CHAPTER 152

STORMWATER DRAINAGE UTILITY

§ 152.01 PURPOSE.

   The Council hereby determines and declares that it is necessary and in the public interest to create a stormwater drainage utility to finance, own, operate, maintain, repair and improve the existing stormwater drainage facilities servicing the village.

§ 152.02 MAINTENANCE BY VILLAGE.

   The village shall maintain all public stormwater drainage facilities located on village-owned land, and in public rights-of-way and easements.
   (A)   Public facilities include, but are not limited to:
      (1)   Open drainage ways owned by the village or located in public-owned rights-of-way or drainage easements in the village;
      (2)   A piped drainage system and its related appurtenances which have been designed and constructed expressly for use by the general public; and
      (3)   Roadside drainage ditches within the public right-of-way along streets.
   (B)   Facilities not qualifying as public facilities include, but are not limited to:
      (1)   Private parking lot storm drainage;
      (2)   Stormwater retention or detention facilities located on private property;
      (3)   Roof, footing and area drains;
      (4)   Drains not designated and constructed for use by the general public;
      (5)   Open drainage swales or ditches on private property for which no public easement of record has been granted; and
      (6)   Access drive culverts.

§ 152.03 CHARGES.

   (A)   In order to pay the cost of operating, maintaining, repairing, improving and extending the utility, the Council has established and impose just and equitable charges on all users of the utility for the services provided by the utility.
   (B)   Theses charges are as follows:

Note: ERU is the abbreviation for equivalent residential unit and is the equivalent of 3,000 sq. ft. of impervious area
 
   (C)   If any charge for the service of the system shall not be paid by the due date on the water/sewer quarterly bill, a late payment charge of 10% of the amount will be added thereto and collected therewith.

§ 152.04 CREDITS.

   (A)   Credits shall be offered to nonresidential customers with more than five ERUs for the following items and percentages.
 
Detention/retention (exceeding standards)
10% maximum
Detention/retention (minimum standard)
5% maximum
Dry well subsurface drainage/maintenance
10% maximum
 
   (B)   A maximum of 25% credit will be permitted for eligible properties. Credits must be applied for according to the credit application procedure established by the Village Administrator.

§ 152.05 STORMWATER UTILITY FUND.

   Pursuant to and in accordance with R.C. § 5705.09, the Council hereby established a special fund to be known as the Stormwater Utility Fund for the revenues and expenses of the utility.

§ 152.06 ADMINISTRATOR; DUTIES.

   The Village Administrator shall be the administrator of this utility and is hereby authorized to develop, for approval by Council, policies, regulations, standards, charges and financial incentives to promote, regulate and administer the utility.
