ZONING DISTRICTS

§ 151.055 INCLUSION.

   It is the intent of this chapter that the entire area of the village, including all land and water areas, rivers, streets, alleys, railroads and other rights-of-way, be included in the districts established by this chapter. Any area not shown on the Official Zoning Map of the village as being included in any zoning district shall be deemed to be in the R-1 1-Family Residence District.

§ 151.056 DISTRICTS.

   (A)   Generally. In order to accomplish the purpose of this chapter the Village of Diamond, Illinois, is hereby divided into the following districts.

§ 151.057 MAPS.

   The boundaries of the zoning districts are established as shown on the maps entitled “Official Zoning Map of Diamond, Illinois,” which map is made a part hereof, and shall have the same force and effect as if the Zoning Map, together with all notations, references and other information shown thereon, were fully set forth and described herein.

§ 151.058 DISTRICT BOUNDARIES.

   District boundary lines are either the center lines of railroads, highways, streets, alleys or easements, or the boundary lines of sections, quarter-sections, divisions of sections, tracts or lots, or such lines extended otherwise indicated.

§ 151.059 ZONING OF PUBLIC WAYS.

   All streets, alleys, public ways, waterways and railroad rights-of-way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately adjacent to such streets, alleys, public ways and railroad rights-of-way or waterways. Where the center line of a street, alley, public way, waterway or railroad right-of-way serves as a district boundary, the zoning of such areas, unless otherwise specifically designated, shall be deemed to be the same as that of the adjacent property up to such center line.

§ 151.060 ZONING OF ANNEXED LAND.

   Unless otherwise provided for in an annexation agreement, all land which hereafter may be annexed to the village shall automatically be classified in the R-1 1-Family Residence District.

1   Outdoor storage of equipment, production waste or product for microbreweries, microdistilleries and microwineries is strictly prohibited when located in a business district. However, outdoor storage of spent grains or grapes may be permitted to be stored outdoors in appropriate silos or containers in the manufacturing districts, provided the storage is screened from public view. Screening may be with fencing, landscaping or a combination of both.
   Microdistilleries or microwineries located in business districts must include an ancillary tasting room with a minimum of 150 square feet. Retail sales of the product from a microdistillery or microwinery are permitted on site and shall be consistent with state and local laws.
   Microbreweries/brew pubs, where if off-premise consumption is allowed, all sales must be in capped/sealed containers. Microbrewery/brew pub operations in a business district must be ancillary to a restaurant, and the brewing component of the facility shall not be more than 25% of the total floor area.
2   Any religious institution with an assembly area with a seating capacity greater than 200 people shall be considered a special use regardless of the district.
