SECTION 12

- Accessory building regulations.

Area and height regulations for accessory buildings and structures in residential and apartment districts:

1.

Front yard:

Attached accessory buildings shall have a front yard not less than the main building. Detached accessory buildings shall be located in the area defined as the rear yard.

2.

Side yard:

There shall be a side yard for any detached accessory building of not less than three (3) feet from any side lot line when such detached accessory building is located in the rear of the lot (the rear of a line erected connecting the midpoints on the two (2) opposite side lot lines of any lot, tract or plot). When a detached accessory building is located in front of the line connecting the two (2) midpoints of the opposite side lot lines as herein described such accessory building shall observe the same side yard as specified for the main building.

3.

Rear yard:

There shall be a rear yard for accessory buildings not less than three (3) feet from any lot line, alley line or easement line, except that if no alley exists, the rear yard shall not be less than ten (10) feet as measured from the rear lot line. Where apartments are permitted, the main building and all accessory buildings shall not cover more than fifty (50) percent of the rear of the lot (that portion of the lot lying to the rear of a line erected joining the midpoint of one (1) side lot line with the midpoint of the opposite side lot line). Carports, garages, or other detached accessory buildings located within the rear portion of the lot as heretofore described shall not be located nearer than three (3) feet to any side lot line.

4.

Height:

An accessory building height shall be limited to a maximum of two (2) stories, with the maximum height of any single story being twelve (12) feet.

5.

Air conditioning or similar accessory structures:

Air conditioning compressors, cooling towers and similar accessory structures shall observe all front, side or rear yards specified for accessory buildings. When such accessory structures are located in the side yard of that portion of a lot herein designated as the rear of the lot, the minimum side yard shall be three (3) feet. When such accessory structures are located forward of the line dividing the rear of the lot from the front of the lot, the accessory structures shall observe the same side yard as required for the main structure.

6.

Satellite dish installer's license:

a.

No person, firm, or corporation shall engage in the business of installing satellite dish antennas unless such person, firm, or corporation holds a current satellite dish antenna installer's license.

b.

No permit for the installation of any satellite dish antenna shall be issued to any person, firm, or corporation unless such person, firm, or corporation is the holder of a license entitling said holder to procure permits for said installations.

c.

Application for satellite dish antenna's installer's license shall be made in writing, stating the name and place of business of the applicant, the firm company, or corporation to be represented by said applicant.

d.

The fee for satellite dish installer's license shall be ten dollars ($10.00) per annum, payable in full advance and renewed annually, and may be revoked at any time by the order of the mayor and city council for violation of any of the provisions of this ordinance; and the offending person, firm, conducting any such work for a period of one (1) year, at which time it may be renewed.

7.

Satellite dish antennas located in residential districts shall meet the following conditions for placement and installation:

a.

Antennas shall not be located in the front or side yard(s).

b.

Antennas shall be installed so that the center line of the dish is not less than four (4) feet from any property line. Antenna shall not encroach upon any property line.

c.

Installation on the roof is permitted provided the total height of the structure and the antenna does not exceed the district height restrictions as set forth in section 9 of the zoning ordinance and the total diameter of the dish does not exceed three (3) feet.

d.

All antennas shall be installed according to manufacturer's specifications, meet all code requirements, be permanently anchored, and a building permit, with ten dollar ($10.00) permit fee, shall be required for each installation.

e.

A temporary permit may be granted by the building official for demonstration purposes only for a maximum of seventy-two (72) hours.

f.

All antennas shall be located in a manner that will not interfere with pedestrian or vehicular movement, be a visual obstruction to traffic, or eliminate required parking spaces.

8.

Satellite dish antennas located in retail and/or commercial districts shall meet the following conditions for installation:

a.

Installation on the roof is permitted provided the total height of the structure and the antenna does not exceed the district height restrictions as set forth in section 9 of the zoning ordinance.

b.

All antennas shall be installed according to manufacturer's specifications, meet all code requirements, be permanently anchored, and a building permit fee with ten dollar ($10.00) permit fee, shall be required for each installation, except for sales or demonstration purposes.

c.

All antennas shall be located in a manner that will not interfere with pedestrian or vehicular movement, be a visual obstruction to traffic, or eliminate required parking spaces.

d.

A temporary permit may be granted by the building official for demonstration purposes only for a maximum of seventy-two (72) hours.
