- BUILDING PERMITS AND CERTIFICATES OF OCCUPANCY

Sec. 36-343. - Building permits.

No person shall commence site preparation for, or construction or alteration of, any building without applying for and obtaining a building permit from the building inspector; provided, however, any building permit shall expire six months from the date of its issuance unless within that period construction of the permitted building has commenced. The permit fees for construction shall be in the amounts provided in the village fee schedule.

Sec. 36-344. - Certificates of occupancy—Required.

Subsequent to the effective date of the ordinance from which this chapter is derived, no change in the use or occupancy of land, nor any change of use or occupancy in an existing building shall be made, nor shall any new building be occupied for any purpose, until a certificate of occupancy has been issued by the building inspector. A certificate of occupancy shall be issued only after completion of the work and inspection and approval thereof by the building inspector and it shall state that the new occupancy complies with all provisions of this chapter.

Sec. 36-345. - Certificates of occupancy—Recordkeeping.

A record of all certificates of occupancy shall be kept on file in the office of the building inspector, and copies shall be furnished on request to any person having a proprietary or tenancy interest in land or in a building affected by such certificate of occupancy.

Sec. 36-346. - Certificates of occupancy—Nonconforming uses.

(a)

A certificate of occupancy shall be required of all nonconforming uses of land or buildings created by the passage of the ordinance from which this chapter is derived.

(b)

Application for such certificate of occupancy for nonconforming uses shall be filed with the building inspector by the owner or lessee of the land or building occupied by such nonconforming use within two years from the effective date of the ordinance from which this chapter is derived.

(c)

It is the duty of the building inspector to issue a certificate of occupancy for nonconforming uses.

(d)

Any nonconforming use for which an occupancy permit has not been obtained in conformity with the requirements of subsections (a), through (c) of this section shall be presumed to be operating in violation of this chapter and such use shall be abated.
