§ 151.070 ADMINISTRATIVE OFFICER.

   (A)   The Administrative Officer, who shall be appointed by the Advisory Plan Commission upon recommendation of the Mayor, shall:
      (1)   Administer the provisions of this chapter;
      (2)   Issue zoning-building permits; and
      (3)   Maintain a permanent file of all zoning-building permits and applications as public records.
   (B)   The Administrative Officer shall have the following powers and duties:
      (1)   The exclusive right to hear and approve or deny all specifications for mobile homes and manufactured housing special exceptions only. A special exception may only be approved by the Administrative Officer upon determination in writing that the provisions of § 151.089 have been met. In addition, the Administrative Officer may impose conditions pursuant to § 151.092;
      (2)   The exclusive right to hear and approve or deny variances from the development standards of the zoning ordinance. A variance from the development standards may be approved by the Administrative Officer only upon a determination in writing that the provisions of § 151.087 have been met. In addition, the Administrative Officer may impose conditions pursuant to § 151.092; and
      (3)   The rules and procedures adopted by the Advisory Board of Zoning Appeals under § 151.085 shall apply to the Administrative Officer, and any appeal of the decision made by the Administrative Officer shall be done in accordance with § 151.073.

§ 151.071 ZONING-BUILDING PERMITS.

   (A)   A zoning-building permit shall be obtained before any person may:
      (1)   Occupy or use any vacant land;
      (2)   Occupy or use any structure hereafter constructed, reconstructed, moved, or enlarged;
      (3)   Change the use of a structure or land to a different use;
      (4)   Change a nonconforming use;
      (5)   Erect a fence; or
      (6)   Erect a satellite dish.
   (B)   Application for a zoning-building permit shall be accomplished by a plot plan showing clearly and completely the location, dimensions, and nature of any structure involved and such other information as the Administrative Officer may require for administration of this chapter. Any zoning-building permits shall expire six months after date of issuance.

§ 151.072 VIOLATIONS.

   It shall be unlawful to locate, erect, construct, reconstruct, enlarge, change, maintain, or use any structure or land in violation of any regulation in or any provisions of this chapter or of any regulation enacted hereunder by the Advisory Board of Zoning Appeals. The Advisory Plan Commission may institute a suit for mandatory injunction directing the removal of a structure erected in violation of this chapter. Any structure or use that violates this chapter shall be deemed to be a common nuisance, and the owner of the structure shall be liable for maintaining a common nuisance.

§ 151.073 METHOD OF APPEAL.

   Any person aggrieved or affected by the provisions of this chapter or by any decision of the Administrative Officer may appeal to the Advisory Board of Zoning Appeals within a reasonable time, as provided by the rules of the Advisory Board, by filing a notice of appeal specifying the grounds thereof. Every decision of the Advisory Board of Zoning Appeals shall be subject to review by the Circuit or Superior Court of the county.
