The city decision making bodies and officials described in this chapter, without limitation upon such authority as each may possess by law, have responsibility for implementing and administering this title in the manner described in sections 12-2-2 through 12-2-5 of this chapter. 12-2-2: CITY COUNCIL:
The city council, as the city's legislative body, hereby reserves to itself the following powers and duties in connection with the implementation of this title:
A. To initiate amendments to the text of this zoning ordinance and to the zoning map, subject to the regulations of section 12-3-7, "Amendments", of this title;
B. To grant or deny amendments to the text of this zoning ordinance and to the zoning map, upon recommendation of the PZB, subject to the regulations of section 12-3-7, "Amendments", of this title;
C. To grant or deny any variations not within the jurisdiction of the PZB or the zoning administrator, upon recommendation of the PZB, subject to the regulations of section 12-3-6, "Variations", of this title; provided, however that the city council shall have jurisdiction to grant or deny any variation that would normally be under the jurisdiction of the PZB, when the applicant is concurrently requesting other relief over which the city council has original jurisdiction pursuant to this section;
D. To grant or deny conditional use permits, upon recommendation of the PZB, subject to the regulations of section 12-3-4, "Conditional Uses", of this title;
E. To grant or deny planned unit developments, upon recommendation of the PZB, subject to the regulations of section 12-3-5, "Planned Unit Developments", of this title;
F. To take such other actions not delegated to other bodies or officials as may be desirable or necessary to implement the provisions of this title; and
G. To grant or deny extensions for nonconforming uses and buildings, subject to the regulations of chapter 5, "Nonconforming Uses And Structures", of this title. (Ord. Z-29-15, 10-5-2015)

The planning and zoning board ("PZB") created by section 2-2-1 of the city code, shall be comprised as set forth in title 2, chapter 2 of the city code and shall be vested with the following jurisdiction and authority under the zoning ordinance:
A. To initiate amendments to the text of this zoning ordinance and to the zoning map, subject to the regulations of section 12-3-7, "Amendments", of this title;
B. To hear and make recommendations to the city council regarding amendments to the zoning ordinance and to the zoning map, subject to the regulations of section 12-3-7, "Amendments", of this title; and
C. To hear and make recommendations to the city council regarding planned unit developments, including preliminary and final plats, subject to the regulations of section 12-3-5, "Planned Unit Developments", of this title.
D. To grant or deny appeals from any order, requirement, decision or determination made by the zoning administrator under this zoning ordinance, subject to the regulations of section 12-3-9, "Appeals", of this title.
E. To grant or deny any variations from the zoning ordinance not within the jurisdiction of the zoning administrator or the city council, subject to the regulations of section 12-3-6, "Variations", of this title;
F. To hear and make recommendations to the city council regarding variations from the zoning ordinance that are within the jurisdiction of the city council, subject to: 1) the regulations of section 12-3-6, "Variations", of this title; and 2) the provision of section 12-2-2, "City Council", of this title regarding the city council's authority over variations when other relief is being requested concurrently;
G. To hear and make recommendations to the city council regarding conditional uses, subject to the regulations of section 12-3-4, "Conditional Uses", of this title; and
H. To hear and make recommendations to the city council regarding localized alternative sign regulations, subject to the requirements of section 12-11-8, "Localized Alternative Sign Regulations", of this title and the regulations of section 12-3-4, "Conditional Uses", of this title. 12-2-5: ZONING ADMINISTRATOR:
A. Creation: It is hereby established that the director of community and economic development or his designee shall serve as the zoning administrator. (Ord. Z-8-98, 9-21-1998)
B. Duties Of The Office Of Zoning Administrator: The zoning administrator shall enforce this zoning ordinance, and in addition thereto and in furtherance of said authority shall:
1. Grant or deny all zoning certificates and make and maintain records thereof, subject to the regulations of section 12-3-3, "Zoning Certificates", of this title;
2. Interpret the provisions of this title, subject to the regulations of section 12-3-8, "Administrative Interpretations", of this title; (Ord. Z-11-14, 4-7-2014)
3. Grant or deny any variations from the zoning ordinance not within the jurisdiction of the city council and/or the planning and zoning board, subject to the regulations of section 12-3-6, "Variations", of this title;

5. Maintain permanent and current records of the zoning ordinance, including, but not limited to, all maps, amendments, variations, conditional uses, planned unit developments, administrative interpretations, appeals and applications thereof;
6. Serve as a public information source relative to all matters arising out of this zoning ordinance;
7. Conduct inspections of buildings, structures and uses of land to determine compliance with the terms of this zoning ordinance, subject to the regulations of chapter 4, "Enforcement And Penalties", of this title;
8. Enforce the provision of this title pursuant to chapter 4, "Enforcement And Penalties", of this title; and
9. Appoint three (3) member staff design review committee and conduct building design review process in accordance with section 12-3-11, "Building Design Review", of this title. (Ord. Z-11-14, 4-7-2014)

This diagram is intended for use as a guide only. It shall be necessary to consult the text of the zoning ordinance for specific procedures and regulations pertaining to the decision making process and responsibilities, and for the method of filing and perfecting appeals of decisions made pursuant to this title.
