BUSINESS DISTRICTS

4-101 PURPOSES

   Two zoning districts are provided for business and commercial uses. When taken together, these districts are intended to permit development of property for the full range of business and commercial uses needed to serve the citizens of Glencoe and nearby suburban areas.
   The business districts are intended to serve the everyday shopping needs of Village residents as well as to provide opportunities for specialty shops attractive to the wider suburban residential community around the Village. They permit uses that are necessary to satisfy the most basic and frequently occurring shopping needs. They also permit compatible uses that, while not used as frequently, would be desirably located in close proximity to potential users. The districts are normally located on primary or secondary thoroughfares, are relatively small in size, and have bulk standards that provide for compatibility with nearby residential uses. Business uses are to be limited to retail and service establishments dealing directly with customers.
   The B-1 Central Business District is located in the center of the Village. It is intended to be a contiguous area serving the entire Glencoe suburban community with a wide variety of retail and service uses. The bulk standards are intended to reflect the generally more intense development of property existing in this area.
   The B-2 Neighborhood Shopping District is located at the south end of the Village and is functionally a part of the Hubbard Woods commercial area that is partially located in Winnetka. The regulations are designed to encourage a broad range of attractive retail and compatible service uses, and the bulk standard are intended to reflect the development of a contiguous business area consisting primarily of property fronting on one of the major thoroughfares in the Village.

4-102 PERMITTED USES

I.   Permitted Uses in the B-1 (Central Business District) Zoning District
   A.   Uses Permitted By Right on Any Floor in the B-1 Zoning District. The uses indicated in the following table and no others are permitted as of right on any floor in the B-1 District. These uses may be permitted on ground floors with the approval of a Special Use Permit, as provided in Section 4-103 and Section 7-502 of this Code. 4-103 SPECIAL USES

   Except as specifically limited in the following paragraphs, the following may be permitted in any business district subject to the issuance of a special use permit as provided in Section 7-502 of this Code, and subject to the additional standards hereinafter set forth:
   A.   Financial Institution Drive-In Facilities; provided, however, that no special use permit shall be granted unless the Board of Trustees shall find that the evidence establishes that there is a community need for such a facility at the location proposed.
   B.   Gasoline Service Stations (4471); provided, however, that no special use permit shall be granted unless the Board of Trustees shall find that the evidence establishes that there is a community need for such a station at the location proposed. Such special use permit may authorize the outdoor storage of service vehicles and outdoor vehicle maintenance and service activities that are routine in nature, subject to such conditions as the Board of Trustees may deem necessary or appropriate, notwithstanding the limitations of Subsection 4-107D.
   C.   Housing for Senior Citizens and Handicapped Persons; provided, however, that the Board of Trustees may, in approving a special use permit for such housing:
      1.   Allow dwelling unit sizes smaller than those required by Paragraph 4-110C11 of this Code;
      2.   Waive or modify the restriction on residential use below the second floor level of buildings;
      3.   Waive or modify the lot area requirements otherwise applicable;
      4.   Allow a reduction in the number of otherwise applicable required parking spaces; provided, however, that no such reduction shall allow for less than one space for every two dwelling units.
   D.   Relief for buildings in the business districts that do not meet the parking requirements contained in Paragraphs 5-104E1(h)(i) and (ii) of this Code; provided, however, that the Board of Trustees may, in approving a special use permit for parking relief:
      1.   restrict the size of any proposed new building or addition to an existing building;
      2.   restrict the uses of the building, including without limitation restricting the use of one or more floors in the building to retail uses only;
      3.   require that the owner provided off-site parking; and/or
      4.   place any other restrictions or conditions on the special use permit as the Board of Trustees deems necessary or appropriate. (Section D adopted Feb 19, 2004)
   E.   Personal Wireless Services Antennae either: 1)   located on the ground, a building or a utility pole within a a zoning lot or right-of-way but not otherwise permitted; or 2) located on Towers, provided, however, that no such special use permit shall be granted unless the Board of Trustees shall find that, in addition to the other applicable standards for a special use permit, the evidence establishes that there is a community need for such antenna and tower at the location proposed and that such antenna and tower comply with the standards set forth in Paragraph 5-101D13 of this Code. No special use permits authorizing construction of a new tower or addition to, enlargement of, or expansion of use of a lawfully existing tower shall be authorized unless the applicant is able to demonstrate that no lawfully pre-existing antenna support structure or lawfully pre-existing building or structure is available on commercially reasonable terms, and sufficient for the location of an antenna necessary for the provision of personal wireless services.    F.   Residential Use Below the Second Floor ins the B-1 District only, provided that: 
      1.   Any dwelling unit below the second floor is setback at least 120 feet from any zoning lot frontage along either Vernon, Park, or Green Bay Road;
      2.   The zoning lot abuts a residential district; and
      3.   Each such dwelling unit is oriented on the zoning lot so as to provide a buffer between nonresidential uses on the zoning lot and the residential uses on the abutting lot or lots.
   In granting a special use permit pursuant to this Subsection, the Board of Trustees may approve the design and layout of any parking area or parking lot for the required parking spaces serving such residential use, notwithstanding any of the particular requirements in Subsections 5-104B and 5-104C of this Code.    G.   Projecting Signs: but only if such signs are integrally related to the restoration of a building on a block where all the buildings having frontage on such block were constructed before 1920, and provided that such signs are demonstrably shown to be consistent with the restoration of such buildings. No projecting signs authorized pursuant to this Subsection shall be permitted to extend more than 48 inches from the wall of the building to which such sign is attached. (4/1995)
   H.   Relief for any building or structure devoted to Village use that does not meet the bulk, space, and yard requirements contained in Section 4-110 of this Code, subject to such restrictions and conditions on the special use permit as the Board of Trustees may deem necessary or appropriate.    I.   Uses on a ground floor that are permitted on floors other than the ground floor pursuant to Section 4-102.
   J.    Greater maximum building height within the B-2 Zoning District, subject to the following conditions:
      1.    Such relief shall be available only for buildings entirely within those portions of the B-2 Zoning District that are either located:
         a.   no more than 130 feet from the Scott Avenue right-of-way and no less than 100 feet from the Green Bay Road right-of-way; or
         b.   no more than 100 feet from the Scott Avenue right-of-way and no more than 100 feet from the Green Bay Road right-of-way.
      2.    Such relief shall not be available within any portion of the B-2 Zoning District that is west of Green Bay Road.
      3.    The maximum allowable building height allowed with the approval of a Special Use Permit in the B-2 Zoning District shall not exceed 45 feet.
   K.   Permanent Outdoor Dining. Such outdoor dining may include permanent accessory structures.
   L.    Golf Course Protective Structure. With the approval of a Special Use Permit, such structures are not subject to otherwise applicable height, setback, or setback plane Zoning Code requirements.”

4-104 ACCESSORY STRUCTURES AND USES

   Accessory structures and uses are permitted in all business districts subject to the provisions of Section 5-101 of this Code.

4-105 TEMPORARY USES

   Temporary uses are permitted in all business districts subject to the provisions of Section 5-102 of this Code.

4-106 PARKING REQUIREMENTS

   The parking requirements applicable in all business districts are set forth in Section 5-104 of this Code.

4-107 SPECIAL DEVELOPMENT AND USE REGULATIONS

   No building or premises shall hereafter be used, no building shall hereafter be erected or altered, and no accessory use pursuant to Section 5-101 of this Code shall hereafter be allowed, within any business district, unless otherwise provided in this Code, except in accordance with the following use limitations:
   A.   Exterior Appearance Review. No construction or development requiring a building permit and affecting the exterior appearance of any structure shall be permitted in any business district except upon appearance review approval pursuant to Section 7-503 of this Code and approval of the building permit application pursuant to the Glencoe Village Code.
   B.   Incidental Use. Any building primarily used for any of the above enumerated permitted or special uses may not have more than 40 percent of the floor area devoted to manufacturing or storage purposes incidental to such primary use; provided further that no more than five employees shall be engaged at any time on the premises in any such manufacturing or storage use.
   C.   Use of Lot for Residential Purposes. Whenever part of any building is used for residential purposes, such building shall be constructed on a lot having at least 1,200 square feet of lot area per dwelling unit.
   D.   Enclosed Building. All operations including sales and storage shall be conducted within a completely enclosed building, except for permitted temporary uses, operations at a financial institution drive-in facility, and the dispensing of gasoline and oil at gasoline service stations.
   E.   Products. All products produced, kept, handled, or offered for sale shall be sold only at retail on the premises.
   F.   Motor Vehicle Sales. No business establishment, other than an authorized financial institution drive-in facility or an authorized gasoline service station, shall offer goods or services directly to customers waiting in vehicles or, by design of physical facilities or by service or packaging procedures, encourage or permit customers to receive any product which may be used or consumed in a vehicle on the premises.
   G.   Exterior Lighting. All exterior lighting in the business districts shall be so arranged as to prevent direct glare of beams onto any residential district by the use of luminare cutoffs.
   H.   Noise. No noise from operations of any use in the business districts shall be detectable at any point off the zoning lot on which the use is located so as to constitute a nuisance or offense.
   I.   Glare and Heat. No glare or heat from any operations of any use in the business districts shall be detectable at any point off the zoning lot on which the use is located so as to constitute a nuisance or offense.
   J.   Air Pollution. No air pollution, including smoke or gas, odors, and particulate matter, from any operations of any use in the business districts shall be detectable at any point off the zoning lot on which the use is located, unless in compliance with all applicable regulations of the Illinois Environmental Protection Agency.
   K.   Firearm and Ammunition Sales. The sale or transfer of firearms or ammunition in connection with a business shall not be permitted within one mile of any public or private school or public park, as measured from the lot lines of the respective properties. (July 19, 2001 Amendment)

   Signs are permitted in all business districts subject to the provisions of Section 5-105 of this Code.

4-109 BUFFER AND LANDSCAPING

   The buffer and landscaping requirements applicable in all business districts are set forth in Section 5-106 of this Code.

4-110 BULK, SPACE, AND YARD REQUIREMENTS

   C.   Exceptions and Explanatory Notes.
      1.   Height Exceptions. Chimneys, elevator bulkheads, monuments, penthouses for machinery only, stacks, ornamental towers and spires, or necessary mechanical appurtenances may extend not more than seven feet above the highest point of the roof of the principal structure, provided that such appurtenances are screened in accordance with Section 5-106 of this Code. Certain properties within the B-2 District may be built to a maximum height of up to 45 feet with a special use permit as provided in Subsection 4-103(J).
      2.   Visibility Across Corners. Any other provision of this Code to the contrary notwithstanding, nothing more than two and one-half feet high shall be erected, placed, planted, allowed to grow, or maintained within the area bounded by the street lines and a line drawn between points on the street lines 12 feet from the corner on any corner lot in any business district where a front or side yard is required or provided.
      3.   Special Setbacks for Signs. Special setbacks established for some signs by Section 5-105 of this Code shall control over the yard and setback requirements established in the table.
      4.   Specified Structures and Uses in Required Yards. The following structures and uses, except as limited below, may be located in any required yard:
         (a)   Statuary and ornamental light standards having a height of 8 feet or less and having a footprint not exceeding two square feet; and
         (b)   Open patios and walkways; and
         (c)   Eaves projecting not more than 30 inches from an exterior wall, plus any gutters or downspouts projecting not more than six inches from such eaves; and
         (d)   Gutters, downspouts, ornamental features, cornices, belt courses, leaders, sills, lintels, and the like projecting not more than 12 inches from an exterior wall; and
         (e)   Outside stairways and ramps to first floors; provided that any platforms therefor shall not project more than four feet from an exterior wall, exceed four feet in height, or extend more than one foot on either side of the door opening; provided further that no stairways or ramps shall be wider than such platform; and
         (f)   Flagpoles; and
         (g)   Terraces; and
         (h)   Fences and walls subject to the limitations in the Glencoe Village Code; and
         (i)   Driveways, parking lots, and parking areas subject to the limitations of Section 5-104 of this Code; and
         (j)   Hedges; and
         (k)   Canvas or similar readily movable awnings and canopies attached by temporary supports to the exterior wall of a building and not extending more than 72 inches from such wall; provided that the bottom of the structural elements of any awning or canopy (other than ground supports) shall be maintained at least seven feet above grade and all other elements thereof shall extend at least six and one-half feet above grade.
      5.   Platted Building Lines. See Subsection 8-101F of this Code.
      6.   Front and Corner Side Yard Adjustments.
         (a)   B-1 District. Where the setback requirements of this Code differ from two adjoining lots, or where the side yard of one lot is less than the front yard required along the same street for an adjoining lot, the side lot line of the second lot being formed partially or wholly by the rear lot line of the first mentioned lot, the building line for the lot on which the deeper setback is required shall be modified for a distance of not more than 60 feet from the lot line of the adjoining lot, to lie halfway between the lesser and the greater of the two required building lines.
         (b)   B-2 District. On corner lots, a setback line is here established at a distance from the corner defined by a triangle formed by two lines each 30 feet in length measured along the two street lines and a third line connecting the first two such lines.
      7.   Side Yards. Whenever a side yard is provided on a lot, said side yard shall be not less than five feet wide.
      8.   Alley. In computing the depth of the rear yard or of a side yard or open court for any building where such yard or court opens onto an alley, one-half of the alley width may be assumed to be a portion of the yard or court.
      9.   Exception to Rear Yard Requirements. In the case of a through lot in the B-1 District, there shall be a rear yard having a depth equal to the required front yard for such lot.
      10.   Courts. The following regulations shall apply to outer and inner courts in business districts:
         (a)   Outer Court. The width of an outer court shall not be less than five feet nor less than one-sixth the length of such court from the closed end.
         (b)   Inner Court. An inner court shall not be less than five feet wide, nor shall its area be less than 50 square feet.
      11.   Dwelling Units in Multiple Family Dwellings. No dwelling unit in a multiple family dwelling hereafter erected, constructed, or created in any business district shall have a gross floor area of less than 600 square feet if an efficiency dwelling unit; 800 square feet if a one-bedroom dwelling unit; or 800 square feet plus an additional 150 square feet for every bedroom in excess of the first bedroom if a two or more bedroom dwelling unit.
