CHAPTER 12

6 AG AGRICULTURE DISTRICT

12-6-1 Description

The AG Agriculture District is intended to offer protection to agricultural land within the City limits from the depreciating effects of objectionable, hazardous, and unsightly uses and, at the same time, prevent untimely scattering of more dense urban development. The types of uses and intensity of use of lands which are authorized in this district are designed to encourage and protect all agricultural uses until urbanization is warranted and the appropriate changes in district classification are made.

12-6-2 Permitted Principal Uses

Property and buildings in an AG Agriculture District shall be used only for the following purposes:

  1. Included uses.
    1. Agricultural uses and services and certain other uses suitable for location in an agricultural environment.
    2. Any use permitted in the RS-1 or RS-2 Residential Single-Family District.
    3. Animal and poultry raising.
    4. Business signs or outdoor advertising subject to the provisions of CCC 12-13.
    5. Chick hatchery.
    6. Dairy farming.
    7. Farming.
    8. Fishery.
    9. Foster home.
    10. Guest or dude ranch.
    11. Horticultural nursery.
    12. Municipal use, public building, and public utility.
    13. Neighborhood group home subject to the provisions of CCC 12-5-5.
    14. Oil well or gas well, including the drilling thereof.
    15. Public park or playground.
    16. Ranching.
    17. Riding stable or academy.
    18. Roadside sales stands.
    19. Servant or caretaker quarters.
    20. Veterinary hospital (large animals).
    21. Water reservoir.
  2. Use conditions.
    1. Dairy farming, fishery, guest or dude ranch and riding stable or academy requires a minimum lot area of five acres.
    2. Horticultural nursery permits the growing of plant stocks only, and no retail sales are permitted on the site.
    3. Roadside sales stands, provided:
      1. Only products raised on the premises shall be sold in such stand.
      2. Such stands shall be of a temporary nature and shall not be constructed as a permanent structure.
      3. The stand shall be set back from the front property line an adequate distance to permit parking and ingress and egress; and shall not be constructed in such a location as to create an undue traffic hazard.
      4. The stand shall be removed during winter months. Veterinary hospital (large animals) requires a minimum lot area of five acres.

12-6-3 Permitted Accessory Uses And Structures

Accessory uses and structures customarily incident to a permitted principal use in the AG Agriculture District are permitted in such districts. In addition, the following uses are permitted as accessory uses:

  1. Children's day nursery.
  2. Fallout and/or storm shelter.
  3. Family daycare home, subject to the provisions of CCC 12-5-6.
  4. Home occupation subject to the provisions of CCC 12-5-4.
  5. Mausoleums in existing or approved cemeteries.
  6. Signs subject to the provisions of CCC 12-13.

12-6-4 Uses Permitted By Special Exception

The following uses may be permitted as special exceptions by the Board of Adjustment in accordance with the provisions contained in CCC 12-3A:

  1. Advertising signs.
  2. Community group home subject to the provisions of CCC 12-5-7.
  3. Sewer lagoon.

12-6-5 Uses Permitted By Specific Use Permit

The following uses may be permitted upon the issuance of a specific use permit by the Planning Commission and City Council in accordance with the provisions contained in CCC 12-3D:

  1. Cemetery.
  2. Churches, rectories, convents, parish houses, halls, and other religious uses.
  3. Country clubs and golf courses, excluding miniature golf courses and driving ranges.
  4. Kennel.
  5. Public school or school offering general education courses the same as ordinarily given in the public schools and having no rooms regularly used for housing and/or shopping.
  6. Sewage disposal facility.
  7. Water treatment facility and/or water storage facility.

12-6-6 Minimum Yard Requirements

  1. Front yard. The depth of the required front yard shall be determined in the following manner: Measured from the centerline of the abutting street, add one-half of the right-of-way designated on the City major street and highway plan or 25 feet if not designated on the street and highway plan, to a setback of 35 feet.
  2. Side yards. All buildings shall be set back from the side lot line to comply with the following side yard requirements:
    1. For principal buildings on interior lots, there shall be a minimum side yard of 20 feet.
    2. For unattached accessory buildings on an interior lot, there shall be a minimum side yard of ten feet.
    3. On any corner lot, the depth of the required exterior side yard shall be determined in the following manner: Measured from the centerline of the abutting street, add one-half of the right-of-way designated in the City major street and highway plan, or 25 feet if not designated on the street plan, to a setback distance of 25 feet. The interior side yard requirements shall be the same as in subsections B1 and 2 of this section.
  3. Rear yard. There shall be a rear yard for principal buildings of not less than 25 feet. Unattached accessory buildings may be located in the rear yard but shall be set back at least ten feet from the rear property line or outside any utility easement, whichever is greater.

12-6-7 Minimum Lot Area

The minimum lot area for uses permitted by right or special exception is two acres or the land area required by the County Health Department, whichever is greater.

12-6-8 Minimum Lot Width And Frontage

  1. The minimum lot width for uses allowed in the agriculture district is 200 feet.
  2. All lots shall abut on a street for a distance of not less than 30 feet.

12-6-9 Maximum Height Of Structures

Except as provided in CCC 12-5-8, no structure shall exceed 40 feet in height.
