§ 155.099 ADOPTION BY REFERENCE 2.
The Turtleback Mountain Resort Planned Unit Development Overlay Zone as described in the Turtleback Mountain Partners submission of 1-18-2006 with added drainage plan and amendments thereto is herewith adopted by reference and made a part of this subchapter.
Turtleback Mountain Resort PUD Ordinance shall be applicable to the territory within the boundaries of the Turtleback Mountain Resort PUD identified on the submission attached and adopted in § 155.099
of this subchapter.

§ 155.101 PURPOSE.
The purpose of this subchapter is to document Elephant Butte City Council approval of the Turtleback Mountain Resort Planned Unit Development Overlay Zone and to permit the PUD to proceed as described in the submission under conditions of §§ 155.075
through 155.080
, Planned Unit Development Special Use Overlay Zone and those listed in § 155.102
of this subchapter.

§ 155.102 CONDITIONS OF APPROVAL.
The Turtleback Mountain Resort Planned Unit Development is approved to proceed with the following conditions:
(A) The definition of COMMUNITY DRIVE is the same as the meaning of COLLECTOR STREET as given in Chapter 151.
(B) Any accessory dwelling or guest cottage constructed within the Turtleback Mountain Resort PUD Overlay Zone shall be counted toward the total number of dwellings permitted by this subchapter within this PUD zone.

§ 155.103 FIRE SUPPRESSION PROCEDURES.
In the event of any fire within the developed Turtleback Mountain Resort Planned Unit Development, guidleines for response to said fire(s) can be found in “Turtleback Mountain Resort Fire Fighting and Safety Plan” which is herewith adopted by reference.

This subchapter shall become effective 5 days after passage and posting in the same locations as designated in the current open meetings act resolution as designated by the Open Meetings Act Resolution adopted each year, by summary title as provided by law.
