For the purpose of this Chapter, the following terms, phrases, words and their derivations shall have the meaning given herein.
ACCESSORY USES AND BUILDINGSBuildings and structures which are clearly incidental to and customarily and commonly associated with the main permitted use of the premises. Such accessory buildings and uses shall not be so constructed, maintained and conducted as to produce noise, vibration, concussion, dust, dirt, fly ash, odor, noxious gases, heat or glare which is injurious, damaging or unhealthful to adjacent property or the uses thereof and shall be on the premises of the main use. Each accessory building requires a building permit.
ADULT DAY CAREA group program designed to provide care and supervision to meet the needs of functional impaired adults for periods of less than twenty-four (24) hours but more than two (2) hours per day in a place other than the adult's own home but such facilities shall not be allowed in a "Shopping Center."
ADULT DAY HEALTH CAREA program of organized therapeutic, rehabilitative and social activities provided outside the home for a period of less than twenty-four (24) hours to persons with functional impairments of at least an intermediate care facility (ICF) level of care. For the purpose of this definition "adult", means a person eighteen (18) years of age or older.
ADULT ENTERTAINMENTAny business or establishment which offers its patrons services or entertainment such as books, videos, periodicals and the like characterized by an emphasis on matter depicting, describing or relating to sexual activities or specified anatomical areas.
ALLEYAny public space or thoroughfare twenty (20) feet or less in width but not less than ten (10) feet in width which has been dedicated or deeded to the public for public travel and which affords secondary access to abutting property.
ALTERATIONAny change or modification to the exterior of a building, site, structure or object that requires a Building Permit or any change or modification to an exterior architectural feature as identified by the Landmark and Historic District Commission ("LHDC") at the time of the nomination and designation by the City Council. Alteration does not include repair nor does it include landscape maintenance.
ALTEREDAs applied to a building or structure, a change or rearrangement in the structural parts or in the exit facilities or an enlargement, whether by extending on a side or by increasing in height, or the moving from one location or position to another.
ALTERNATIVE NICOTINE PRODUCTAny non-combustible product containing nicotine that is intended for human consumption, whether chewed, absorbed, dissolved, or ingested by any other means. "Alternative nicotine product" does not include any vapor product, tobacco product or any product regulated as a drug or device by the United States Food and Drug Administration under Chapter
V of the Food, Drug and Cosmetic Act.
ANATOMICAL AREAS, SPECIFIEDLess than completely or opaquely covered:
1. Human genitals or pubic regions.
3. Female breasts below a point immediately above the top of the areola.
ANTENNAAny device that transmits and/or receives electromagnetic signals for voice, data or video communications purposes including, but not limited to, television, AM/FM radio, microwave, cellular telephone and similar forms of communications. The term shall exclude satellite earth station antennae less than six (6) feet in diameter, any receive-only home television antennae, ground-mounted antennas and antennas constructed primarily of wire and used for non-commercial purposes.
ANTENNA EQUIPMENT CABINETA structure for the protection and security of communications equipment associated with one (1) or more antennae where direct access to equipment is provided from the exterior and that has horizontal dimensions that do not exceed four (4) feet by six (6) feet and vertical height that does not exceed six (6) feet.
ANTENNA EQUIPMENT SHELTERA building for the protection and security of communications equipment associated with one (1) or more antennae and where access to equipment is gained from the interior of the building. Human occupancy for office or other uses or the storage of other materials and equipment not in direct support of the connected antenna is prohibited.
ANTENNA SUPPORT STRUCTUREA tower or disguised support structure but excluding those support structures under eighty (80) feet in height owned and operated by an amateur radio operator licensed by the FCC.
AREA, BUILDINGThe aggregate of the maximum horizontal cross section area of the main building on a lot, excluding cornices, eaves, gutters or chimneys projecting not more than two (2) feet, steps, one-story open porches, balconies and terraces measuring from outer side of wall.
AUTO SERVICE GARAGEA place where repairs, rental, washing, servicing, greasing, adjusting or equipping of automobiles or other motor vehicles may be performed but not including painting, body work and major repairs.
BANKAn institution that trades in money; an establishment for the deposit, custody and issuance of money and also for making loans and discounts and facilitating the transmission of remittances from one place to another. Credit unions and savings and loans shall also be classified as a bank, but "check cashing establishments", "short-term loan establishments" and "pawnshops" are not classified as a bank.
BANQUET CENTERA special purpose room, dining room, or a building used for hosting large social and business events, with a full kitchen where food is served.
BARBER, BEAUTY OR COSMETOLOGY SCHOOLA facility who holds themselves out as providing educational services, duly licensed by the Missouri State Board of Cosmetology and Barber Examiners for a barber school, cosmetology school or crossover school.
BASEMENTA story partly underground and having more than one-half (½) of its height below the ground. A basement shall be counted as a story if subdivided and used for dwelling or business purposes. Rathskeller or playrooms are not dwelling purposes.
BED AND BREAKFASTA use within an occupied single-family dwelling wherein rooms are rented and meals are served to overnight guests for commercial purposes, as distinguished from a hotel or motel.
BREWPUBSA microbrewery that brews beer for both on and off-premise sale and consumption with an annual production of ten thousand (10,000) barrels or less.
BUILDINGA structure having a roof supported by columns or walls and when separated by a division wall without openings, each portion of such building shall be deemed a separate building except as provided in this Chapter.
BUILDING, HEIGHT OFThe vertical distance measured from the curb level to the highest point of the roof surface, if a flat roof; to the deck line of mansard roofs; and to the mean height level between eaves and ridges for gable, hip and gambrel roofs. For buildings set back from the street line, the height of the building may be measured from the average elevation of the finished grade along the front of the building.
BUILDING LINEA line parallel to and equidistant from the street between which line and street no building or structure may be erected.
BUSINESS, PROFESSIONAL OFFICE OR ADMINISTRATIVE OFFICEAny building or part of a building in which one (1) or more persons are employed in the management, direction or conducting of an agency, business or brokerage, labor or fraternal organization and shall exclude such uses as retail sale, manufacture, assembly or storage of goods, places of assembly and amusement, tattooing establishment, check-cashing establishment or consumer installment loan establishment.
CALIPERA measurement of the tree trunk diameter measured at two and one-half (2½) feet above grade level.
CERTIFICATE OF APPROPRIATENESSA certificate issued by the Landmark and Historic District Commission ("LHDC") indicating its approval of plans for alteration, off-site relocation or demolition of a landmark or of a Historic District contributing resource.
CERTIFICATE OF ECONOMIC HARDSHIPA certificate issued by the Landmark and Historic District Commission ("LHDC") authorizing demolition, even though a certificate of appropriateness has previously been denied.
CHECK-CASHING ESTABLISHMENTA business engaged in check-cashing operations for a fee as a primary or substantial element of its business and which is not licensed by the appropriate State or Federal agency as a banking or savings and loan facility.
CHILD DAY CARE CENTERA facility, other than the provider's permanent residence or separate from the provider's living quarters, where any person advertises or holds themselves out as providing care for more than four (4) children for any part of the twenty-four (24) hour day, for compensation or otherwise, except those operated by a school system or in connection with a business establishment as a convenience for its customers or for its employees. But such facilities shall not be allowed in a "shopping center".
CHILD DAY CARE HOMEA family home, occupied as a permanent residence by the day care provider, in which family-like care is given for more than four (4) children but no more than ten (10) children, not related to the day care provider, for any part of the twenty-four (24) hour day.
CIGAR BARA business with a permit to sell alcoholic beverages that generates twenty-five percent (25%) or more of its quarterly gross revenue from the sale of cigars and/or rental of humidor space, has a humidor on the premises and does not allow minors to enter the premises.
CLUBA building or portion thereof on premises owned or operated by a corporation, association, person or persons for a social, educational or recreational purpose, but not primarily for profit or to render a service which is customarily carried on as a business.
COMMISSIONPlanning and Zoning Commission of the City of Florissant, Missouri.
COMMISSIONERThe Commissioner shall mean the Building Commissioner of the City of Florissant, Missouri or designated representative.
CONSTRUCTIONThe act of adding an addition to an existing structure or the erection of a new principal or accessory structure on a lot or property.
CONSUMER LOAN COMPANYA company that is primarily or substantially in the business of making loans secured or unsecured and are authorized under Chapter
367, RSMo., sometimes also referred to as "traditional installment loan lenders," as authorized under Chapter
408, RSMo. A consumer loan company shall not include companies sometimes referred to as "pay day loan companies" or "title loan companies."
CONTINUING CARE RETIREMENT FACILITYA building or complex of buildings that provides elderly housing, catered living and/or assisted living dwelling units, skilled and intermediate care nursing units and accessory services for residents of the facility; and programs, outpatient care and rehabilitation services provided by the facility to the general public.
CONVENIENCE STOREA retail establishment having a gross floor area of five thousand (5,000) square feet or less, primarily selling foods as well as other household goods customarily sold in larger food markets and supermarkets.
COSMETIC MICROPIGMENTATIONA method of adding, replacing or augmenting cosmetic features by the placement of subcutaneous pigmentation by a licensed doctor or nurse.
COURTAn open space which may or may not have direct street access and around which is arranged a single building or a group of related buildings.
COVER CHARGEAn entrance fee sometimes charged at bars, nightclubs, or restaurants.
CRAFT ROOMA facility who holds themselves out as providing a space for craft activities associated with learning techniques.
CURB LEVELThe level of the established curb in front of the building measured at the center of such front. Where no curb has been established, the Director of Public Works shall establish such curb level or its equivalent for the purpose of this Chapter.
DANCE STUDIOIs a space in which dancers learn or rehearse, excludes pole dancing.
DEMOLITIONAny act or process which destroys, in part or in whole, a landmark or a Historic District contributing resource or threatens to destroy a landmark or a Historic District contributing resource by failure to maintain it in a condition of good repair and maintenance.
DESIGN GUIDELINEA standard of appropriate activity that will preserve the historic, architectural, scenic or aesthetic character of landmarks, Historic District contributing resources and Historic Districts.
DIRECTORThe Director of Public Works or his/her designee.
DISGUISED SUPPORT STRUCTUREAny freestanding manmade structure designed for the support of communications antennas, the presence of which is camouflaged or concealed from ordinary view as an appropriately placed architectural or natural feature. Such structures may include, but are not limited to, clock towers, campaniles, bell towers, church steeples, observation towers, signs, light standards and artificial trees of designs and types as approved by the Building Commissioner.
DISTRICTAny section of the City of Florissant within which the zoning regulations are uniform.
DUPLEX DWELLINGA detached or semi-detached building designed for or occupied exclusively by two (2) families living independently of each other.
DWELLINGAny building, or portion thereof, which is designed or used exclusively for dwelling purposes.
DWELLING, MULTIPLEA building or portion thereof used or designed as a residence for three (3) or more families living independently of each other and doing their own cooking in said building, including apartments, apartment hotels and group houses.
DWELLING UNITOne (1) or more rooms physically arranged so as to create an independent housekeeping establishment for occupancy by one (1) family with at least one (1) separate bathroom and facilities for cooking and sleeping.
EDUCATIONAL DEVELOPMENT CENTERA facility who holds themselves out as providing educational services, pre- or after-school programs, summer educational camps, and having obtained a written determination from the State Division of Health and Senior Services that it is not a child day care center, or having obtained partial funding from the State Department of Education and Secondary Education to provide such services. But such facilities shall not be allowed in a shopping center.
ERECTTo build, construct, attach, hang, place, suspend or affix.
ESTATE SALEThe sale of goods or products that are part of an estate and such sale shall take place on the premises subject to the estate.
ESTHETICIANA State-licensed skin care professional who has been trained through apprenticeships or formal esthetics programs to perform treatments that promote skin health and beauty. These include facials, superficial chemical peels, body treatments, and waxing.
EXTERIOR ARCHITECTURAL APPEARANCEThe architectural character and general composition of the exterior of a structure including, but not limited to, the kind, color and texture of the building material and the type, design and character of all windows, doors, light fixtures, signs and appurtenant elements.
FAAThe Federal Aviation Administration.
FAMILY1. An individual living as a single non-profit, housekeeping unit in a dwelling unit; or
2. Two (2) individuals or married couple and the children thereof, including adopted children, foster children and grandchildren, and no more than two (2) other persons related to the individuals or married couple by blood or marriage and no more than two (2) other individuals; or
3. A group of not more than four (4) persons not related by blood or marriage and not living as a group home but living together as a single housekeeping unit in a dwelling unit as distinguished from a boarding house; or
4. A group of nine (9) or fewer unrelated mentally or physically handicapped persons (group home), excluding supervisory persons acting as house parents or guardians, who need not be related to each other or to any of the mentally or physically handicapped individuals residing in a dwelling unit as distinguished from a boarding house.
FCCThe Federal Communications Commission.
FENCEA structure, partition or wall erected for the purpose of enclosing a piece of land or to separate two (2) contiguous pieces of land. Shrubs, hedges, trees or an ornamental divider consisting of posts no higher than thirty (30) inches from the ground level, spaced no closer than four (4) feet from each other and connected by not more than two (2) strands or rails, having a minimum nominal dimension of three-quarters (¾) inch, located along a private walkway or driveway and not used to enclose an area shall not be considered a fence.
FILLING STATIONAny building, structure or land used for the dispensing, sale or offering for sale at retail of any automobile fuels, oils, including accessories, lubrication of automobiles and replacement or installation of minor parts and accessories, but not including major repair work such as motor replacement, body and fender repair or spray painting.
FITNESS CENTERAn establishment where space, equipment or instruction is provided for activities related to physical well-being such as dance, martial arts, yoga, and other forms of physical exercise and does not include a recreational facility, excludes pole dancing.
FLOOR AREAThe square feet of floor space within the outside line of walls and includes the total of all space on all floors of a building. It does not include porches, garages or space in a basement or cellar when said basement or cellar space is used for storage or incidental uses.
FLORISSANT HISTORIC REGISTERThe list of officially designated Landmarks, Historic District Contributing Resources and Historic Districts within the City of Florissant.
FRONTAGEThat portion of a lot, parcel or tract of land adjacent to or abutting a street.
FRONTAGE, REVERSEDA corner lot with a rear lot line adjacent to the side lot line of the abutting lot.
GARAGE, PRIVATEA building or part thereof accessory to a main building and providing for the storage of automobiles and in which no occupation or business for profit is carried on.
GARAGE, PUBLICA building, other than a private or storage garage, used for the care, repair or equipment of self-propelled vehicles or where such vehicles are kept for remuneration or hire.
GARAGE, PUBLIC STORAGEA building or part thereof, other than a private garage, for the storage of motor vehicles and in which service activities may be carried on only by special permit for filling station.
GROUP HOMEAny dwelling in which nine (9) or fewer unrelated mentally or physically handicapped persons reside, excluding supervisory persons acting as house parents or guardians, who need not be related to each other or to any of the mentally or physically handicapped persons residing in the dwelling unit.
HEIGHT, TOWERThe vertical distance measured from the base of the structure to its highest point and including the main structure and all attachments thereto.
HISTORIC DISTRICTAn area designated as a "Historic District" by ordinance of the City Council which may include individual Landmarks, as well as other properties or structures, referred to as Historic District Contributing Resources which, while not of such historic and/or architectural significance to be designated as Landmarks, nevertheless contribute to the overall visual characteristics and historical significance of the Historic District.
HISTORIC DISTRICT CONTRIBUTING RESOURCEA building, site, structure or object within the boundaries of a Historic District that adds to the historic, architectural, cultural or archeological values for which the district is considered significant but does not qualify as a Landmark.
HISTORIC SIGNIFICANCECharacter, interest or value as part of the development, heritage or culture of the community, County, State or country; as the location of an important local, County, State or national event; or through identification with a person or persons who made an important contribution to the development of the community, County, State or country.
HOME OCCUPATIONAn occupation or activity carried on by no more than two (2) members of a family residing on the premises, including home work activities carried on under the supervision of the State vocational rehabilitation agency or pursuant to license issued by the State Department of Labor, but excluding beauty shops, barbershops, music schools, convalescent or nursing homes, tourist homes, massage or other establishment offering services to the general public and providing that there are no signs or any display that will indicate from the exterior of the building that it is being utilized for any purpose other than that of a dwelling, providing further, that there is no stock-in-trade or commodity sold upon the premises, no person is employed other than a member of the family residing on the premises, except as to the said home work activities hereinabove authorized, no mechanical equipment is used in the conduct of the activity or is stored on the premises except such as is customary for purely domestic or household purposes and, provided further, that not over twenty percent (20%) of the total actual floor area of the improvements, exclusive of the basement, is used for the conduct of such home occupation and except for the storage of equipment for home operated lawn care businesses provided that there is no more than one (1) properly licensed trailer stored on the property, which shall be kept clean and that all equipment pertaining to the lawn care business must be stored in the trailer that shall not be larger than six (6) feet by sixteen (16) feet and the equipment stored on the trailer shall not exceed six (6) feet in height and the trailer shall be parked in an enclosed area or shall be covered and parked behind the front of the property line on an improved surface of asphalt or concrete.
HOTELA building in which lodging is provided and offered to the public for compensation and in which ingress and egress to and from rooms is made through an inside lobby or office supervised by a person in charge at all hours and which is open to transient guests, as distinguished from a motel or bed and breakfast.
INSTALLMENT LOAN LENDERS A company that is licensed under Sections
367.100 to
367.200, RSMo., or Section
408.510, RSMo., whose direct consumer loans are limited only to traditional installment loans as defined in Section
408.512, RSMo. An installment loan lender is also referred to as a "consumer loan company" but shall not include companies referred to as "pay day loan companies" or "title loan companies."
INSTITUTIONA building occupied by a non-profit corporation or a non-profit establishment for public use.
INTERNET CAFÉA simple cafe in which customers pay to use computers to access the Internet.
JUNK YARDThe use of an open space for the wrecking, dismantling or storage of worn-out or wrecked automobiles or machinery or other worn-out, cast-off, discarded or scrap material which is ready for destruction or has been collected or stored for salvage purposes or conversion to some use.
LANDMARKAny property, site or structure designated as a "landmark" by ordinance of the City Council pursuant to the procedures described herein.
LHDCThe Landmark and Historic District Commission.
LIVE STREAMING STUDIOA facility for broadcasting real-time video or audio content over the internet, does not include adult entertainment.
LOADING SPACEAn off-street space or berth on the same lot with a building, or contiguous to a group of buildings, for the temporary parking of a commercial vehicle while loading or unloading merchandise or materials and which abuts upon a street, alley or other appropriate means of access and having a minimum dimension of twelve (12) feet by thirty-five (35) feet and a vertical clearance of at least fourteen (14) feet.
LOTA parcel of land occupied or capable of being occupied by one (1) building and the accessory buildings or uses customarily incident to it, including such open spaces as are required by this Chapter and having its principal frontage upon a street or court.
LOT, CORNERA lot at the point of intersection of and abutting on two (2) or more intersecting streets, the angle of intersection being not more than one hundred thirty-five degrees (135°).
LOT, DEPTH OFThe minimum horizontal distance between the front and rear lot lines.
LOT, DOUBLE FRONTAGEA lot having a frontage on two (2) non-intersecting streets, as distinguished from a corner lot.
LOT OF RECORDA lot which is a part of a subdivision, the map of which has been recorded in the office of the County Recorder of Deeds of St. Louis County, or a lot described by metes and bounds, the description of which has been recorded in the office of the County Recorder of Deeds of St. Louis County.
MAJOR STREETA street of substantial continuity which serves or is intended to serve fast or large volumes of traffic and is indicated as a major street in the City Comprehensive Plan.
MARIJUANA or MARIHUANACannabis indica, Cannabis sativa, and Cannabis ruderalis, hybrids of such species, and any other strains commonly understood within the scientific community to constitute marijuana, as well as resin extracted from the plant and marijuana-infused products. "Marijuana" or "Marihuana" do not include industrial hemp containing a crop-wide average tetrahydrocannabinol concentration that does not exceed three-tenths of one percent (3/10 of 1%) on a dry weight basis, or commodities or products manufactured from industrial hemp.
MARIJUANA CULTIVATION FACILITYA facility licensed by the State of Missouri to acquire, cultivate, process, store, transport, and sell marijuana to a Marijuana Dispensary Facility, Marijuana Testing Facility, or to a Marijuana-Infused Products Manufacturing Facility.
MARIJUANA DISPENSARY FACILITYA facility licensed by the State of Missouri to acquire, store, sell, transport, and deliver marijuana, marijuana-infused products and drug paraphernalia used to administer marijuana in accordance with applicable law and regulations.
MARIJUANA-INFUSED PRODUCTSProducts that are infused with marijuana or an extract thereof and are intended for use or consumption other than by smoking, including, but not limited to, edible products, ointments, tinctures and concentrates.
MARIJUANA-INFUSED PRODUCTS MANUFACTURING FACILITYA facility licensed by the State of Missouri, to acquire, store, manufacture, transport, and sell marijuana-infused products to a Marijuana Dispensary Facility, a Marijuana Test Facility, or to another Marijuana-Infused Projects Manufacturing Facility.
MARIJUANA MIRCO-DISPENSARY FACILITYA facility licensed by the State of Missouri to acquire, process, package, store on-site or off-site, sell transport to or from, and deliver marijuana, marijuana seeds, marijuana vegetative cuttings (also known as clones), marijuana-infused products, and drug paraphernalia used to administer marijuana as provided for in this Section to a consumer, qualifying patient, or primary caregiver, as defined in Article
XIV of the Missouri Constitution, anywhere on the licensed property or to any address as directed by the consumer, qualifying patient, or primary caregiver, and consistent with the limitations of Article
XIV of the Missouri Constitution and as otherwise allowed by law, a microbusiness wholesale facility or a marijuana testing facility. Microbusiness dispensary facilities may receive transaction orders at the dispensary directly from the consumer in person, by phone, or via the internet, including from a third party. A microbusiness dispensary facility's authority to process marijuana shall include the creation of pre-rolls.
MASONRYExposed face brick or natural building stone which is used as a facing component which is applied over exterior wall back-up construction. Exposed masonry construction shall not include hollow masonry units, concrete masonry units, glass blocks, plastic and/or composite blocks, metal panels, plastic panels, plaster exterior insulation-finish system, precast concrete panels or any composition and all cast-in-place concrete walls, tilt-up concrete panels.
MASSAGE PARLORAny establishment operating in conformity with the Florissant Code in which, for any form of payment or consideration, a massage, alcohol rub, electric or magnetic treatment or similar treatment or manipulation of the human body is administered except when such treatment or manipulation is administered by a medical practitioner, chiropractor, acupuncturist, physical therapist or similar person licensed by the State or as a service provided by a medical facility, athletic club, health club, reducing salon or similar establishment where massage or a similar manipulation of the human body is offered as an incidental or accessory service.
MECHANICAL OR ELECTRONIC AMUSEMENT DEVICEAny machine, table device or game which, upon the insertion of a coin, debit or credit card, swipe card, slug, token, plate, disc, or any other form of currency, permits a person or operator to use the device as a game, or contest of skill, chance, luck or amusement, whether or not registering a score, which may cause a person or operator of the same to secure some amusement, enjoyment or entertainment, and which is not a gambling device licensed by either the Missouri Gaming Commission or the Missouri State Lottery Commission. It, shall include, but not be limited to, such devices as electronic or mechanical game machines, video game machines, pinball machines, skill ball, bowling machines or any other mechanical or electronic games or operations similar thereto under whatever name they may be indicated.
MEDICAL MARIJUANA CULTIVATION FACILITYA facility licensed by the State of Missouri to acquire, cultivate, process, store, transport, and sell marijuana to a Medical Marijuana Dispensary Facility, Medical Marijuana Testing Facility, or to a Medical-Infused Products Manufacturing Facility.
MEDICAL MARIJUANA DISPENSARY FACILITYA facility licensed by the State of Missouri to acquire, store, sell, transport, and deliver marijuana, marijuana-infused products and drug paraphernalia used to administer marijuana in accordance with applicable law and regulations.
MEDICAL MARIJUANA-INFUSED PRODUCTS MANUFACTURING FACILITYA facility licensed by the State of Missouri, to acquire, store, manufacture, transport, and sell marijuana-infused products to a Medical Marijuana Dispensary Facility, a Medical Marijuana Test Facility, or to another Medical Marijuana-Infused Projects Manufacturing Facility.

OFF-SITE RELOCATIONAny relocation of a structure, object or artifact, in whole or in part, from its current site or to another site.
OLD TOWNAn area generally bounded by Castello, St. Marie, St. Michael Streets including both sides of the street and Coldwater Creek.
OLD TOWN DEVELOPMENT PLAN AND GUIDELINESA set of guidelines as adopted herewith and as may be hereafter amended, which guidelines are applicable to and are designated as the standards regulating the exterior design of buildings within those portions of Old Town that are within "H" Historic Districts. The term shall also not include any support structure under eighty (80) feet in height owned and operated by an amateur radio operator licensed by the Federal Communications Commission.

USED CAR SALES AREAAn open area, other than a street, alley, or place, used for the display and sale of used automobiles and where no repair work is done except the necessary reconditioning of the cars to be displayed and sold on the premises, but such area shall not be allowed in a "Shopping Center."
VAPOR PRODUCTAny non-combustible product containing nicotine that employs a heating element, power source, electronic circuit or other electronic, chemical or mechanical means, regardless of shape or size, that can be used to produce vapor from nicotine in a solution or other form. "Vapor product" includes any electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe or similar product or device and any vapor cartridge or other container of nicotine in a solution or other form that is intended to be used with or in an electronic cigarette, electronic cigar, electronic cigarillo, electronic pipe or similar product or device. "Vapor product" does not include an alternative nicotine product or tobacco product.
