COMMERCIAL DISTRICT C-1
This district covers that portion of the community intended for the conduct of general business to which the public requires direct and frequent access and is characterized by constant heavy traffic, and by noise of congestion of people and passenger vehicles. This includes such uses as retail stores, banks, theaters, business offices, newspaper offices, printing presses, restaurants, taverns, garages, and service stations, located mostly on primary highway arteries.

In Commercial District C-1, structures to be erected or land to be used shall be for one or more of the following uses:
(1)
Animal hospital or clinic.
(2)
Antique and gift shops.
(3)
Automobile or truck sales, service and repair, including body or fender repair, but not auto salvage or junk.
(4)
Bakeries.
(5)
Barber and beauty shops.
(6)
Boardinghouses.
(7)
Car washes.
(8)
Churches.
(9)
Clubs and lodges.
(10)
Commercial greenhouses, plant nurseries and landscaping.
(11)
Restaurants and food sales.
(12)
Pharmacies.
(13)
Dry cleaners, laundries, and laundromats.
(14)
Farm supply, feed and seed stores (with storage under cover).
(15)
Financial institutions.
(16)
Funeral homes.
(17)
Furniture refinishing and repair including upholstering, cabinet and furniture making.
(18)
Furniture stores.
(19)
Home appliance sales and service.
(20)
Hospitals, general; and laboratories-pharmaceutical and/or medical.
(21)
Hotels, motels and inns.
(22)
Newspaper and electronic media.
(23)
Fire departments, rescue squads and ambulance services.
(24)
Libraries.
(25)
Lumber and building supply (with storage under cover).
(26)
Machinery and electronic sales and service, with a special exception and use permit.
(27)
Office buildings including government offices.
(28)
Plumbing and electrical supply (with storage under cover).
(29)
Public utilities.
(30)
Restaurants; on-premises alcoholic beverage sales permitted.
(31)
Retail stores selling directly to the public.
(32)
Service stations (with major repair under cover), vehicle towing and temporary storage (shall be completely enclosed with a screened wall).

Taxi service and bus terminals.
(34)
Theaters, assembly halls.
(35)
Tourist homes.
(36)
Wholesale and processing not objectionable because of dirt, noise, or odors with a special exception and use permit.

Off-street parking as required by this chapter.

Public billiard parlors and pool rooms, bowling alleys, dance halls, taverns, and similar forms of public amusement only after a public hearing shall have been held by the town council on an application submitted to the body for such use. The town council may request that the commission submit a recommendation to them concerning such use applications. In approving any such application, the town council may establish such special requirements and regulations for the protection of adjacent property, set the hours of operation, and make requirements as they may deem necessary in the public interest. On-premises alcoholic beverage sales permitted with a special exception and use permit.

Photographic studios and printing services.
(42)
High speed voice and data communication hub. Minimum 50-foot by 50-foot lot size. The zoning administrator may require adjustments to the site plan where needed to meet the intent of this section, or waive certain requirements where necessary to facilitate placement with the approval of town council.

Single-family dwellings used for residential purposes on the upper floors and at the rear of a building used for commercial purposes.

The following uses are specifically excluded:

Pain Management and Substance Abuse Clinics

No area regulations shall apply in this district, except for permitted uses utilizing individual sewage disposal systems; the required area for any such use shall be approved by the health official.

Buildings shall be located ten feet or more from any street right-of-way which is 50 feet or greater in width or 35 feet or more from the center line of any street right-of-way less than 50 feet in width, except that signs advertising sale or rent or premises may be erected up to the property line. This shall be known as the "setback line."

For permitted uses, the minimum side yard or rear yard immediately adjoining or adjacent to a residential district shall be 25 feet. This requirement shall not apply where residential districts are separated from commercial districts by a public street or right-of-way with a minimum width of 30 feet.

Buildings may be erected up to 35 feet in height from grade except that:
(1)
The height limit for structures may be increased up to 45 feet and up to three stories provided each side yard is ten feet, plus one foot of side yard for each additional foot of building height over 35 feet.
(2)
Church spires, belfries, cupolas, monuments, cooling towers, municipal water towers, chimneys, flues, flag poles, television antennae, and radio aerials are exempt. Parapet walls may be up to four feet above the height of the building on which the walls rest. Satellite dishes shall be placed in the rear yards or on roofs.

Before a building permit shall be issued or construction commenced on any permitted use in this district, or a permit issued for a new use, detailed site plans in sufficient details to show the operations and processes shall be submitted to the zoning administrator for study. The administrator may refer these plans to the planning commission for their recommendations. Modification of the plans may be required.
