CHAPTER 156

COMPREHENSIVE FEE SCHEDULE

§ 156.01 SHORT TITLE.

   This chapter shall be known as the Comprehensive Fee Schedule.

§ 156.02 SCOPE.

   It is the intent of this chapter to consolidate all fees associated with the various chapters of this code of ordinances into a comprehensive schedule for the convenience of the public. The fees in this chapter shall be considered as superseding any conflicting fees listed in other chapters of this code of ordinances. Fees appearing in other chapters but not yet consolidated into this chapter shall apply as if a part of this chapter.

§ 156.03 GENERAL PROVISIONS.

   (A)   Payment of fees. No permit, certificate, license or approval shall be issued until the fees hereinafter prescribed shall have been paid. When there is a processing fee as required by division (B) hereof, the balance of the permit fee shall be paid before the issuance of the permit and shall be equal to the difference between the total permit fee and the processing fee. A receipt shall be rendered to the person making a fee payment, which receipt shall indicate the amount paid and the purpose of the fee.
   (B)   Processing fee. No application for a building permit shall be accepted for filing unless the applicant shall, at the time of filing, pay a processing fee in accordance with § 156.09. Processing fees shall become a part of the permit fee and any other fee which may accrue thereafter; and no portion of such processing fee shall be refunded, except as provided in this chapter.
   (C)   Renewal fee. The fee for the renewal of a permit shall be one-half of the original permit fee; provided, however, that the minimum fee for any renewal shall be the sum of $25 and the maximum fee for any renewal shall be the sum of $200.
   (D)   Record and deposit of fees. Records shall be kept by the Director of Community Development of all fees received. Such records shall show the date of receipt, the name of the person making payment, and the purpose for which such fees have been paid. All fees thus received shall be deposited with the City Treasurer to the credit of the general fund.
   (E)   Refund of permit fees:
      (1)   Refund of permit fees may be authorized if applied for within one year from the date of issuance of the permit if:
         (a)   The permit has expired by time limitation;
         (b)   The project is abandoned; or
         (c)   There is a major change in the project (different type of building, different model, change of occupancy and the like).
      (2)   Refund shall be at the discretion of the Director of Community Development and, if granted, shall be in the amount of one- half of the permit fee, less $15. No refunds shall be granted where the permit fee is $30 or less and, no refund of a building permit processing fee shall be granted.
      (3)   Claims for return of refundable permit fees, bonds, and deposits shall be by written requests on forms provided by the city.
   (F)   Unclaimed fees. Unclaimed permit fees, bonds, and deposits. Unclaimed permit fees, bonds, and deposits remaining on the books of the city for more than one year after issuance of the same shall be returned to the general fund of the city, and thereafter no refund shall be made. Extensions may be requested in advance of the expiration date if the work is not completed.
   (G)   Inspection fee. The inspection fee for services of the city inspection personnel pertaining to the inspection of streets and the public right-of-way, not specifically provided for in other ordinances, shall be at the rate of $40 per hour. The developer or person requesting an inspection shall pay the inspection fee, in addition to all other permits or fees paid or to be paid in connection with that development.
   (H)   Public hearing fees. Fees for procedures involving public hearings include the cost of up to maximum of two signs to be provided and installed by the city (when required by the code) and notices to a maximum of 25 adjacent property owners (when required by the code). Fees for signs or notices not included in the application fee will be assessed at the time of application at the rate of $20 per sign and $.50 per notice. The additional fee for notice is based on the notices being sent by regular mail. Certified or other more costly methods will be assessed at correspondingly higher rates.

§ 156.04 SIGN CODE FEES.

   The following schedule shall apply to all signs under the jurisdiction of Chapter 90 (sign code) of the city code of ordinances.
   (A)   Temporary sign: $10.00.
   (B)   Special signs: $100.00 on all signs requiring action by the Planning Commission. (This fee is in addition to the sign permit fee charged per § 156.09(B).)
   (C)   Exempt signs, no fee charged.
   (D)   All other signs: Fee based on cost of sign and installation per fee schedule, § 156.09(B).
   (E)   Variance $300.00.

§ 156.05 FIRE CODE FEES.

   The following schedule shall apply to all fees under the jurisdiction of Chapter 95 (Fire Code) of the city code of ordinances.
   (A)   Administrative fees.
      (1)   License inspections (foster care): $30.00.
      (2)   Certificate of Fire Code Compliance (with inspection): $35.00.
         (a)   Permit fees shall provide for customary inspection only. The first two inspections shall be part of the permit fee. The fee for the third and any subsequent inspection(s) thereafter shall be doubled.
         (b)   The Fire Chief may authorize inspection after normal working hours or on weekends upon request. The fees for such inspections shall be at the rate of $60.00 per hour with a minimum of one hour.
      (3)   Reports and copies.
         (a)   B/W single page copies: $0.10.
         (b)   Color single page copies: $0.20.
         (c)   Compilations of reports or documents: $3.00.
      (4)   Hydrant use.
         (a)   Hydrant permit: $50.00.
         (b)   Hydrant bond: $100.00.
   (B)   Construction permits, OFC 105.7.
      (1)   Automatic fire extinguishing systems (sprinkler system), OFC 105.7.1.
         (a)   Processing fee: $35.00 plus a permit fee of $.01 per square foot with a minimum fee of $25.00.
      (2)   Underground fire lines: $50.00.
      (3)   Compressed gases, OFC 105.7.3.
         (a)   All systems or alterations to the system or storage: $20.00.
      (4)   Fire alarm/supervision systems, OFC 105.7.5.
         (a)   Processing fee: $35.00 plus a permit fee of $.01 with a minimum fee of $25.00.
      (5)   Standpipe systems, OFC 105.7.13.
         (a)   Permit fee: $150.00.
         (b)   Inspection fee: $50.00 per floor.

         (b)   Temporary above ground storage in approved portable tanks - maximum 660 gallons.
            1.   Initial installation and for first 90 days at a single location: $50.00 for each tank.
            2.   For each additional 30-day period thereafter: $25.00.
         (c)   Flammable and combustible liquid dispensing devices or remote pumps:
            1.   New installation in conjunction with tanks, applicable tank fees plus $50.00 for each dispenser or remote pump for attendance or self-service.
            2.   To repair or replace existing dispenser or remote pump (each site), $25.00.
            3.   To convert existing dispensers or remote pumps to self service (each site), permit fee $50.00 per dispenser.
NOTE: All flammable and combustible liquid fees are cumulative with other applicable fees covered under other schedules.

§ 156.06 BUSINESS REGULATIONS.

   The following schedule shall apply to all fees under the jurisdiction of Chapter 110 (Business Regulations) of the city code of ordinances.
   (A)   Bowling lanes, pool or billiard tables. Each proprietor of a bowling alley, pool or billiard table for the use of public playing in the city shall pay a license fee of $25 per annum for one alley and $25 per annum for one table; and $10 for each additional alley and $10 per annum for each additional table.
   (B)   Carnival licenses. The fee for the license shall be $50 for the first day and $25 for each additional day or part of a day that the carnival shall operate.
   (C)   Pinball and amusement machines. Every exhibitor shall pay an annual license fee of $100 which may be prorated on a quarterly basis for each pinball machine or amusement machine maintained, possessed, operated, displayed, or exhibited in the city, in which the exhibitor has any interest or over which the exhibitor exercises or has the authority to exercise any control whatsoever.
   (D)   Fees for public picnics; public amusements. For each day that such picnic, outing, or entertainment is to be held, a fee of $5.00 shall accompany the application for such period. In addition to the permit fee, an additional sum shall be paid as required for the cost of detailing police officer(s) to preserve the peace and good order at such public picnic, public outing, public or other organized events that are open to the public. The event holder shall pay off-duty police officers directly. Should on-duty police officers be required, the event holder shall reimburse the city the expense it incurs for the assignment of such officers. All police officers detailed to the event shall comply with the Forest Park Police Department rules and regulations. This section shall not apply to any public picnic, public outing, and public entertainment given for the sole benefit of or for city.
   (E)   Commercial solicitors permit fee. Twenty-five dollars if valid between 91 days and one year; or $10 if valid for 90 days or less.
   (F)   Public vehicle license fees. No such public vehicle shall be operated unless a license has been issued to the owner thereof and is in force. Each such license shall expire on December 31 for the year in which it is issued. In the event a license is issued after October 1 of any year, the fee shall be 1/4; on or after July 1, ½; and on or after April 1, 3/4 of the annual fee. The license fees for each such public vehicle shall be as follows:
      (1)   Taxicab, $20.00 per annum, provided however a taxicab company may be issued a license for any number of taxicabs owned or operated by it and duly listed and identified on its application as hereinafter provided for the sum of $20.00 per annum.
      (2)   Auto for hire, $15.00 per annum.
      (3)   Driverless auto for hire, $10.00 per annum.

§ 156.07 ZONING CODE FEES.

   The following schedule shall apply to all fees under the jurisdiction of Chapter 150 of the zoning code of the city code of ordinances.

§ 156.08 SUBDIVISION RULES AND REGULATIONS FEES.

   (A)   The following schedule shall apply to all fees under the jurisdiction of Chapter 151 (subdivision rules and regulations) of the city code of ordinances.
   (B)   Plan review fees. There shall be charges for engineering and plan review by the City Engineer, city employees, and the Planning Commission. These charges shall cover the original submission of plans and two subsequent submissions, if necessary, to make corrections as requested by the city. If a fourth submission is required, an additional charge of $25 shall be made and the engineering time (city's cost plus 10%) shall be invoiced to the developer. There shall be no charge for subsequent submissions when new changes are requested by the city. This charge will be levied only when changes requested have not been complied with. The developer shall make payment of the engineering charges upon submission of billing. Charges are to be as follows:
      (1)   Preliminary plats: $200.00 for the first 100 lots* plus Note A.
      (2)   Subdivision improvement plans: $200.00 for the 50 first lots* plus Note A.
      (3)   Record plats: $100.00 for the first 30 lots* plus Note A.
      (4)    As-built plans: $100.00 for the first 30 lots* plus Note A.
      (5)   Lot split: $50.00.
      (6)   Variances: $300.00 plus Note B.
      (7)   Administrative appeals: $100.00 plus Note B.
      (8)   Code interpretations: $100 plus Note B.
   *For the fixing of the above charges; in the case of plans with oversize lots, the developer shall be charged on basis of either the number of lots or on the basis of 14,000 square feet per lot, whichever results in the higher cost.
   Note A: Work performed by city employees and professional consultants and other associated costs incurred by the city will be charged to the applicant at their billed cost plus 10%. In the case of work performed by the City Engineer, the hourly cost to the applicant shall be at the rate of $30 per hour. The permit shall not be issued prior to this additional fee being paid in full.
   Note B: Where work performed by the City Engineer, city employees, and professional consultants and other costs directly associated with a variance appeal or code interpretation exceeds the residue of the fee after standard costs are deducted, the applicant will be charged as described in Note A. All charges must be paid within 30 days of invoice.

§ 156.09 BUILDING PERMIT, INSPECTION, AND CERTIFICATION FEES.

   (A)   Authority and scope. In accordance with the authority set forth in R.C. §§ 715.26 and 3791.04, the fee schedule set out below is established for the acceptance and approval of plans and specifications, and the making of the various in-progress inspections, as required in the city building code or by the discretion of the Building Official. Such fees, in their proper form, shall apply to all projects regulated by the city building code and FPCO Chapter 154, Subchapter E. Fees for permits, inspection, and certificates shall be paid as set forth herein. The Building Official shall keep an accurate account of all fees collected, and such fees shall be deposited as required by law.
   (B)   Investigating fee, work without a permit. Where the work for which a permit is required by this section is started or proceeded prior to obtaining the required permit, a special investigation shall be made before a permit may be issued for such work. An investigation fee shall be equal to the amount of the permit fee required by this chapter. For repeat offenses, the owner or contractor shall be charged an additional penalty of $500. Such investigation fee shall be in addition to the payment of the regular permit fee and any other fee which may accrue thereafter, and no portion of such investigation fee shall be refunded. The payment of such investigation fee shall not relieve any person from fully complying with the requirements of this chapter, nor from any other penalty prescribed herein.
   (C)   Fees for 24-hour service on application for permits.
      (1)   Twenty-four hour service on an application for a building permit for residential or nonresidential construction shall be requested at the time of filing the application for a permit.
      (2)   The Director of Building and Inspections shall determine at the time of the request the capability of the Building Department to provide the requested overnight service based on the size and complexity of the project or department workload.
      (3)   The fee for such service shall be equal to one-half the regular permit fee computed in accordance with this section. Such 24-hour service fee shall be in addition to the regular permit fee and to any other fees which may accrue thereafter.
   (D)   Permit fee calculations and tables. Building permit fees are calculated using permit fee multipliers, in accordance with one of the following formulas and the fee tables:
      (1)   FORMULA A: OBC Building Permit Only (no HVAC)
         Permit Fee = Building Gross Area x 98.5 x Occupancy Multiplier x Permit Fee Multiplier =
      (2)   FORMULA B: OBC HVAC Permit Only (no Building)
         Permit Fee = Formula A x 0.25
      (3)   FORMULA C: One, Two and Three Family Residential Building Permit (OBC or RCO)
         Permit Fee = Building Gross Area x 0.6 (Building Gross Area includes garage, basement, finished or unfinished) + tabular fees indicated below.
      (4)   Fees for buildings and structures regulated by the RCO and Chapter 154 (add administration fee):

   (E)   Administrative fees.
      (1)   Certificate of occupancy (CO).
         (a)   Buildings and structures regulated by the FPBC: $40.00.
         (b)   Buildings and structures regulated by the OBC: $ 120.00.
      (2)   Certificate of completion (CC) for all permits where a CO is not required = $20.00.
      (3)   Temporary certificate of occupancy (TCO) extension fee will double each month.
         (a)   Buildings and structures regulated by the RCO: $ 85.00.
         (b)   Buildings and structures regulated by the OBC: $ 195.00, fees will double after each 30 days.

         (a)   Violations issued under the Code shall be punishable by a fine of not more than $1,500 for each offense as provided.
         (b)   Violations issued for offenses to R.C. Chapters 3781 and 3791 shall not be more than $1,000. Each day that any such violation or failure continues shall be deemed a separate offense.
   (H)   Forest Park Standards Administration Fee (including state surcharge). In accordance with R.C. § 3781.02, an assessment fee equal to 5% of all fees charged by the Building Department for projects regulated by the Ohio Building Code and Forest Park Code for commercial use and an assessment fee equal to 3% of all fees regulated by Residential Code of Ohio is collected and Forest Park Code for residential use.

§ 156.10 ELECTRICAL PERMIT, INSPECTION, AND PLAN REVIEW FEES.

   (A)   Fees for electrical permits, inspections, and plan review shall be prescribed by and be payable to and retained by the authorized inspection agency as compensation in full for services to provide an electrical system in accordance with the Building Code.
   (B)   The authorized inspection agent shall keep an accurate account of all electrical permits issued, and of all fees collected for all work within the city.

§ 156.11 PLUMBING PERMITS, INSPECTIONS, AND PLAN REVIEW FEES.

   The Hamilton County Department of Health issues all plumbing permits, performs all plan reviews and makes all plumbing inspections and otherwise controls all installations of plumbing systems within the city. All fees for plumbing permits, inspections and plan reviews are set by the Hamilton County Health Department and must be paid directly to that agency.

§ 156.12 SANITARY WASTE DISPOSAL SYSTEM FEES.

   The Metropolitan Sewer District of Hamilton County authorizes and controls all installations of sanitary waste disposal systems and connection to existing sanitary sewer lines within the city. Fees for sanitary sewer connections are set by and must be paid directly to that agency.

§ 156.13 STORMWATER MANAGEMENT CODE FEES.

   The following schedule shall apply to all fees under the jurisdiction of Chapter 51 of the City of Forest Park Code of Ordinances:
   (A)   Review for new or expired plans: $25 plus Note A.
   (B)   Stormwater management permit: $20 plus Note B.
   (C)   Review fees for revisions to unexpired, approved plans: $10 plus Note A.
   (D)   Variance to Stormwater Management Code: $65 plus Note C.
   (E)   Appeal of administrative decision or code interpretation: $65 plus Note C.
   NOTE A: Work performed by city employees and professional consultants and other associated costs incurred by the city will be charged to the applicant at cost plus 10%. In the case of work performed by the City Engineer, the hourly cost to the applicant shall be at the rate of $40 per hour. The permit shall not be issued prior to this additional fee being paid in full.
   NOTE B: Field inspections for stormwater management will be charged at the rate of $40 per hour or part thereof for a minimum of one hour. Inspection fees must be paid in full prior to the stormwater management bond being returned to the applicant.
   NOTE C: Where work performed by the City Engineer, city employees, and professional consultants and other costs directly associated with a variance appeal or code interpretation exceeds the residue of the fee after standard costs are deducted, the applicant will be charged as described in Note A above. All charges must be paid within 30 days of invoice.

§ 156.14 FEES FOR WORK IN PUBLIC RIGHTS-OF-WAY.

   Any work in, or occupancy of, the public rights-of-way within the city shall be governed by the requirements of Chapters 52 and 92 of the Codified Ordinances of Forest Park, Ohio. The following fees and bond schedule shall apply to all work or construction within public rights-of-way:
   (A)   Pursuant to Chapter 52, each person who occupies, uses or seeks to occupy or use the rights-of-way to operate a system as defined by § 52.003, unless specifically exempted by § 52.013, shall be required to obtain and maintain a certificate of registration in accordance with the following fee schedule:
      (1)   An application fee that is equal to the actual direct costs the city incurs for the receipt, review, processing and grant (or denial) of the required application for a certificate of registration.
      (2)   An annual registration maintenance fee of $25.26 (per mile as determined in accordance with § 52.060(A)).
      (3)   General insurance and bonding requirements for holders of certificates of registration shall be as required in §§ 52.038(C) and 52.210 et seq.
   (B)   A right-of-way permit fee of $24.95 shall be charged for the issuance of a street opening permit as required by Chapter 92 and/or a right-of-way permit as required by Chapter 52.

§ 156.15 RENTAL REGISTRATION FEES.

   (A)   Annual permits.
      (1)   Initial rental registration permit:
         (a)   Single and two-family dwellings: $100.
         (b)   Multi-family dwellings: $100 per building plus $10 for each unit.
      (2)   Annual permit renewal:
         (a)   Single and two-family dwellings: $100.
         (b)   Multi-family dwellings: $100 per building plus $10 for each unit.
   (B)   Change of occupant. Permits for which renewal is required solely due to a change of occupant: $50.
   (C)   Reinspection fees. Reinspections performed by the city to confirm the correction of violations noted in an initial inspection.
      (1)   First reinspection: No charge.
      (2)   Second reinspection: $70.
      (3)   Third reinspection: $140.
      (4)   Subsequent reinspections, after the second: $210.
   (D)   Pro-rated fees. For permits issued for less than one year, the fees charged in divisions (A) and (B) of this section shall be pro-rated as follows:
      (1)   Permits issued between June 1 and August 31: 75%.
      (2)   Permits issued between September 1 and November 30: 50%.
      (3)   Permits issued between December 1 and February 28: 25%.

§ 156.16 FEES FOR REGISTRATION OF FORECLOSING MORTGAGED PROPERTY AND VACANT PROPERTY.

   The following shall apply to all fees under the jurisdiction of Chapter 153 of this Code of Ordinances:
   (A)   Initial Semi-Annual Registration Fee: $300.
   (B)   Semi-Annual Renewal Fee: $300.
   (C)   Late Payment Fee: 10% for each 30 days, or portion thereof, past the date due for the applicable fee.
   (D)   Refund: If a fee has been paid due to an error, and the property is not subject to the requirements of Chapter 153, the City Manager may authorize a refund. Otherwise, all fees incurred in compliance with this chapter are non-refundable.

§ 156.17 COMMUNITY REINVESTMENT AREA FEES.

   The following fees shall apply to all applications for tax abatement within a community reinvestment area as defined by R.C. Chapter 3735.
   (A)   Tax abatement application for residential properties: $250.
   (B)   Tax abatement application for commercial or industrial properties: $1,000.
   (C)   Revisions and amendments: 50% of the applicable fee.
   (D)   Appeal of the decision of the Housing Officer: $100.

§ 156.18 ECONOMIC DEVELOPMENT PROJECT FEES.

   The following fees shall apply to all applications for economic development projects requiring city participation to create and monitor community reinvestment districts, enterprise zone agreements, incentive districts, tax-increment financing districts, special assessments, urban renewal, downtown redevelopment districts, special improvement districts, or any form of debt, be it bonds, notes, loans, or leases. The terms are defined in R.C. Chapters 725, 727, 729, 1710, 3735, and 5709.
   (A)   Creation and issuance fees of $50,000 for projects with a total cost not to exceed $2,000,000 with no conduit of debt, or tax adjustments.
      (1)   An additional $20,000 per $1,000,000 in excess of $2,000,000.
      (2)   If the debt is conduited by the city, an additional $10,000 per $1,000,000 will be charged.
      (3)   If the project includes tax abatements, credits, reductions, or waivers, an additional 0.75% of the total project cost will be charged.
      (4)   For more complex deals the city reserves the right to establish an alternate fee structure defined within a development agreement.
   (B)   Management fees of $5,000 per year for the life of the project with a total cost not to exceed $2,000,000 with no conduit of debt, or tax adjustments.
      (1)   An additional $1,000 per $1,000,000 in excess of $2,000,000.
      (2)   If the debt is conduited by the city, an additional $10,000 on the first $2,000,000 plus the fee outlined in division (B)(1) of this section.
      (3)   If the project includes tax abatements, credits, reductions, or waivers, an additional $10,000 on the first $2,000,000 plus 0.50% of the total project cost on the highest debt outstanding during the project period will be charged.
      (4)   For more complex deals the city reserves the right to establish an alternate fee structure defined within a development agreement.
