32 INDUSTRIAL ZONING DISTRICTS

§ 18.32.010 Purpose of chapter.

This chapter lists the uses of land that may be allowed within the industrial zoning districts established by Chapter 18.12. It also determines the type of land use permit/approval required for each use, and provides general standards for site development.

§ 18.32.020 Purpose of industrial zoning districts.

The purposes of the individual industrial zoning districts and the manner in which they are applied are as follows.
A. 
Light Industrial District (LM). The LM zoning district is intended for low to medium intensity uses that involve the manufacture, fabrication, assembly, or processing of primarily finished materials. This zoning district is characterized by medium and large lots and is designed to promote the development of uses such as auto service centers, research and development parks, construction industries, incidental wholesale and retail activity, outdoor storage, and assembly/light manufacturing uses. Residential uses of any kind are prohibited in this district with the exception of emergency shelters. The LM zoning district is consistent with the industrial land use designation of the General Plan.
B. 
Industrial District (M). The M zoning district is intended to accommodate a broad range of manufacturing and industrial uses. Permitted activity may vary from medium to higher intensity uses that involve the manufacture, fabrication, assembly, or processing of raw and/or finished materials. This zoning district is characterized by large lots and is designed to promote the development of uses such as industrial processing and assembly warehousing. Residential uses of any kind are prohibited in this district. The M zoning district is consistent with the industrial land use designation of the General Plan.

§ 18.32.030 Regulations for industrial zoning districts.

Regulations for industrial zoning districts shall be as follows:
A. 
Permitted and conditionally permitted uses shall be as specified in Table 18.32-1.
B. 
Development standards shall be as specified in Section 18.32.050.
C. 
Off-street parking and loading shall be provided in accordance with the provisions of Chapter 18.48.
D. 
Signs shall comply with the provisions of Chapter 18.56.
E. 
Landscaping and screening shall be provided in accordance with the provisions of Chapter 18.52.
F. 
No building, structure, vehicle, or land shall be used nor shall any building, structure or vehicle be erected, altered, moved, enlarged, or stored below the established base flood elevation (as shown on the Flood Insurance Rate Maps (FIRM) prepared by the Federal Emergency Management Agency (FEMA) and including any letter of map amendments (LOMAs) and letter of map revisions (LOMRs)). If no base flood elevation exists and there is a likelihood that the property is subject to flooding, the applicant shall submit a hydrological survey that establishes the base flood elevation. No area lying below base flood elevation shall be used in any manner so as to create problems inimical to the public health, safety or general welfare or so as to have a detrimental effect on the use or value of property in the vicinity or within the City as a whole.
G. 
In addition to the uses permitted in Table 18.32-1, and subject to the requirements of the applicable uniform codes, the following uses are allowed in all zoning districts without a permit.
1. 
Gardens, the primary purpose of which is to provide food for noncommercial use.
2. 
Keeping of four (4) or fewer dogs of more than four (4) months of age.
3. 
City or City-approved wells, water treatment plants, lift stations, substations, and similar facilities.

§ 18.32.040 Industrial zoning districts land uses and permit requirements.

A. 
Table 18.32-1 identifies the uses of land allowed by this Development Code in each industrial zoning district, and the land use permit required to establish each use, in compliance with Chapter 18.68. Uses are permitted or prohibited in accordance with Table 18.32-1 and provided they conform to all provisions of this title. The letter "N" indicates the use is prohibited in the corresponding zoning district. The letter "P" indicates the use is permitted in the corresponding zoning district. The letter "M" indicates the use is permitted in the corresponding zoning district subject to approval of a minor use permit (see Section 18.68.120). The letter "C" indicates the use is permitted in the corresponding zoning district subject to approval of a conditional use permit (see Section 18.68.130). If a proposed use does not appear in this table, the proposed use is considered a prohibited use, unless it is determined to be similar to a use specified in this table in accordance with Section 18.68.090. Footnote numbers in Table 18.32-1 correspond to numbers in subsection B of this section.

B. 
The following special considerations shall apply to Table 18.32-1 (numbers correspond to footnote numbers in the table):
1. 
Adult bookstores, adult entertainment centers, and adult live entertainment center shall meet all of the requirements below.
a. 
The use shall not be located within one thousand (1,000) feet of any day care facility, library, public park or a school, which has or may have a minor or minors as an attendee at such school.
b. 
The use shall not be located within five hundred (500) feet of any place of worship.
c. 
The use shall not be located within five hundred (500) feet of any residential zone, nor of any other adult bookstore, adult entertainment center, or adult live entertainment center.
d. 
An adult bookstore or adult entertainment center shall not operate prior to ten a.m. nor after ten p.m. on any day.
e. 
The exterior appearance of the building housing the use shall not be inconsistent with the external appearance of other structures already constructed or under construction in the LM or M zoning districts.
f. 
All measurements of distance pursuant to this subsection shall be from the closest point on the zoning district boundary or property line of the parcel on which a school, church, adult bookstore, adult entertainment center, or adult live entertainment center is located, to the closest point on the property line of the parcel on which the adult bookstore, adult entertainment center, or adult live entertainment center is proposed to be located. The use permit, by its terms, shall not exceed five (5) years in duration. The use permit may be extended for five (5) year periods, but only upon review by the Planning Commission for compliance with all the requirements of applicable laws, ordinances, rules, regulations, and such findings as would be necessary for the issuance of a new permit.

3. 
Office must be directly associated with, and secondary to, principal permitted use.
4. 
For mobile food vending standards, see Section 18.44.090.
5. 
Retail store must be clearly incidental and/or directly related to the principal use of the property and shall not exceed twenty-five percent (25%) of the total building area for the principal use.
6. 
Requires design review approval pursuant to Section 18.68.100. The sidewalk cafe shall be ancillary to a shop, restaurant, or snack bar.
7. 
Automobile repair garages including the parking and storage of vehicles and related equipment/accessories used in connection with the garage shall be conducted within a completely enclosed building or within a view-obscuring fence. These vehicles shall be actively worked on or they will be considered stored within an unpermitted impound yard.
8. 
Use shall be conducted within a completely enclosed building or within a view- obscuring fence, otherwise a conditional use permit is required.
9. 
A conditional use permit is required when located within five hundred (500) feet of any residential zoning district.
10. 
Mini-storage units shall not be used for any of the following uses:
a. 
The storage of explosives or bulk quantities of flammable or combustible materials as defined in the current edition of the Uniform Building Code or the Uniform Fire Code.
b. 
The shelter or housing of persons, plants or animals.
c. 
The storage of materials which are infested with or especially attractive to vermin, rodents or disease vectors.
d. 
Manufacturing.
e. 
A store, office, or repair facility. The electrical supply in a mini-storage unit shall not exceed one hundred twenty (120) volts.
f. 
The storage of vehicles in customer parking spaces. A rental truck operation is permitted as an ancillary use if the vehicles for rent are parked inside approved, view-obscuring fenced areas and not in customer parking spaces.
11. 
A shipping container is constructed of metal, wood, or other material and designed or patterned after structures used in containerized shipping operations. No shipping container or similar structure shall be used as an accessory structure for incidental storage, permanent or temporary, in any zoning district unless granted a minor use permit pursuant to Section 18.68.120.

§ 18.32.050 Industrial zoning districts general development standards.

The purpose of this section is to provide open areas around structures for access to and around buildings; to protect access to natural light, ventilation, and direct sunlight; to ensure the compatibility of adjacent land uses; to provide space for privacy, landscaping, and recreation; to regulate the height of structures; to promote public safety; and to preserve neighborhood character.
A. 
Development standards for industrial zoning districts shall be as specified in Table 18.32-2. Footnote numbers in the table correspond to numbers in subsection B of this section.

Footnotes: The following special development standards shall apply to applicable zoning districts listed in Table 18.32-2 (numbers correspond to footnote numbers in the table):
1. 
Refer to Section 18.52.040 for landscaping requirements for nonresidential development.
2. 
Where the subject property adjoins a residential zoning district, the minimum front yard setback, the minimum side yard setback on the adjoining side, and the minimum rear yard setback shall be the same as required in the adjoining residential district. In the public/quasi-public zoning district, setbacks less than that of adjacent residential districts may be reviewed for approval subject to Section 18.68.080.
