45 PLANNED UNIT DEVELOPMENTS

§ 18.45.010 Purpose, goals, and objective.

A. 
Purpose. The purpose of this chapter is to establish clear development standards that will achieve the city of Donnelly's vision for development as presented in the Donnelly comprehensive plan. The standards will be designed to create livable communities that provide exemplary open spaces and recreational opportunities, that encourage a diversification of housing types, styles and living options for a wide range of income levels and lifestyles, and thereby enhance the living experience within the city of Donnelly.
B. 
Goals. To provide guidance and establish expectations for development within the city of Donnelly. The development provides clear standards and options for development within the city including lot sizing, setbacks, open space and the diversification of housing types.
C. 
Objective. To guide land development and construction to achieve the following:
1. 
A maximum choice of living environments by allowing a variety of housing and building types, lot dimensions, yards, building setbacks and area requirements;
2. 
A more useful pattern of open space and recreation areas and, if permitted as part of the project, more convenience in the location of accessory commercial uses, office uses and services;
3. 
A development pattern which preserves and utilizes natural topography and geologic features, scenic vistas, trees and other vegetation, and prevents the disruption of natural drainage patterns;
4. 
A more efficient use of land than is generally achieved through conventional development resulting in substantial savings through shorter utilities and streets; and
5. 
A development pattern in harmony with the objective for land use density, transportation and community facilities as presented in the comprehensive plan.
6. 
A development pattern that provides for the integrated and harmonious design of buildings, and for adequate and properly arranged facilities for internal traffic circulation, landscaping and such other features and facilities as may be necessary to make the project attractive and efficient from the standpoint of the adjoining and surrounding noncommercial areas.

§ 18.45.020 Processing and standards.

A Planned Unit Development (PUD) shall be processed as a Conditional Use Permit, under the conditional use permit criteria, with the following stipulations:
A. 
All state statutes regarding a Planned Unit Development shall be complied with.
B. 
The development shall be processed as a CUP as regulated within this title.
C. 
The conditions of approval may stipulate that all, or a limited number, of permitted uses identified within the zone chart are permitted and may stipulate that all, or a limited number, of the conditional uses identified within the zone chart are permitted if the council finds that the CUP findings will be met.
D. 
Development shall comply with all applicable city codes such as but not limited to design review regulations, subdivision regulations and floodplain development regulations except as stipulated within subsection (E) of this section.
E. 
Per Idaho Code Section 67-6512(f), exceptions or waivers of standards, other than use, may be permitted if the Council finds that the CUP findings are met and if those specific exceptions or waivers are identified in the conditions of approval for the CUP. Such exceptions or waivers may include, but are not limited to, lot coverage, lot sizes and setbacks. Any exceptions or waivers granted by the Council are to achieve a more desirable planned development.
