Approach area. There shall be one approach area in the air space above the airport district extending from each end of each landing strip situated within Zone I of the Airport District for a distance of two miles from each end of each landing strip. Each approach area within the Airport District shall be a trapezoid portion of the zoned area 1,000 feet in width at the end of each landing strip and broadening to a width of 4,000 feet two miles distant from the end of each landing strip.

The center line of each approach area shall be a continuation of the center line of the landing strip.

Turning areas. Turning areas shall consist of all portions of the Airport District not included within the approach areas.

Airport height restrictions. No building, structure or other object shall hereafter be erected, altered, reconstructed or used, nor shall any trees or other natural objects be permitted to grow or be maintained within the approach areas the height of which, above the elevation of the end of the landing strip nearest the said object, in the case of Zone I airports, would exceed by a vertical distance 1/40 of its shortest horizontal distance from the end of such landing strip, and in the case of Zone II airports, would exceed by a vertical distance 1/10 of its shortest horizontal distance from the end of such landing strip, and provided that within a distance of two miles from the end of each landing strip in Zone I, and within a distance of 6,000 feet from the end of each landing strip in Zone II, no such building structure or object situated in an approach area shall have a height of more than 150 feet.

Airport obstructions. Airport buildings, boundary zones, flood light mountings and other airport appurtenances may be of such height and so located as to constitute obstructions with any turning area other than one adjacent to an approach area for a landing strip used, designed or intended to be used for instrument landing subject to the limitations prescribed in this section. No buildings or structures shall hereafter be erected, altered, reconstructed or used, nor shall any trees or other natural objects be permitted to grow or be maintained within the turning areas of the height of which, above the elevation of the portion of the landing area nearest the said object is more than 1/7 its distance from such landing area or from the nearest boundary of any approach area, whichever distance is shorter; said height to be exclusive of and in addition to the height permitted at the point from or to which the measurement was taken in the approach area or landing area. Where alternate computations within the meaning of this definition can be made, the height shall be determined to be that which is most restrictive; and provided further that no such object or structure within a distance of two miles from any landing area situated within Zone I of the Airport District shall have a height in excess of 150 feet, and no such object or structure within a distance of 6,000 feet from any such landing area situated within Zone II of the Airport District shall have a height in excess of 150 feet.

Airport hazards.

The Board of Appeals, at its discretion, may grant special permits for uses or structures upon the property comprising the Municipal Airport of the County of Chautauqua, or elsewhere, within the Airport District. Any permit granted under the provisions of this section may be so conditioned as to require the owner of the structure or tree to permit the owner or operator of the airport nearest thereto, at its or their own expense, to install, operate and to maintain thereon such markers as may be necessary in the safe operation of the airport.

The regulations prescribed herein relating to Airport District restrictions shall not be construed to require the removal, lowering or other change or alteration of any structure or tree not conforming to such regulations as of the effective date hereof or otherwise interfere with the continuance of any nonconforming use.
