CHAPTER 1268

Districts Generally and Zoning Maps

1268.01 DISTRICTS ESTABLISHED.

   (a)   The City is hereby divided into the following zones or districts:
      (1)   R-2 Single-Family Residential (Low Density) District
      (2)   R-3 Single-Family Residential (Moderate Density) District
      (3)   R-4 Single-Family Residential (High Density) District
      (4)   PRD Planned Residential District
      (5)   B-1 Office/Service District
      (6)   B-2 Limited Service District
      (7)   B-ISD Interchange Service District
      (8)   CBD Central Business District
      (9)   I Industrial District
      (10)   CON Conservation, Public Use/Recreation District
      (11)   MHD Mobile Home Park District
   (b)   The following special districts may be established where it is determined by the City Council that special treatment is in the public interest. Such districts shall overlay the regular zoning classification, and the regulations and standards associated with such special districts shall apply in addition to the requirements of the regular zoning classifications.
      (1)   Downtown Design District.
      (2)   Flood Plain District.

1268.02 OFFICIAL ZONING MAPS.

   The location and boundaries of the districts established by Section 1268.01 are set forth and indicated on a set of maps entitled "Official Zoning Maps," which Maps have been approved and recommended by the Planning Commission and approved and adopted by the Council of the City of Geneva, and are so noted with the date of adoption. Said Official Zoning Maps, as presently constituted, or as the same may be hereinafter amended, shall be a part of this Zoning Code and shall be located in the office of the Administrator.

1268.03 DETERMINATION OF DISTRICT BOUNDARIES.

   Where uncertainty exists as to the boundaries of districts as shown on the Official Zoning Maps, the following rules shall apply:
   (a)   Boundaries shall be as generally designated in the City of Geneva Comprehensive Plan, adopted February 10, 1992;
   (b)   Boundaries indicated as approximately following the centerlines of streets shall be construed to follow such centerlines;
   (c)   Boundaries indicated as approximately following platted lot lines shall be construed as following such boundaries;
   (d)   Boundaries indicated as approximately following City boundaries shall be construed as following such boundaries;
   (e)   Boundaries indicated as following railroad lines shall be construed to be midway between the main track;
   (f)   Boundaries indicated as parallel to or extensions of features indicated in subsections (a) through (e) hereof shall be so construed. Distances not specifically indicated on the Official Zoning Maps shall be determined by the scale of the Maps.
   (g)   Where physical features existing on the ground are at variance with those shown on the Official Zoning Maps or in other circumstances not covered by subsections (a) through (e) hereof, the Planning Commission shall interpret the district boundaries.

1268.04 CONFORMITY WITH DISTRICT REGULATIONS; DIMENSIONS AND

   No building, structure or land shall hereafter be used or occupied, and no building or structure or part thereof shall hereafter be erected, constructed, reconstructed, moved or structurally altered, except in conformity with all of the regulations herein specified for the district in which it is located.
   No yard or lot existing at the time of passage of this Zoning Code shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date of this Zoning Code shall meet at least the minimum requirements established by this Zoning Code, except as provided herein.

1268.05 SCHEDULE OF DISTRICT REGULATIONS.

   District regulations for individual districts shall be as set forth in the following Schedule of District Regulations, which shall be a part of this Zoning Code, and in Chapter 1280 - Supplementary Regulations.
Densities, as shown on the schedule, should be calculated based on the gross acreage of the property. Minimum floor area requirements refer to main structures. Minimum setbacks refer to all structures.

(a) R-2 SINGLE-FAMILY RESIDENTIAL (LOW DENSITY)
The purpose of this District is to provide locations for low density single-family development. Certain other uses compatible with and supportive of such uses shall be permitted.
(1)   Single-family residences
(2)   Greenhouses, the products of which are used only for the persons living on the premises
(3)   Accessory uses incidental to single-family uses
(4)   Public facilities, with a conditional use permit (CUP)
(5)   Schools, public or private, with a CUP
(6)   Library or museum, with a CUP
(7)   Park, playground or golf course and/or recreational
(8)   Church or other place of worship, excluding funeral chapel or mortuary chapel
(9)   Hospital and/or medical center
(10)    Family homes for mentally dis-abled children or adult, with a CUP
(11)    Accessory living quarters (see Supplementary Regulations)
(12)    Home occupation, with a CUP
(13)   Public utility structures, with a CUP, provided that such use is not injurious to adjacent premises or occupants by reason of emission of dust, gases, fumes, odors, smoke, electric disturbances, noise, vibration or appearance and is not dangerous to life or property
(14)   Funeral home and accessory uses
(15)   Business and professional offices: (architect, engineer, doctor, attorney, planner, insurance, financial planners, chiropractic/ massotherapy clinics and other like uses) in residences fronting on St. Rt. 534 (from North Ave. to St. Rt. 84) and along US Rt. 20 with a CUP

(d)   B-1 OFFICE/SERVICE
   The purposes of this District are to:
(1)   Locate certain service and professional office uses that are supportive and compatible with each other and with residential uses adjacent to such residential areas;
(2)   Provide an entrance and definition to the Central Business District (CBD) and not negatively impact the Central Business District;
(3)   Provide a transition between the CBD and residential zones;
(4)   Provide such locations in a manner which minimize negative impacts on other districts; and
(5)   Establish site improvements and criteria to mitigate potential negative impacts between office and residential uses.
Nonretail service activities, nonprofit agencies, funeral homes, professional services (legal, medical, dental, engineering, real estate, chiropractic/ massotherapy clinics and financial) and like uses, as determined by the Plan. Comm.

(1)   Provide locations for activities most suited to freeway interchange access by their nature and the needs of freeway travelers;
(2)   Take advantage of the special opportunities available to the community at freeway interchanges; and
(3)   Promote attractive development of the freeway interchange entrance to the community.

(g)   CBD DOWNTOWN DISTRICT
The purposes of this District are to promote the general community health, safety, convenience and welfare by maintaining a high quality of community development; to protect and preserve the value, use and appearance of property; to promote the stability of property values; and to protect real estate from impairment or destruction of value.
These purposes will be served by the regulation of exterior design, use of materials, dimensions, landscaping and orientation of all buildings, other structures and other physical elements hereinafter altered, constructed, reconstructed, erected, enlarged or remodeled in the Downtown Design District
The intent and purpose of this section are to utilize these standards for the Downtown Design District only.

(i)   PRD PLANNED RESIDENTIAL DEVELOPMENT
The purposes of the PRD District are to permit the use of new techniques for the planning and development of residential areas within the City which meet the varied housing needs of residents; to provide for the conservation of natural features; to promote the creation of special amenities in residential developments; and to ensure the authority and means for the Planning Commission to control and manage the design while exercising flexibility in permitting such developments.

(j)   RMH RESIDENTIAL MOBILE HOME DISTRICT The purpose of this District is to provide locations for mobile home residences and certain uses compatible with and supportive of such uses.
