152 Enforcement

Section 152.120

152.120 Responsibility

The provisions of this chapter shall be enforced by the Zoning Inspector. Appeal from the decision of the Zoning Inspector may be made to the City Council as provided herein.

152.121 Zoning Certificate

A zoning certificate shall be required to erect, construct, reconstruct, alter, maintain, or use any building or structure, or to use any land as herein specified. It shall be the duty of the Zoning Inspector to issue a zoning certificate if the building or other structure and the proposed use thereof, or the proposed use of the land or premise, conforms with all of the requirements herein set forth, and in addition, where a zoning certificate is requested for a C-2 Highway Business, the Zoning Inspector shall request City Council approval of a drawing showing the contemplated ingress and egress from the proposed structure or use onto the adjacent public roadway or roadways.

151.122 Application For Zoning Certificate

To obtain a zoning certificate, the applicant shall submit the required documents established in this chapter.

  1. An application on form prescribed by the Zoning Inspector, containing information sufficient to show compliance with the requirements of this chapter.
  2. A plat drawn to scale showing the actual shape and dimensions of the lot to be built upon, the exact size and location on the lot of existing buildings and structures, the lines within which the proposed building or structure and driveways shall be located or altered, the existing and intended use of the property, and such other information with regard to the lot and neighboring lots and their use as may be necessary to determine compliance with and provide for the enforcement of this chapter.
  3. In areas which are not served with public water or sewer, a certified statement that the proposed water and sewer facilities will be installed to conform to the minimum requirements of the Department of Health and Human Services Regulation and Licensure.
  4. Any zoning certificate issued shall become invalid unless the work authorized by it shall be commenced within six months of its date of issue or if the work authorized by it is suspended or abandoned for a period of one year. A record of zoning certificates shall be kept on file in the office of the Zoning Inspector.

152.123 Conflicts

Whenever the regulations of this chapter require a greater width or size of yards, courts, or other open space; or require a greater percentage of lot to be left unoccupied; or impose other more restrictive standards than are required in or under any other statutes or agreements, the regulations and requirements of this chapter shall govern. Whenever the provisions of any other statute or agreement Zoning Code 67 require more restrictive standards than are required by this chapter, the provisions of such statutes or agreement shall govern.

152.999 Penalty

  1. Any person, firm, or corporation violating any provision of this chapter shall be deemed guilty of an infraction as defined by Neb. RS 29-431, and upon conviction thereof shall be fined not more than the statutory limit as set forth in sections Neb. RS 17-505, as amended from time to time with costs. Each and every day during which such illegal locating, erection, construction, reconstruction, enlargement, change, maintenance, or use continues may be deemed a separate offense.
  2. In case any building is erected, constructed, reconstructed, altered, repaired, converted, or maintained, or any building or land is used in violation of this chapter, the Zoning Inspector, or any other appropriate municipal authority, or any person who would be damaged by such violation, in addition to other remedies, may institute an action for injunction, or mandamus, or other appropriate action or proceeding to prevent such violation.
