ARTICLE VI

- PENALTIES AND ENFORCEMENT

Sec. 77-91. - Penalty for violations.

(a)

Any person violating any of the provisions or terms of this chapter shall be subject to the same penalty as provided for in this chapter, and upon conviction shall be punished by a fine not to exceed the sum of $2,000.00 for each offense, and each and every day such violation shall continue shall be deemed to constitute a separate offense.

(b)

In addition to the penalty provided for in subsection (a), the right is hereby conferred and extended upon any property owner owning a property in any district, where such property owner may be affected or invaded by a violation of the terms of the article, to bring suit in such court or courts having jurisdiction thereof and obtain such remedies as may be available at law and equity in the protection of the rights of such property owner.

Sec. 77-92. - Preserving rights in pending litigation and violations under existing ordinances.

By the passage of the ordinance from which this chapter is derived, no presently illegal use shall be deemed to have been legalized unless such use falls specifically within a use district where the actual use is a conforming use where recognized, or an illegal use, as the case may be. It is further the intent and declared purpose of this chapter that no offense committed, and no liability, penalty or forfeiture, either civil or criminal, incurred prior to the time the zoning ordinance, as codified in this chapter, was adopted, shall be discharged or affected.

Sec. 77-93. - Severability.

It is the intention of the city council that this chapter and every provision thereof shall be considered severable and the validity or partial invalidity of any section, clause, or provision of this chapter shall not affect the validity of any other portion of this chapter.

Sec. 77-94. - Effective date.

The ordinance from which this chapter is derived shall become effective on the 8 th day of May 2018, after publication of the caption, as the law in such cases provides.
