155.100 AUTHORITY

PURPOSE, AND APPLICATION

§ 155.101 AUTHORITY

The Freeport Zoning Code is adopted:

  1. (A)
    Under the authority of the Constitution and laws of the State of Texas, including but not limited to, the following chapters of the Texas Local Government Code (TLGC):
    1. (1)
      TLGC Chapter 211, Municipal Zoning Authority;
    2. (2)
      TLGC Chapter 213, Municipal Comprehensive Plans;
    3. (3)
      TLGC Chapter 214, Municipal Regulation of Housing and Other Structures;
  2. (B)
    Pursuant to the provisions of the City’s Home Rule Charter.

Effective on: 1/10/2022

§ 155.102 PURPOSE

The regulations of this Chapter are established to: 

  1. (A)
    Implement the City's adopted planning documents, including but not limited to the City's Strategic Community Plan;
  2. (B)
    Promote the public health, safety, morals, and general welfare of the City;
  3. (C)
    Secure safety from fire, panic and other dangers;
  4. (D)
    Provide adequate light and air;
  5. (E)
    Prevent the overcrowding of land;
  6. (F)
    Avoid undue concentration of population;  and 
  7. (G)
    Facilitate the adequate provision of transportation, water, sewage, schools, parks and other public requirements.

§ 155.103 APPLICATION

  • (A)
    Jurisdiction. Unless otherwise noted:
    1. (1)
      ​​​​​All provisions of this Chapter apply within the corporate limits of the City of Freeport; and 
    2. (2)
      No provision of this Chapter shall apply within the Extraterritorial Jurisdiction (ETJ) of the City.
  • (B)
    Zoning Districts. This Chapter divides the City into zoning districts that create different standards for development that vary depending upon which zoning district a parcel of property is located within.
  • (C)
    Minimum Standards. The regulations set by this Chapter for each district shall be minimum regulations and shall apply uniformly to all land, buildings, and structures unless otherwise stated.
  • (D)
    Conformity. No building, structure, land or part thereof shall be used, occupied, erected, constructed, reconstructed, moved or structurally altered unless in conformity with all regulations in this Chapter specified for the district in which it is located.
