USES

§ 155.125 PERMITTED AND CONDITIONAL USES BY ZONES.

   The table in § 155.126 shows all land uses which are allowed within the city. The following criteria should be used to interpret the use listed in the table.
   (A)   Uses identified with a “P” designation are determined as a “permitted use” and are required to receive approval as a permitted use as identified by the requirements of this subchapter.
   (B)   Uses identified with a “C” designation are determined as a “conditional use” and are required to receive approval as a conditional use as identified by the requirements of this subchapter.
   (C)   Any use which is not specifically designated as a permitted or conditional within any specific zone is prohibited in that zone.
   (D)   All uses must comply with applicable local, state, and federal requirements and licensing and must provide evidence of such compliance before the use is either approved by the city or established within the city.

§ 155.127 ADDITIONAL INFORMATION REGARDING SCHEDULE OF USES.

   The following regulations shall apply to the schedule of uses:
   (A)   (1)   Sale of firearms and alcohol shall not be permitted within 1,000 feet of any school or place of worship.
      (2)   A hotel or motel may have an “on-premises” consumption of alcohol use that does not require more than 7% of the floor space of the hotel or motel. Restaurants with “on-premises” consumption of alcohol use are also permitted by conditional use in certain zones, as per the land use chart. Other than for a hotel/motel or a restaurant, as designated on the Land Use Chart, “on-premises” consumption of alcohol is not available for any other business in any zone.
   (B)   Cannabis.
      (1)   Definitions. In addition to the definitions set forth in UCA §4-41a-102 (Cannabis Production Establishments), and UCA § 26-61a-102 (Utah Medical Cannabis Act), the following definitions apply:
         CANNABIS PRODUCTION ESTABLISHMENT. An establishment defined in UCA § 4-41a-102, and includes a cannabis cultivation facility, a cannabis processing facility, or an independent cannabis testing laboratory.
         MEDICAL CANNABIS PHARMACY. An entity that acquires or intends to acquire, possesses, and sells or intends to sell cannabis in an medicinal dosage form, a cannabis product in a medicinal dosage form, or a medical cannabis device, to a medical cannabis cardholder, as defined under UCA § 26-61a-102.
         PRIMARILY RESIDENTIAL ZONE. For the purposes of this section, and any applicable state law the following zoning districts: A, Rl-40, Rl-20, RD-1, RD-2.
      (2)   Standards.
         (a)   Medical cannabis production establishment. The following standards apply:
            1.   No emission of dust, fumes, vapors, odors, or waste into the environment from any facility involving the growing, processing, or testing of cannabis.
            2.   Each medical cannabis production establishments shall:
               A.   Not be located in a primarily residential zone.
               B.   Meet the municipal code regulations, site development standards, and sign requirements for any main building and accessory building.
               C.   Obtain and comply with all state requirements set forth in accordance with UCA §§ 4-41a-101 et seq.
               D.   Comply with location requirements set forth in UCA § 4-41a-201.
               E.   Obtain and comply with business license regulations.
         (b)   Medical cannabis pharmacy. The following standards apply:
            1.   Not be located in or within 600 feet of a primarily residential zone.
            2.   No cannabis products shall be visible from outside of any structure.
            3.   Meet the municipal code regulations, site development standards, and sign requirements for commercial development.
            4.   Obtain and comply with all state requirements in accordance with UCA §§ 26-61a-101 et seq.
            5.   Comply with location requirements set forth in UCA § 26-61a-301.
         6.   Obtain and comply with business license regulations.
