SECTION 1407

BUSINESS, COMMERCIAL AND MIXED USE DISTRICTS

1407.01 Preamble.

Business, Commercial and Mixed Use District regulations are intended to govern the locations and uses of a full range of business and commercial establishments needed to serve the citizens of Elmwood Park and its trade area. The regulations of the various business districts are designed to provide for groupings of business and commercial establishments that are compatible in scope of services and method of operations.

1407.02 Business District Provisions.

A. 
Dwelling Units. Dwelling units are allowed in business districts when authorized pursuant to Section 1411.11 special uses, but are not allowed on the ground floor or below grade. Dwelling units are not allowed as permitted or special uses in the Commercial District. The Mixed Use District is intended to allow both business and residential uses as permitted uses.
B. 
Enclosure of Operations. All business, servicing or processing shall be conducted within completely enclosed buildings except:
1. 
Off-street parking or loading;
2. 
Drive-in type of operations when conducted as a lawful permitted or special use in the B-2 District or C-1 District;
3. 
Open sales lots when operated as a special use in the B-2 District and C-1 District; and
4. 
Outdoor storage accessory to a light manufacturing use in the C-1 District which shall be enclosed by a solid six-foot high fence.
C. 
Performance Standards. All activities shall be conducted in such a manner that there is no emission of dense smoke, particulate matter, radiation, noise, glare, heat, odor and no other potential hazard that will endanger health and safety within the community, or adversely affect the enjoyment of the residential neighborhoods of the Village.
D. 
Parking Limitations.
1. 
Parking of trucks when accessory to the conduct of a permitted use shall be limited to vehicles having not over 1 1/2 tons capacity, except for pick-up or delivery services during normal business hours.
2. 
Trucks in excess of 1 1/2 tons capacity shall not be parked in the open within 150 feet of a residence district boundary line.
E. 
Scope of Operations. All business establishments shall be retail trade or service establishments dealing directly with consumers, and all goods produced on the premises shall be sold on the premises where produced except for specific uses where wholesale sales or processing and fabricating are specified as otherwise permitted in the C-1 District.

1407.04 Special Conditions.

Prior to the authorization for a special use, and the granting of a special use permit, special conditions where identified in Section 1407.03 of this appendix shall be required in addition to compliance with the requirements for satisfactory plans, specifications, public hearings and other conditions which may be required. The following list of special conditions is identified by code numbers corresponding to those which appear in Section 1407.03 of this appendix in connection with specific special uses:

Such special use may be permitted on a lot which is located more than 100 feet from a residence district.

Such special use may be permitted where the owner satisfactorily establishes that there will be no appreciable traffic congestion or hazard to pedestrian safety.

Such special use may be permitted where not more than five persons will be employed on the premises.

Such special use may be permitted above the ground floor.
5
Such special use may be permitted on a lot which is not less than 10,000 square feet in area.
6
Such special use may be permitted provided the total floor area does not exceed 25,000 square feet and provided that specifications verifying conformance to the performance standards are approved by the director of code administration.

Such special use may be permitted only on lots which are not immediately adjacent and contiguous to a residential district or to an established non-conforming residential use. For the purpose of this paragraph, the term "immediately adjacent and contiguous to" shall not include properties separated by a dedicated street or alley.

Such special use may be permitted with a front/corner side yard from zero feet to less than 30 feet, provided the director of code administration determines the required setback, having taken into account factors such as the established setbacks on adjacent lots, and the amount of off street parking to be created by such use.

Such special use may be permitted only for a medical cannabis dispensing organization, which, by December 31, 2019, held a valid registration under the Compassionate Use of Medical Cannabis Pilot Program, and continues to operate with a valid medical cannabis dispensing license at the same location.

Only one such special use for an Adult Use Cannabis Dispensing Organization may be permitted within the Village of Elmwood Park.
11
Consumption of cannabis and cannabis-infused products on the premises shall be prohibited.
