Districts Established; Zoning Map
§ 171-8 Classes of districts and schedules of regulations.

The Village of Fishkill is hereby divided into the following classes of districts:
R-10 | One-Family Residence |
R-7.5 | One- or Two-Family Residence |
R-50 | Three-or-More-Family Residence |
VC-BD | Village Center Business District |
PB | Planned Business |
GB-1 | General Business-1 |
GB-2 | General Business-2 |
PI | Planned Industry |
LC | Land Conservation |
The Village hereby adopts the "Schedule of Uses for Nonresidential Districts" attached hereto as Schedule C, and "Schedule of Uses for Residential Districts" attached hereto as Schedule D, as part of this section. Said Schedules of Uses, with all the explanatory matter thereon, are hereby made a part of this chapter.[1]

Said Schedules of Regulations, with all explanatory matter thereon, are hereby made a part of this chapter.[2]

§ 171-9 Zoning Map.
[Amended 10-19-2009 by L.L. No. 32-2009]
Said districts are bounded and defined as shown on the map entitled "Village of Fishkill Zoning District Map with Historic Preservation Overlay Zone," which map, with all explanatory matter thereon, is hereby made a part of this chapter.[1] The parcels set forth below are moved from the previously designated districts to the newly created districts. The listed parcels are hereby re-zoned to the class of zoning district hereinafter designated.[2]
§ 171-10 Interpretation of district boundaries.
Where uncertainty exists as to the locations of any boundaries shown on the Zoning Map, the following rules shall apply:
District boundary lines are intended to follow streets, rights-of-way, watercourses or lot lines, or be parallel or perpendicular thereto, unless such district boundary lines are fixed by dimensions as shown on the Zoning Map.
Where district boundaries are indicated as approximately following streets, rights-of-way or watercourses, the center lines thereof shall be construed to be such boundaries.
Where district boundaries are so indicated that they approximately follow Village boundary lines, they shall be construed to be coincident with such Village boundary lines.
If, after use of the above rules and the map, the district classification of any land is in question, it shall be deemed to be in the most restrictive of the adjoining district.
§ 171-11 Lots in two or more districts.
General. Where a lot in one ownership of record is divided by one or more district boundary lines, each of said divisions of the lot shall be subject to the regulations of the district in which it is located.
Extension of use. Notwithstanding the above, where the boundary of a zoning district divides a lot within municipal boundary lines, the existence of which lot is evidenced by deed or deeds recorded in the office of the Dutchess County Clerk on the effective date of this chapter or on the effective date of any amendment of this chapter establishing such boundary, the Planning Board may grant a special use permit to authorize a use of land, buildings and other structures permitted in one district to be extended into the other district for a distance of not more than 30 feet in accordance with the provisions of Article VII.
