHOOD COMMERCIAL DISTRICT.

   (A)   Purpose and intent. Within the limits of the Downtown Collierville Small Area Plan Study Area, these districts are designed to provide a variety of goods and services for immediate residential neighborhoods. It is not intended that these districts permit uses which generate large volumes of truck traffic. Adequate landscape buffers, fencing or walls and appropriate open spaces between non-residential and residential areas are required to protect the integrity of residential neighborhoods. Non-residential buildings should be designed to reflect the residential form, limited to one- to two-stories, to blend with the adjacent residential neighborhood with parking typically to the side or rear of the building. Emphasis is on a pedestrian scale, designed for walkability with the nearby neighborhoods.
   (B)   Uses and structures.
      (1)   Principal permitted uses and structures. For specific permitted uses allowed in this zoning district, refer to § 151.021.
      (2)   Permitted accessory uses and structures.
         (a)   Accessory off-street parking and loading facilities as required in §§ 151.115 et seq.
         (b)   Accessory facilities and buildings customarily incidental to a permitted use as regulated by § 151.025.
      (3)   Conditional uses. For specific conditional uses allowed in this zoning district, refer to § 151.021.
      (4)   Prohibited uses. Any use not allowed by right, by accessory or by conditional uses is prohibited in the NC Neighborhood Commercial District. (See also § 151.021.)
   (C)   Bulk regulations. For bulk regulations, which include minimum lot area, minimum lot width at the building line, and maximum height, refer to the table in § 151.027(D).
   (D)   Yard requirements. For yard requirements in the NC Neighborhood Commercial District, including setbacks for front, side and rear yards, refer to the table in § 151.027(D).
   (E)   Use of required yard area. All open areas not occupied by sidewalks, driveways, and parking or loading areas shall also be devoted to landscaping as defined in § 151.003.
   (F)   Site plan review process. This site plan review and approval process is outlined in § 151.311.
   (G)   Enclosure requirements. All uses in the NC Neighborhood Commercial District shall be conducted within completely enclosed buildings except for parking, loading and other accessory uses, as regulated by § 151.025, which by their nature exist outside a building.

§ 151.062 MPO MEDICAL - PROFESSIONAL OFFICE DISTRICT.

   (A)   Purpose and intent. These districts are designed to provide adequate space in appropriate locations suitable for accommodating medical, dental or similar personal services and to provide for professional and business offices. In addition, certain commercial trade and service uses are permitted if necessary to serve the frequent and recurring needs of persons working in this district. Bulk limitations are designed to maximize compatibility with less intensive land uses when adjacent to residential districts.
   (B)   Uses and structures.
      (1)   Principal permitted uses and structures. For specific permitted uses allowed in this zoning district, refer to § 151.021.
      (2)   Permitted accessory uses and structures.
         (a)   Accessory off-street parking and loading facilities as required in §§ 151.115 et seq.
         (b)   Accessory facilities and buildings customarily incidental to a permitted use as regulated by § 151.025.
      (3)   Conditional uses. For specific conditional uses allowed in this zoning district, refer to § 151.021.
      (4)   Prohibited uses. Any use not allowed by right, by accessory or by conditional uses is prohibited in the MPO Medical Professional Office District. (See also § 151.021.)
      (5)   Restriction on the amount of space devoted to conditional uses. In order to maintain the office and professional character of the MPO Districts, at least 75% of the gross floor area of any structure on a lot in an MPO District shall be occupied by uses permitted by right (for example, principal permitted uses and structures).
   (C)   Bulk regulations. For bulk regulations, which include minimum lot area, minimum lot width at the building line, and maximum height, refer to the table in § 151.027.
   (D)   Yard requirements.
      (1)   General provisions. General provisions applicable to all commercial districts concerning visibility at intersections, permitted obstructions in required yards, obstructions prohibited at street intersections, exceptions to these provisions and other regulations are contained in § 151.006.
      (2)   Basic provisions. For yard requirements, which include setbacks for front, side, and rear yards, refer to the table in § 151.027.
   (E)   Use of required yard area. The following uses may be made of yard areas in the MPO Districts.
      (1)   Landscaping. The first ten feet of any required yard adjacent to a street shall be devoted to landscaping (as defined in § 151.003). All other required yard areas not occupied by sidewalks and driveways shall also be devoted to landscaping.
      (2)   Driveways and accessory off-street parking. No driveway or parking area shall occupy more than half of any required yard.
      (3)   Sidewalks.
   (F)   Site plan review process. This site plan review and approval process is outlined in § 151.311.
   (G)   Enclosure requirements. All uses shall be conducted within completely enclosed buildings except for parking, loading and other accessory uses, as regulated by § 151.025, which by their nature exist outside a building.

§ 151.063 SCC SHOPPING CENTER COMMERCIAL DISTRICT.

   (A)   Purpose and intent. These districts are designed to provide for the development of shopping and commercial centers of integrated design of various sizes to serve the community. In these coordinated commercial developments a variety of uses are permitted, including commercial trade and service uses, entertainment facilities and offices. These districts are intended to be designed to accommodate safely a high volume of automotive traffic, so ease of automotive access is essential. Appropriate open space between commercial and residential areas is required.
   (B)   Uses and structures.
      (1)   Principal permitted uses and structures. For specific permitted uses allowed in this zoning district, refer to § 151.021.
      (2)   Permitted accessory uses and structures.
         (a)   Accessory off-street parking and loading facilities as required in §§ 151.115 et seq.
         (b)   Accessory facilities and buildings customarily incidental to a permitted use as regulated by § 151.025.
      (3)   Conditional uses. For specific conditional uses allowed in this zoning district, refer to § 151.021.
      (4)   Prohibited uses. Any use not allowed by right, by accessory or by conditional uses is prohibited in the SCC Shopping Center Commercial District. (See also § 151.021.)
   (C)   Bulk regulations. For bulk regulations, which include minimum lot area, minimum lot width at the building line, and maximum height, refer to the table in § 151.027.
   (D)   Yard requirements.
      (1)   General provisions. General provisions applicable to all commercial districts concerning visibility at intersections, permitted obstructions in required yards, obstructions prohibited at street intersections, exceptions to these provisions and other regulations are contained in § 151.006.
      (2)   Basic provisions. For yard requirements, which include setbacks for front, side, and rear yards, refer to the table in § 151.027.
   (E)   Use of required yard area. The following uses may be made of yard areas in the SCC Districts.
      (1)   Landscaping. The first ten feet of any required yard adjacent to a street shall be devoted to landscaping (as defined in § 151.003). All other required yard areas not occupied by sidewalks and driveways shall also be devoted to landscaping.
      (2)   Driveways and accessory off-street parking. The maximum number of permitted parking spaces shall be based upon a ratio of one parking space per 200 square feet of gross building area with the exception of auto dealerships, places of assembly and those permitted and conditional land uses that have a minimum parking space requirement that is less, in which case the minimum parking space requirement shall also serve as the maximum parking space requirement. Auto dealerships shall be permitted one additional parking space per 125 square feet of gross building area for customer parking and vehicle storage areas completely concealed from public view with a masonry brick wall. All parking areas shall be striped and all vehicles shall be parked within designated parking spaces. The maximum number of spaces for places of assembly, including, but not limited to, churches, auditoriums, theaters and restaurants shall not exceed one space for every two seats provided for within the assembly occupancy.
   (F)   Site plan review process. This site plan review and approval process is outlined in § 151.311.
   (G)   Enclosure requirements. All uses shall be conducted within completely enclosed buildings except for parking, loading and other accessory uses, as regulated by § 151.025, which by their nature exist outside a building.

§ 151.064 CB CENTRAL BUSINESS DISTRICT.

   (A)   Purpose and intent. This district is designed to provide for a wide range of retail, office, amusement, accessory residential, attached residential, institutional and service uses within the limits of the Downtown Collierville Small Area Plan Study Area. High intensity of use is permitted in this district and increased building bulk is provided as a means of encouraging such development. This district is intended to be designed in a manner conducive to and safe for a high volume of pedestrian traffic. The CB District is intended to accommodate some automotive-oriented uses, but an emphasis shall be placed on the pedestrian and walkability.
   (B)   Uses and structures.
      (1)   Principal permitted uses and structures. For specific permitted uses allowed in this zoning district, refer to § 151.021.
      (2)   Permitted accessory uses and structures.
         (a)   Accessory off-street parking and loading facilities as required in §§ 151.115 et seq.
         (b)   Accessory facilities and buildings customarily incidental to a permitted use as regulated by § 151.025.
      (3)   Conditional uses. For specific conditional uses allowed in this zoning district, refer to § 151.021.
      (4)   Prohibited uses. Any use not allowed by right, by accessory or by conditional uses is prohibited in the CB Central Business District. (See also § 151.021.)
   (C)   Bulk regulations. For bulk regulations, which include minimum lot area, minimum lot width at the building line, and maximum height, refer to the table in § 151.027.
   (D) Yard requirements. For yard requirements, which include setbacks for front, side, and rear yards, refer to the table in § 151.027(D).
   (E)   Use of open space. Within the CB Central Business District, all open areas not occupied by driveways, sidewalks, and parking or loading areas, shall be devoted to landscaping as defined in § 151.003.
   (F)   Access. All buildings in the CB District shall be readily accessible from the rear on order to provide for off-street loading or delivery.
   (G)   Site plan review process. This site plan review and approval process is outlined in § 151.311.
   (H)   Enclosure requirements. All uses in the CB Central Business District shall be conducted within completely enclosed buildings except for parking, loading and other accessory uses, as regulated by § 151.025, which by their nature exist outside a building.

§ 151.065 GC GENERAL COMMERCIAL DISTRICT.

   (A)   Intent and purpose. These districts are designed to provide adequate space in appropriate locations for the establishment of a wide variety of uses, including commercial trade and service uses, entertainment facilities, offices and establishments engaged in wholesale trade. Since these activities tend to generate relatively large volumes of traffic and have other characteristics detrimental to residential districts, their locations should be removed from the proximity of residential districts as much as possible.
   (B)   Uses and structures.
      (1)   Principal permitted uses and structures. For specific permitted uses allowed in this zoning district, refer to § 151.021.
      (2)   Permitted accessory uses and structures.
         (a)   Accessory off-street parking and loading facilities as required in §§ 151.115 et seq.
         (b)   Accessory facilities and buildings customarily incidental to a permitted use as regulated by § 151.025.
      (3)   Conditional uses. For specific conditional uses allowed in this zoning district, refer to § 151.021.
      (4)   Prohibited uses. Any use not allowed by right, by accessory or by conditional use is prohibited in the GC District.
   (C)   Bulk regulations. For bulk regulations, which include minimum lot area, minimum lot width at the building line, and maximum height, refer to the table in § 151.027.
      (3)   Maximum gross floor area ratio. The maximum gross floor area ratio (FAR) shall be 0.25.
   (D)   Yard requirements.
      (1)   General provisions. General provisions applicable to all commercial districts concerning visibility at intersections, permitted obstructions in required yards, obstructions prohibited at street intersections, exceptions to these provisions and other regulations are contained in § 151.006.
      (2)   Basic provisions. For yard requirements, which include setbacks for front, side, and rear yards, refer to the table in § 151.027.
