GENERAL PROVISIONS

§ 12.04.010 CITATION:

This title of the Gonzales municipal code shall be known and cited as the GONZALES ZONING ORDINANCE.

§ 12.04.020 AUTHORITY:

This title is adopted pursuant to the authority contained in California Government Code section 65850 et seq.

§ 12.04.030 PURPOSES:

The purpose of this title is to protect and to promote the public health, safety, peace, comfort, convenience, prosperity, and general welfare. More specifically, this title is adopted in order to achieve the following objectives:
A. 
To provide a precise guide for the physical development of the city in such a manner as to achieve progressively the arrangement of land uses depicted in the Gonzales general plan consistent with the goals and policies of the general plan.
B. 
To foster a harmonious, convenient, and workable relationship among land uses.
C. 
To promote the stability of existing land uses that conform with the general plan and to protect them from inharmonious influences and harmful intrusions.
D. 
To ensure that public and private lands are ultimately used for the purposes which are most appropriate and most beneficial from the standpoint of the city as a whole.
E. 
To promote a safe, effective traffic circulation system.
F. 
To foster the provision of adequate off street parking and off street loading facilities.
G. 
To facilitate the appropriate location of community facilities and institutions.
H. 
To protect and enhance real property values.
I. 
To safeguard and enhance the appearance of the city.

§ 12.04.040 APPLICABILITY:

This title shall apply, to the extent permitted by law, to all property in incorporated Gonzales, whether owned by private persons, firms, corporations, or organizations; by the United States or any of its agencies; by the state of California or any of its agencies or political subdivisions; by any county or city, including the city of Gonzales; or by any authority or public entity organized under the laws of the state of California. Any governmental agency shall be exempt from the provisions of this title only to the extent that such property may not be lawfully regulated by the city of Gonzales.

§ 12.04.050 COMPLIANCE WITH TITLE:

A. 
It shall be unlawful for any building or structure to be moved, erected, used, altered, enlarged, or rebuilt or for any use to be established or changed that does not strictly conform to the provisions of this title.
B. 
It shall be unlawful for any yard, open space, or land to be used for any purpose or in any way not specifically permitted by this title.
C. 
No department, official, or employee of the city vested with the duty or authority to issue permits or licenses for buildings, structures, or uses subject to the requirements of this title shall issue a permit or license in conflict with the provisions of this title; any permit or license issued in conflict with any provision of this title shall be null and void. Further, no permit or license shall be issued by any department, official, or employee of the city for any building, structure, or use subject to the requirements of this title on a parcel of land where the department, official, or employee is aware that a violation of this title exists.
D. 
Notwithstanding the foregoing, in considering the issuance of permits or licenses for buildings, structures, or uses associated with subdivision projects of more than two hundred (200) units for which a tentative subdivision map was approved prior to August of 2000, the planning director shall be vested with the discretion to administratively reconcile conflicts between the provisions of this title and its predecessor. Such discretion may only be exercised in instances in which a real conflict exists between the new and previous provisions of this title, and reconciliation shall be limited to application of either the new or previous code provisions, as determined to be appropriate by the planning director.

§ 12.04.060 RELATIONSHIP TO OTHER REGULATIONS AND REQUIREMENTS:

A. 
The regulations of this title and requirements or conditions imposed pursuant to this title shall not supersede any other regulations or requirements adopted or imposed by the Gonzales city council, any board, commission, or department of the city, or any other local, state, or federal agency that has jurisdiction by law over uses and development authorized by this title. All uses and development authorized by this title shall comply with all other such regulations and requirements. Where two (2) or more ordinances regulate the same use or activity, the more restrictive ordinance shall apply.
B. 
Nothing contained in this title shall be deemed to repeal or amend any regulation of the city requiring a permit or license or both for any business, trade, or occupation nor shall anything in this title be deemed to repeal or amend the building code of the city.
C. 
In no case shall the time limit for action required by this title for any approving body exceed time limits as set forth in California Government Code section 65920 et seq., otherwise known as the permit streamlining act.

§ 12.04.070 BUILDINGS UNDER CONSTRUCTION:

Any building or structure for which a building permit has been issued prior to the effective date of this title may be completed and used in accordance with the plans, specifications, and permits on which said building permit was granted, if construction is commenced within one year after the issuance of said permit and diligently pursued to completion. No extensions of time shall be granted for commencement of construction.

§ 12.04.080 FEES:

The city council shall establish by resolution, and may amend and revise from time to time, fees for processing the various applications authorized or required by this title. All fees shall be paid at the time an application is filed, and no processing shall commence until the fee is paid in full.

§ 12.04.090 PERMIT STREAMLINING ACT:

It is the intent of this title that all actions taken by the decision making body pursuant to this title that are solely adjudicatory in nature be within a time frame consistent with the provisions of California Government Code section 65920 et seq., (the permit streamlining act). Nothing in this title shall be interpreted as imposing time limits on actions taken by the decision making body pursuant to this title that are legislative in nature or that require both adjudicatory and legislative judgments.

§ 12.04.100 ENFORCEMENT:

Where the planning director determines that a violation of this title is occurring, he/she shall take the following actions:
A. 
Abatement: Commence abatement procedures in accordance with chapter 5.20, "Public Nuisances", of this code.
B. 
Violations; Type Of Penalty: Any violations of the provisions of this title are declared to be public offenses and infractions enforced and punishable in the manner prescribed by this city code, the Penal Code, and the Government Code of the state of California. Any violation of the provisions of this title, which would otherwise be an infraction, is a misdemeanor if a person has been convicted of three (3) or more violations of this title, or any other provision of this code, within the twelve (12) month period immediately preceding the commission of the offense and such prior convictions are admitted by the defendant or alleged in the accusatory pleading. Any such person shall be deemed to be guilty of a separate offense for each and every day during any portion of which any violation of this title is committed, continued or permitted by such person, and shall be punishable as herein provided.
C. 
Contents Of Notices: All notices sent pursuant to this chapter shall be clear and simple, shall include complete information, and shall clearly identify the violation, action required, time periods allowed, and potential punishment for failure to comply. Compliance dates shall be measured from the date of signature on certified mail, or date of personal service.
D. 
Additional Actions: The rights, remedies, sanctions, penalties and actions provided herein shall be in addition to those otherwise provided by law.

§ 12.04.110 OCCUPANCY AND MAINTENANCE:

A. 
Compliance With Requirements: No building or use shall be occupied or begun until all applicable requirements of this title have been met. All uses and projects shall be constructed and maintained according to the provisions of this title, and the conditions, plans and descriptions accompanying the approval. Failure to do so shall be deemed a violation subject to enforcement as specified in this chapter.
B. 
Nuisance Declared: Any building or structure constructed, erected, altered, moved or maintained contrary to the provisions of this title, any property used contrary to the provisions of this title, or any failure to comply with any conditions attached to the granting of a development permit, special use permit or variance, shall be, and the same is hereby declared to be, unlawful and a public nuisance.

§ 12.04.120 DENIAL AND REAPPLICATION:

Reapplication shall not be made for any matter denied pursuant to this title for a period of one year, except upon a finding by the planning commission or city council that there has been a substantial change in conditions or the content of the application such that early rehearing would be justified.

§ 12.04.130 PLANNING COMMISSION:

Pursuant to Government Code sections 65000 et seq., and section 2.04.010 of this code, there is hereby established a Gonzales planning commission.
A. 
Appointment: Effective April 1, 2003, the planning commission shall consist of five (5) members. All current commission members whose staggered appointed terms, made pursuant to former Gonzales municipal code section 17.04.036 or subsequent council action, have not expired as of said date, shall continue to serve for the duration of their terms. With respect to all vacancies on the commission existing as of April 1, 2003, as well as all vacancies or expired terms from said date forward, commission members shall be nominated by the mayor and appointed thereafter by approval of a majority of the members of the city council. Commission members shall be appointed for a term of four (4) years. If a vacancy occurs other than by expiration of term, it shall be filled by appointment for the unexpired portion of the term.
B. 
Members, Removal From Office: Although a member shall be appointed for a term, he or she serves at the pleasure of the city council and may be removed with or without specific cause prior to the expiration of said term by a majority vote of the city council. All members are subject to the residency and attendance requirements set forth in sections 2.04.020 and 2.04.030 of this code.
C. 
Bylaws: The planning commission shall adopt a set of bylaws governing its organization and operation which shall be consistent with state law and city ordinances and resolutions. These bylaws shall be adopted by a majority vote in the form of a resolution which shall be kept on file at city hall by the city clerk.
D. 
Meetings And Records: The planning commission shall hold at least one meeting each month and such other meetings as may be necessary. The planning commission shall keep a public record of its resolutions, transactions, findings and determinations. For purposes of transacting business, a quorum of at least three (3) commission members must be present at any given meeting.
E. 
Secretary: The city clerk shall serve as secretary to the planning commission and shall record the minutes of the meetings of the planning commission and maintain all planning commission records.
F. 
Functions:[1] The planning commission shall perform those functions described by the planning and zoning law, including those functions specified in Government Code section 65103, as well as all functions specified by this code and any city ordinance or resolution.

§ 12.04.140 SEVERABILITY:

If any section, subsection, paragraph, sentence, clause, or phrase of this title is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this title. The city council hereby declares that it would have passed this title, and each section, subsection, sentence, clause, and phrase thereof, regardless of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared invalid or unconstitutional.

§ 12.04.150 VIOLATIONS; PROSECUTION:

Any person using any building, structure, or parcel of land in violation of any provision of this title shall be prosecuted to the fullest extent of the law.

§ 12.08.010 INTERPRETATION:

A. 
For the purpose of this title, certain words and terms used herein are defined in the following sections:
B. 
Words used in the present tense include the future, words in the singular number include the plural, and words in the plural number include the singular, unless the natural construction of the wording indicates otherwise.
C. 
The word "shall" is mandatory and not discretionary.
D. 
The word "may" is permissive and leaves the action fully to the discretion of the city or other agency involved.

§ 12.08.020 TERMS DEFINED:

ACCESSORY DWELLING UNIT (ADU):
An attached or detached residential dwelling unit that provides complete independent living facilities for one or more persons and is located on a lot with a proposed or existing primary residence. It shall include permanent provisions for living, sleeping, eating, cooking, and sanitation on the same parcel as the single-family or multifamily dwelling is or will be situated. An ADU also includes the following:
A. An efficiency unit.
B. A manufactured home, as defined in Cal. Health & Safety Code § 18007.
ACCESSORY STRUCTURE:
A building which is subordinate to, and the use of which is incidental to, that of the principal building or the principal use of the same lot or building site. No building in an R district which contains a dwelling unit shall be deemed to be an accessory building. (See illustration.)

ACCESSORY USE:
A use incidental and subordinate to the principal use of the premises, which does not alter the characteristics of the use, considered as a whole and as related to other uses permitted in the same district.
ADULT ENTERTAINMENT FACILITY:
Any facility which includes an adult bookstore, an adult motion picture theater, an adult live entertainment establishment or any other place of business of any similar purpose, operation or function, with or without an alcohol license, where a substantial portion of its trade consists of materials or entertainment which is distinguished or characterized by the emphasis on matters or acts depicting, describing or relating to sexual activities and that portray actual or simulated anatomical genital areas, pubic regions, buttocks, anus or breasts.
AGRICULTURAL SERVICES:
Services that support the agricultural industry such as labor contractors, testing labs, retail establishments specifically related to growing crops, etc.
AGRICULTURE:
The tilling of soil, the raising of crops, horticulture, small livestock farming, dairying or animal husbandry, including all uses customarily incidental thereto, but not including slaughterhouses, feed yards, hog farms, fertilizer works, bone yards or plants for the reduction of animal matter or any other industrial or agricultural use which is determined by the planning commission to be similarly objectionable because of noise, odor, smoke, dust or fumes.
ALLEY:
A public thoroughfare, not exceeding thirty feet (30') in width, for the use of pedestrians and/or vehicles, which affords only a secondary means of access to the abutting property.
AMBULANCE SERVICE:
Any business substantially devoted to providing emergency medical care and transportation, including incidental storage and vehicle maintenance.
ANIMAL SALES AND SERVICE:
Animal Boarding:
Provision of shelter and care for domestic animals on a commercial basis. This classification includes activities such as feeding, exercising, grooming, and incidental medical care.
Animal Grooming:
Provision of bathing and trimming services for domestic animals on a commercial basis. This classification includes boarding of domestic animals for a maximum period of forty eight (48) hours.
Animal Hospital:
Establishment where domestic animals receive medical and surgical treatment. This classification includes only facilities that are entirely enclosed, soundproofed and air conditioned. Grooming and temporary (thirty (30) days) boarding of animals is included if incidental to the hospital use.
Animal Retail Sales:
Retail sales of domestic animals, provided such activities take place within an entirely enclosed building. This classification includes grooming if incidental to the retail use.
ANIMALS:
Domestic:
Small animals of the type generally accepted as pets, including, but not limited to, dogs, cats, rabbits, fish, and birds but not including chickens, ducks, geese, pea fowl, goats, sheep, and hogs. Domestic animals shall not include any animals, birds or fish maintained for commercial purposes.
Exotic:
Any wild animal not customarily confined or cultivated by man but kept as a pet or for display.
APARTMENT:
A dwelling unit in a multi-family building.
APARTMENT HOUSE:
See definition of "Residential, Multi-Family."
APPEAL BODY:
A group of city officials appointed with the task of conducting appeal hearings.
ARTIST STUDIO:
Work space for artists and artisans, including individuals practicing one of the fine arts or performing arts, or skilled in an applied art or craft.
ATTACHED STRUCTURE:
Whenever this code requires a room or dwelling unit to be attached to any other structure on the property, the connecting portion must meet all of the following conditions:
A. Be permanently roofed;
B. Be enclosed on no less than two (2) sides with walls;
C. Be not more than twenty feet (20') in length;
D. Be not less than eight feet (8') in width.
AUTOMOBILE AND TRAILER SALES AREA:
An open area used for the display, sale or rental of new or used automobiles or trailers, and where repair work is limited to minor incidental repair of automobiles or trailers to be displayed, rented or sold on the premises.
AUTOMOBILE REPAIR:
See definition of "Motor Vehicle Repair."
AUTOMOBILE SALES AND SERVICE:
Sale or rental of automobiles, motorcycles, trucks, and recreational vehicles, including storage and incidental maintenance.
AUTOMOBILE SELF-SERVICE STATION:
An establishment where liquids used as motor fuels are stored and dispersed into the fuel tanks of motor vehicles by persons other than the service station attendant and may include facilities available for the sale of other retail products.
AUTOMOBILE SERVICE STATION:
A place where motor fuel, lubrication or grease is offered for sale to the public and delivered to the public and where minor auto vehicle repair and retail is an accessory use to the sale and delivery of motor fuel, oil and grease.
AUTOMOBILE SERVICE STATION/CONVENIENCE FOOD STORE:
A place where motor fuel, lubrication or grease is offered for sale to the public and delivered to the public and where minor auto vehicle repair and retail establishments are an accessory use to the sale and delivery of motor fuel, oil, and grease.
AUTOMOBILE STORAGE:
Lots for storage or parking of tow away vehicles, impound yards, and storage lots for automobiles, trucks, buses, and recreational vehicles.
AUTOMOBILE WASHING:
Washing, waxing, detailing or cleaning of automobiles or similar light vehicles, including the use of mechanical automobile washers.
AUTOMOBILE WRECKING:
See definition of "Junkyard."
BAKERY:
Retail Bakery:
A sales facility which offers bakery products only for direct sale to the public and which, as an accessory use, may include the preparation of products normally sold in bakeries for sale off the premises. Retail bakeries shall not devote over twenty percent (20%) of their gross output to the preparation of bakery products for sale at other locations.
Wholesale Bakery:
A bakery or other food store which devotes over ninety percent (90%) of its gross floor area to the preparation of bakery products for sale at other locations. Wholesale bakeries may offer bakery products for direct sale to the public.
BAR/COCKTAIL LOUNGE:
An establishment wherein alcoholic beverages are sold at retail for consumption on the premises, and minors are excluded by law.
BASEMENT OR CELLAR:
A story partly or wholly underground, and having more than one-half (1/2) of its height below the average level of the adjoining ground. A basement, when designed for or occupied by dwellings, business or manufacturing, shall be considered a story.
BED AND BREAKFAST:
A bed and breakfast is a small lodging establishment that offers overnight accommodation and breakfast. Bed and breakfasts are often private family homes and typically have between four (4) and eleven (11) rooms, with six (6) being the average. In addition, a B&B has the hosts living in the house.
BILLBOARDS:
See "sign" related definitions in section 12.116.020.
BLOCK:
That property so designated on an official map of the city or part of the city, or bounded by streets, or by a street or streets and railroad right-of-way, canal right-of-way, or unsubdivided acreage.
BOARDINGHOUSE:
A building, other than a hotel or restaurant, where meals or lodging, or both meals and lodging, are provided for compensation for four (4) or more persons. The term does not include such uses as rest home, convalescent home or home for the aged.
BUILDING:
Any structure built for the shelter or enclosure of persons, animals, fowl, chattels, or property of any kind.
BUILDING, ACCESSORY:
See definition of "Accessory Structure."
BUILDING HEIGHT:
The vertical distance from the average level of the highest and lowest point of that portion of the lot covered by the structure to the apex of the structure.
BUILDING HEIGHT, SECOND DWELLINGS ABOVE GARAGES:
When a second dwelling is located above a garage, the height shall be determined as the vertical distance from the floor of the second dwelling unit to the apex of the structure.
BUILDING, MAIN:
A building in which is conducted the principal use of the lot on which it is situated.
BUILDING MATERIALS AND SERVICES:
Retailing or wholesaling of building supplies or equipment. This classification includes lumber yards, tool and equipment sales establishments, and building contractors' yards but excludes establishments devoted exclusively to retail sales of paint and hardware.
BUILDING SITE:
The land area, consisting of one or more lots or parcels of land under common ownership or control, to be considered as the unit of land occupied by a main building or buildings and accessory buildings, or by a principal use and uses, together with all yards, parking spaces and other open spaces required by this title.
BUNGALOW COURT:
A group of two (2) or more detached or semidetached one family, two (2) family or multiple-family dwellings, occupying a parcel of land in one ownership and having any yard or court in common, including house courts and apartment houses, but not including automobile courts.
BUSINESS OR COMMERCE:
The purchase, sale or handling (other than commodity for profit, but not including junkyards) or the rendering of any service for compensation including offices and office buildings, amusement enterprises, and outdoor advertising signs and structures.
CAMP, PUBLIC:
Land or premises used or intended to be used, let or rented for camping purposes by two (2) or more camping parties, trailers, tents or movable or temporary dwellings.
CARPORT:
A permanent roofed structure with no more than two (2) enclosed vertical sides, used or intended to be used for automobile shelter and storage.
CATERING SERVICES:
Preparation and delivery of food and beverages for off site consumption without provision for on site pick up or consumption.
CEMETERY:
Land used or intended to be used for the burial of the dead, and dedicated for cemetery purposes, including columbariums, crematoriums, mausoleums and mortuaries, when operated in conjunction with and within the boundary of such cemetery.
CENTERLINE:
The "centerline" of a street, as referred to in this title, means the right-of-way centerline as established by the county supervisor, by the city engineer, by the state division of highways or, if no such centerline has been established and in any case in which the foregoing definition is not applicable, the planning commission shall designate the centerline.
CERTIFIED FARMER'S MARKET:
A location operated in accordance with chapter 10.5 of division 17 of the Food and Agricultural Code and any regulations adopted pursuant to this chapter, or any successor chapter.
CITY:
The city of Gonzales.
CLUB:
An association of persons, whether incorporated or unincorporated, organized for some common nonprofit purpose, but not including a group organized solely or primarily to render a service customarily carried on as a business.
CODE:
The Gonzales City Code.
COLLECTOR STREET:
A street which, because of its design and location with reference to other streets and other sources of traffic, shall be used to carry traffic from minor streets to a major thoroughfare.
COMMERCIAL SUBDIVISION:
A subdivision in which the primary use of the land is commercial, as defined by the land use ordinance of the city, and in which such other uses may be permitted as are clearly incidental to the commercial development.
COMMUNICATIONS FACILITIES:
Broadcasting, recording and other communication services attained through electronic or telephonic mechanisms but excluding major utilities. This classification includes radio, television or recording studios, and telephone switching centers.
COMPREHENSIVE SIGN PROGRAM:
See "sign" related definitions in section 12.116.020.
CONDITIONAL USE PERMIT:
Permits required for use classifications typically having unusual site development features or operating characteristics requiring special consideration so that they may be designed, located, and operated compatibly with uses on adjoining properties and in the surrounding area.
CONDOMINIUM DEVELOPMENT:
A structure or appurtenant premises divided in ownership by the existence of condominiums, as now or hereafter defined in California Civil Code section 783, and includes instances where ownership is so divided following prior single ownership of the entire structure(s) and premises, as well as new structures and premises so divided in ownership.
CONSTRUCTION SIGN:
See "sign" related definitions in section 12.116.020.
CONVENIENCE STORE:
A retail establishment generally carrying less than a full range of grocery items, usually prepackaged inventory, and intended to provide grocery goods at the convenience of the general public conducting short shopping trips.
COUNCIL, CITY:
The city council of the city of Gonzales.
COURT:
An open, unoccupied space, other than a yard, on the same lot with a building or buildings, which is bounded on two (2) or more sides by such building or buildings, including the open space in a house court or apartment house providing access to the units thereof.
COVERAGE:
The portion of a site covered by building and parking structures, and all built and water impermeable structures and surfaces, and expressed as a percent of the total site area. "Coverage" does not include solar collectors, which do not increase site coverage by more than ten percent (10%).
CUL-DE-SAC:
A street which connects to other streets only at one end, and having provision for a turnaround at its other end.
DAIRY:
Any premises where milk is produced for sale or distribution, and where three (3) or more cows or goats are in lactation.
DAYCARE FACILITY, LARGE:
Any establishment, activity or use of a site providing group daycare services for more than six (6) children other than those resident on the site, including a day nursery, nursery school, play group, or afternoon group.
DAYCARE FACILITY, SMALL:
Any establishment, activity or use of a site providing group daycare services for six (6) or less children other than those resident on the site, including a day nursery, nursery school, play group, or afternoon group.
DECIDING BODY:
The group of city officials appointed with the specific task of hearing and voting to approve or deny those permit applications described in this title.
DIRECTIONAL SIGN, OFF SITE:

DISTRICT:
A portion of the city within which certain uses of land and buildings are permitted or prohibited and within which certain yards and other open spaces are required and certain height limits are established for buildings, all as set forth and specified in this title.
DUPLEX:
A structure containing two (2) dwelling units, each of which has direct access to the outside.
DWELLING:
Any building or portion thereof designed or used exclusively as the residence of one or more persons, including premanufactured housing on a foundation and mobile homes, as that term is defined in California Government Code section 65852.3, but not including a tent or trailer.
DWELLING, SINGLE-FAMILY:
A building designed for or used exclusively for residence purposes by one family or housekeeping unit. Also see "Residential, Single-Family Attached and Detached."
DWELLING UNIT:
One room, or a suite of two (2) or more rooms, designed for or used by one family for living and sleeping purposes, and having one kitchen.
EAVES:
Roof projections which extend beyond the exterior wall plane of a building.
EFFICIENCY UNIT:
A unit that has the same meaning as defined in Cal. Health & Safety Code § 17958.1.
EMERGENCY SHELTERS:
Interim housing interventions, including, but not limited to, navigation centers, bridge housing, and respite or recuperative care that is limited to occupancy of six months or less. No individual or household may be denied emergency shelter because of an inability to pay.

A category of businesses and services including banks, savings and loan associations, thrifts, real estate brokerages, land title companies, escrow companies, and stock and bond offices.
FLOOR AREA RATIO (FAR):
The ratio between the total floor area of a building or buildings located on a lot and the area of that lot in gross square feet. (See illustration below.)

FLOOR AREA, TOTAL:
The sum of the gross horizontal areas of all floors of a building measured from the exterior faces of the exterior walls or perimeters of horizontal surfaces if such horizontal areas are partially or wholly unenclosed.

Any item provided in Health and Safety Code section 113781, or any successor section.
FOOD AND BEVERAGE SALES:
Retail:
Retail sales of food and beverages for off site preparation and consumption. Typical uses include groceries, liquor stores, and delicatessens. Establishments in which twenty percent (20%) or more of the transactions are sales, and prepared food for on site or take out consumption shall be classified as catering services or eating and drinking establishments.
Wholesale:
Wholesale sales of food and beverage goods in quantity for off site preparation and consumption without direct public access.
FOSTER FAMILY HOME:
A state licensed residential facility providing twenty four (24) hour care for six (6) or fewer foster children, which is zoned, leased, or rented and is the residence of the foster parent or parents, including their family, in whose care the children have been placed.
FRONT WALL:
The wall of the building nearest the street upon which the building faces, but excluding certain architectural features as specified in chapter 12.132, Nonconforming Uses.
FUNERAL AND INTERMENT SERVICES:
A building or part thereof used for human funeral services. Such building may contain space and facilities for: (A) embalming and the performance of other services used in preparation of the dead for burial; (B) the performance of autopsies and other surgical procedures; (C) the storage of caskets, funeral urns and other related funeral supplies; and (D) the storage of funeral vehicles, but shall not include facilities for cremation. Where a funeral home is permitted, a funeral chapel shall also be permitted.

HOME OCCUPATION:
A business, profession, or nonprofit organization conducted by the principal resident or residents of a residential unit, subject to the following conditions: (A) no person who is not a principal resident of the residential unit shall be employed; (B) to be conducted wholly within the main residence, and not conducted within a garage, carport, or accessory structure; (C) shall not increase vehicular traffic on the street on which the residential unit is located by more than four (4) individual visits per day, and which does not increase parking demands on the street on which the residential unit is located; (D) shall not include outdoor display, storage, or signage; and (E) shall not create noise levels exceeding levels defined in the general plan, and which does not create dust, vibration, odor, smoke, fumes, glare, electrical interference, fire hazards, or other hazards, nuisances, or disturbances.
HOSPITAL:
An institution providing primary health services and medical or surgical care to people, primarily inpatients, suffering from illness, disease, injury, deformity, and other physical and mental conditions, and including, as an integral component of the institution, related facilities such as laboratories, outpatient facilities or training facilities.

A facility providing transient lodging accommodations on a daily rate for twenty eight (28) or fewer days to the general public in a building or portion thereof in which access is provided through a common entrance, lobby or hallway.

A dwelling other than a hotel where lodging and/or meals for three (3) or more persons are provided for compensation.
HUMAN-POWERED DEVICE:
Any device moved by human power, including, but not limited to, a pushcart, wagon, bicycle, tricycle, pedal-driver cart, other nonmotorized conveyance, or other wheeled container or mechanism.

INDUSTRY:
General:
Manufacturing of products primarily from extracted or raw materials, or bulk storage and handling of such products and materials. Uses in this classification typically involve a high incidence of truck equipment bulk fuel. This classification includes chemical laundry and dry cleaning plants, auto dismantling, stonework and concrete products manufacturing, and power generation.
Limited:
Manufacturing of finished parts or products from previously prepared materials and the provision of industrial services, both within an enclosed building. This classification includes processing, fabrication, assembly, treatment, and packaging, but excludes basic industrial processing from raw materials, food processing, and major automobile repair.
INSTITUTIONAL USE:
A public or quasi-public use of a lot or building including government offices, schools, utility facilities, parks, libraries, fire stations, social service organizations, and social services, whether funded by public taxes or private donations.
JUNIOR ACCESSORY DWELLING UNIT (JADU):
A unit that is no more than 500 square feet in size and contained entirely within a single-family residence. A JADU may include separate sanitation facilities or may share sanitation facilities with the existing structure.
JUNKYARD:
Any parcel of land or building for which the principal or accessory use is the abandonment, collection, demolition, dismantlement, keeping, storage, bailment, salvage or sale of used, discarded, worn out or scrapped machinery, vehicles, vehicle parts, scrap metal, chains, used pipes, waste paper, rags, enamelware, furniture, bottles, cans, rope, iron, copper or other scrap or discarded materials.
KITCHEN:
Any portion of a structure with any combination of the following: sink (other than that appurtenant to a bathroom), food storage and preparation areas, refrigerator, or cooking appliances including a stove, microwave oven, convection oven, cooking burners, or similar appliances which may reasonably be used for the preparation of food. A separate or second kitchen does not exist if one or more of the following applies: (A) a permanent interior access is provided throughout the living unit; and (B) configuration of appliances clearly indicates that the space is an office or guest room, and will not and cannot be used as a separate living unit. Outdoor structures, not suitable for habitation (e.g., pool cabanas, tool storage areas, workshops, and other improvements unsuitable for habitation) are not deemed second units. Interpretation of whether or not an area is or is not a separate kitchen shall be by the planning director pursuant to this definition.
LABORATORIES:
Establishments providing medical or dental laboratory services or establishments providing photographic, analytical or testing services.
LANDSCAPING:
The planting and maintenance of trees, shrubs, lawns, and other evergreen ground cover or material, including inorganic accessory materials utilized to access or complement the vegetation.
LIVABLE SPACE:
A space in a dwelling intended for human habitation, including living, sleeping, eating, cooking, or sanitation.
LIVESTOCK FARMING:
Keeping of farm animals for use, for propagation, or for intended profit or gain, and without limiting the generality of the foregoing including: dairy and beef cattle, horses, swine, sheep, laying hens, chicken and turkey broilers, turkeys, goats, geese, mink and rabbits.
LIVING AREA:
The interior habitable area of a dwelling unit, including basements and attics, but does not include a garage or any accessory structure.
LOCAL AGENCY:
A city, county, or city and county, whether general law or chartered.
LOT:
Land occupied or to be occupied by a building and its accessory buildings, or by a dwelling group and its accessory buildings, together with such open spaces as are required under the provisions of this title and having its principal frontage on a street. "Lot" includes the word "plot."
LOT AREA:
The total horizontal area included within lot lines.
LOT, CORNER:
A lot bounded on two (2) or more adjacent sides by street lines; provided, that the angle of intersection does not exceed one hundred thirty five degrees (135°) and having a width of not greater than seventy four feet (74'). (See illustration below.)
LOT CORRIDOR:
A lot with access to a street by means of a strip of land having less frontage or width than required for the parcel by this title. (See illustration below.)

A housing-first, low-barrier, service-enriched shelter focused on moving people into permanent housing that provides temporary living facilities while case managers connect individuals experiencing homelessness to income, public benefits, health services, shelter, and housing.
MAIL SERVICE:
A business whose primary activity is providing postage and delivery of letters and packages.
MAINTENANCE AND REPAIR SERVICE:
Major:
Facilities providing equipment maintenance and repair services and materials storage areas. This classification includes corporation yards, equipment service centers and the like and excludes maintenance and repair of motor vehicles.
Minor:
Establishments providing appliance repair, office machine repair or building maintenance service. This classification excludes maintenance and repair of motor vehicles.
MANUFACTURE:
The preparation, making, treatment or processing of articles as merchandise.
MANUFACTURED STRUCTURE:

MEDICAL CLINIC:
A clinic is a healthcare facility that is primarily focused on the care of outpatients. Clinics can be privately operated or publicly managed and funded. They typically cover the primary healthcare needs of populations in local communities, in contrast to larger hospitals which offer specialized treatments and admit inpatients for overnight stays.
MERCHANDISE:
Any non-food item that can be sold and immediately obtained from a sidewalk vendor which is not considered food.
MINI-WAREHOUSE:
A building containing separate spaces of like or varying sizes which are leased or rented on an individual basis and used for the temporary storage of goods and materials.
MOBILE HOME:

MOTEL:
A facility providing transient lodging accommodations on a daily rate for twenty eight (28) or fewer days to the general public in one or more buildings on the same lot. The buildings contain guest rooms or dwelling units, or both, which are usually individually and independently accessible from outside the building. "Motel" includes motor lodge, tourist court, motor hotel or any other designation intended to identify the premises as providing for rental of overnight accommodation primarily to motorists.
MOTOR VEHICLE REPAIR:

Any activity combining minor and major motor vehicle repair shall be defined as "major motor vehicle repair."
Major:
A place providing a full range of repair and maintenance services for motor vehicles, including the following:
A. Cylinder head replacement.
B. Valve grinding or replacement.
C. Clutch replacement.
D. Repair, replace transmission, rear end, rear axles, kingpins.
E. Body work.
F. Engine or transmission removal.
G. Fuel tank repair.
H. Radiator or heater core repair or replacement.
I. Painting.
J. Repair activities that require entry in the engine other than those specifically listed as approved minor automobile repair.
Minor:
A place performing the following repair and maintenance services for motor vehicles, including the following:
A. Tune ups. Major and minor tune up involving spark plugs, points, condensers, valve adjustment, carburetor overhaul, adjustment of fuel injections systems, fuel pump and all necessary filters.
B. Lubrication. Oil changes and filter replacement, transmission, and rear end oil change.
C. Cooling system. Remove and replace radiator and repair of same; replace water pump, heater and other hoses; replace thermostats; recharge air conditioners.
D. Drive train. Replacement of transmission and motor support mounting; replacement of drive shaft universal bearings, center support bushing, accelerator and brake cables; minor repair of hydraulic systems; replacement of shock absorbers.
E. Brakes. Remove and replace shoes and brake pads; rebuild master and wheel cylinders and disc caliper; adjustment of brakes; machine work related to turning of drums or discs.

An establishment serving alcoholic beverages in which the principal business is the sale of such beverages for consumption on the premises and where a dance floor or entertainment is provided.
NONCONFORMING BUILDING:
A building, or portion of a building, which was constructed, or structurally altered, in a manner consistent with land use regulations and development standards in effect at the time of the construction or structural alteration but which does not conform to the current development standards of the district in which it is located. NONCONFORMING STRUCTURE:

OFFICE, BUSINESS AND PROFESSIONAL:
A building or portion of a building wherein services are performed involving predominantly administrative, professional or clerical operations, including and of the same general character as a real estate and insurance agency, accounting firm, business consultant, travel bureau, employment agency, etc., but not including wholesale or retail activities involving stock in trade on the premises.
OFFICE, MEDICAL:
An office or building containing offices where medical and health related services are provided to individuals by physicians, surgeons, dentists, psychologists, and persons practicing the healing arts, but not including medical and dental laboratories and clinics.
ONE OWNERSHIP:
Ownership of property (or possession thereof under a contract to purchase or under a lease the term of which is not less than ten (10) years) by a person or persons, firm, corporation or partnership, individually, jointly, in common, or in any other manner whereby such property is under single or unified control. PARKING GARAGE, COMMERCIAL:
A public or private parking garage used for the commercial business of parking motor vehicles for periods not exceeding twenty two (22) hours during any one day. Also includes "parking garage."
PARKING LOT:
A lot or portion of a lot designed exclusively for the parking of motor vehicles and paved with a permanent all weather surface as may be approved by the public works director.
PARKING LOT, COMMERCIAL:
A public or private parking lot used for the commercial business of parking motor vehicles for periods not exceeding twenty two (22) hours during any one day.
PARKING SPACE:
An area designed for the parking of motor vehicles having unobstructed access to a public street, way, or access easement at all times, and having a minimum width of eight feet (8'), a minimum length of eighteen feet (18'), and a minimum vertical clearance of seven feet (7'), and either within a garage or carport, or uncovered, and paved with a permanent all weather surface as may be approved by the public works director.
PASSAGEWAY:

A state licensed facility which provides an organized program of therapeutic social and day health activities and services and limited twenty four (24) hour inpatient respite care for medically fragile children twenty one (21) years of age or younger, including terminally ill and technology dependent children.
PERMITTED USE:
A use by right which is specifically authorized in a particular zoning district.
PERMITTING AGENCY:
Any entity that is involved in the review of a permit for an accessory dwelling unit or junior accessory dwelling unit and for which there is no substitute, including, but not limited to, applicable planning departments, building departments, utilities, and special districts.
PERSONAL IMPROVEMENT SERVICES:
Services or facilities including photography, fine arts, crafts, dance or music studios, driving schools, diet centers, and the like.
PERSONAL SERVICES:
Establishment providing recurrently needed services of a personal nature, generally including barber and beauty shops, seamstresses, tailors, shoe repair shop, dry cleaning (except bulk processing plants), photocopying, and self-service laundries.
PHARMACY:
A business whose primary activity is the preparing and dispensing of prescription drugs.
PLANNING COMMISSION:

RESIDENTIAL CARE FACILITY, LARGE:
Any use, including supportive and transitional housing, of a residential unit serving seven (7) or more persons on a twenty four (24) hour per day basis. Also includes "dwelling group." Also includes a state-authorized, certified or licensed family care home, foster home, or a group home serving seven (7) or more disabled persons or dependent and neglected children on a twenty four (24) hour a day basis.
RESIDENTIAL CARE FACILITY, LICENSED:
Any family home, group care facility, or similar facility, licensed by the state, that is maintained and operated to provide 24 hour nonmedical care of persons in need of personal services, supervision, or assistance essential for sustaining the activities of daily life or for the protection of the individual. A large licensed residential care facility serves seven or more clients, while a small licensed residential care facility serves six or fewer clients.
RESIDENTIAL CARE FACILITY, SMALL:
Any use, including supportive and transitional housing, of a residential unit serving six (6) or fewer persons on a twenty four (24) hour per day basis. A small residential care facility is a state mandated residential use of the property. Also includes "dwelling group." Also includes a state-authorized, certified or licensed family care home, foster home, or a group home serving six (6) or fewer disabled persons or dependent and neglected children on a twenty four (24) hour a day basis.
RESIDENTIAL CARE FACILITY, UNLICENSED:
Any family home, group home, group care facility, or similar facility, not required to be licensed by the state and operated as a single housekeeping unit, maintained and operated to provide 24 hour nonmedical care of persons in need of personal services, supervision, or assistance essential for sustaining the activities of daily life or for the protection of the individual.
RESIDENTIAL, CONDOMINUM:
Refer to "Condominium Development."
RESIDENTIAL DISTRICT:
Any area zoned exclusively as residential in title 12, Zoning Regulations.
RESIDENTIAL, MANUFACTURED STRUCTURE:
A residential unit constructed off site and delivered and installed on a lot. State law mandates that cities allow the installation of manufactured homes certified under the National Manufactured Housing Construction and Safety Standards Act of 1974 on a foundation system, pursuant to California Health and Safety Code section 18551 on lots zoned for conventional single-family residential dwellings; also includes "residential, mobile home."
RESIDENTIAL, MOBILE HOME:
A trailer coach that is used as a dwelling all the year round, has water faucets and shower or other bathing facilities that may be connected to a water distribution system, and has facilities for washing and a water closet or other similar facility that may be connected to a sewerage system.
RESIDENTIAL, MULTI-FAMILY:
A building having four (4) or more independent and attached residential units.
RESIDENTIAL SECOND UNIT:
An additional separate living unit with kitchen and full bathroom facilities within the R-1 district, whether within the main structure or as a separate structure on the lot. Also includes "second unit."
RESIDENTIAL, SHORT-TERM RENTAL:
Consists of a dwelling, or portion of a dwelling unit, rented for a period of less than thirty (30) days.
RESIDENTIAL, SINGLE-FAMILY ATTACHED:
A building containing two (2) or three (3) independent and attached residential units. Also includes "duplex" and "triplex." Also includes "employee housing, small."
RESIDENTIAL, SINGLE-FAMILY DETACHED:
A detached residential unit. Also includes "employee housing, small."
RESIDENTIAL, SINGLE-ROOM OCCUPANCY (SRO):
A residential facility in which furnished rooms are rented on a weekly or monthly basis and which provides common facilities and services for laundry, cleaning and cooking.
RESIDENTIAL UNIT:
A building, or portion of a building, designed for occupancy as living quarters by one household and having no more than one kitchen and at least one bathroom. A residential unit may be either detached, attached, multi-family, or may be a manufactured structure. A dwelling unit may be owned, either wholly or as part of a condominium or stock cooperative, or may be rented as an apartment. Also includes "dwelling unit."
RESTAURANT:
An establishment that serves food and beverages primarily to persons seated within the building or for take out consumption. This includes cafes, tea rooms, and outdoor cafes.
RESTAURANT, FAST FOOD:
An establishment whose principal business is the sale of foods, frozen desserts or beverages in ready-to-consume individual servings, for consumption either within the restaurant building or for carry out, and where either: (A) foods, frozen desserts or beverages are usually served in paper, plastic or other disposable containers and where customers are not served their food, frozen desserts or beverages by a restaurant employee at the same table or counter where the items are consumed; or (B) the establishment includes a drive-up or drive-through service facility or offers curb service.
RETAIL SALES:
The retail sale of merchandise not specifically listed under another use classification. This classification includes department stores, clothing stores and furniture stores, and businesses retailing the following goods: toys, hobby materials, handcrafted items, jewelry, cameras, photographic supplies, electronic equipment, audio and video sales and rentals, sporting goods, kitchen utensils, hardware, appliances, antiques, art supplies and services, paint and wallpaper, carpeting and floor covering, office supplies, bicycles, new automotive parts and accessories (excluding service and installation) and the like.
RETAIL SALES FOR INDUSTRIAL USES:
This category of retail, which serves the ag industry and is commonly referred to as "farm supply," shall be a permitted use in commercial and industrial districts. However, this use will not be allowed in the neighborhood commercial districts.
ROAMING SIDEWALK VENDOR:
A sidewalk vendor who moves from place to place and stops only to complete a transaction.
SALVAGE AND WRECKING YARD:
The use of a lot or contiguous lots or any portion thereof for the storage of junk, including scrap materials, and/or for the dismantling or wrecking of automobiles or other vehicles, machinery, and the like.
SCHOOL, PRESCHOOL:

SCHOOL, PRIVATE:
A school operated by a private agency or organization which serves as an alternative to public education for kindergarten through twelfth grade or as a technical training school.
SCHOOL, PUBLIC:
A school operated by a public agency under provisions of the California Education Code.
SCHOOL, RELIGIOUS:
A school whose curriculum focuses on religious or spiritual teachings associated with texts recognized as sacred by the congregation of the religious organization operating the school.
SECOND UNIT:

SECONDHAND STORE:
An establishment engaged in the sale or trade of used clothing, furniture, appliances, and other goods.
SERVICE STATION:

SETBACK:
A distance established by the provisions of this title to govern the placement of buildings and other improvements on lots with respect to property lines, streets, ways, or access easements.
SHALL:
"Shall" is mandatory and not discretionary.
SHARED PARKING CONCEPT:
A parking concept that uses the same parking lot or parking space(s) to satisfy parking requirements for more than one use. Uses that share the same parking space must operate at different times of the day so that the parking space serves only one business at a time.
SHOPPING CENTER:
A facility consisting primarily of retail sales and personal service uses and consisting of two (2) or more lease areas codependent on shared parking, landscaping and signage.
SIDEWALK:
That portion of a street, other than the roadway, set apart by curbs, barriers, markings or other specific delineation.
SIDEWALK VENDING RECEPTACLE:
A pushcart, stand, display, pedal-driven cart, wagon, showcase, rack, or other nonmotorized conveyance used for sidewalk vending activities.
SIDEWALK VENDOR:
A person who vends goods or merchandise upon a public sidewalk, including, but not limited to, vending from a structure, stand, display, showcase, rack, human-powered device or other means.

SINGLE-ROOM OCCUPANCY (SRO):

SITE DESIGN:
The design of a site refers to:
A. Street alignments, grades and widths;
B. Drainage and sanitary facilities and utilities, including alignments and grades thereof;
C. Location and size of all required easements and rights-of-way;
D. Fire roads and firebreaks;
E. Lot size and configuration;
F. Traffic access;
G. Grading;
H. Land to be dedicated for park or recreational purposes; and
I. Such other specific requirements in the plan and configuration of site development as may be necessary or convenient to ensure conformity to or implementation of the general plan.
SITE PLAN PERMIT:
Permits used to ensure that each new or expanded use of a site and each new or expanded structure not requiring a conditional use permit complies with the purposes and intent of the zoning code and the Gonzales general plan. Development issues shall include, but not be limited to, buildings, parking lots and other uses of a property not covered by structures.
SLOPE, AVERAGE:

SPECIAL EVENT:
A city permitted event, including, but not limited to, festivals and/or cultural events.

STATIONARY SIDEWALK VENDOR:
A sidewalk vendor who vends from a fixed location.
STORAGE:
The use of a site or structure, or portion thereof, for the keeping of materials, supplies, inventory, equipment, or other items of personal property owned by the occupant of the site or structure and kept in connection with such occupant's use of the premises. "Storage" does not include any area where merchandise offered for sale is on display or where retail services are otherwise being rendered, nor does the term include any area generally accessible to persons other than the occupants who may lawfully come upon the premises.
STORY:
That portion of a building between any floor and the floor, ceiling or roof next above; provided, that the cellar or basement of a building shall not be deemed a story and provided also that any portion of a story exceeding thirteen feet (13') in height shall be deemed an additional story. STORY, HALF:
A story with at least two (2) opposite exterior sides meeting a sloping roof not more than five feet (5') above the floor of such a story.

STREET:
A public or private thoroughfare which affords principal means of access onto abutting property including avenue, place, way, drive, land, boulevard, highway, road, and any other thoroughfare except an "alley" as defined herein.
STREET FRONTAGE:
That portion of a lot or parcel, typically a property line, which is parallel to and adjoining a public street or way or access easement.
STREET LINE:
The boundary between a street and abutting property.
STRUCTURAL ALTERATION:
Any change in the supporting members of a building, including, but not limited to, bearing walls, shear walls, retaining walls, columns, beams, girders, floor joists, ceiling joists, or roof rafters.
STRUCTURE:
Any improvement constructed or erected so as to project thirty inches (30") or more above the level of the adjoining grade, including, but not limited to, buildings, retaining walls, and decks. Fences shall also be considered structures if the height of the fence is greater than six feet (6') above the level of the adjoining existing grade. Patios, walls, and similar improvements which have a finished height less than thirty inches (30") above the existing grade shall not be considered structures. For the purposes of computing the heights of structures and fences, the existing grade shall be the lower of:
A. The existing ground surface; or
B. The elevation of the existing grade at the time the application for construction of the structure is made.
STRUCTURE HEIGHT:

STUDIO:
A business whose activity includes the creation, display, or sale of items of art.
SUBDIVISION SIGN:

SUBSTANDARD LOT:
A lot existing lawfully at the time of the adoption of the zoning ordinance or amendment, but which does not conform to the lot area, width, access or other development standards of the applicable zoning district.
SUPPORTIVE HOUSING:
Housing with no limit on length of stay, that is occupied by the target population, and that is linked to an onsite or offsite service that assists the supportive housing resident in retaining the housing, improving their health status, and maximizing their ability to live and, when possible, work in the community, as defined in Cal. Health & Safety Code § 50675.14. The provisions for supportive housing shall apply to “permanent supportive housing” as defined in Cal. Gov’t. Code § 65650.
SWAP MEET:
Temporary retail sale or exchange of new, handcrafted or secondhand merchandise.
TANDEM PARKING:
Two or more automobiles are parked on a driveway or in any other location on a lot, lined up behind one another.
TARGET POPULATION:
Persons with lower incomes, as defined in Cal. Health & Safety Code § 50093, who have one or more disabilities, including mental illness, HIV or AIDS, substance abuse, or other chronic health condition, or individuals eligible for services provided pursuant to the Lanterman Developmental Disabilities Services Act (Cal. Welf. & Inst. Code § 4500, et seq.) and may include, among other populations, adults, emancipated minors, families with children, elderly persons, young adults aging out of the foster care system, individuals exiting from institutional settings, veterans, and homeless people.
TEMPORARY USE:
A use of a lot, a portion of a lot, or a building for which the use is deemed to be of short duration. The duration of the temporary use shall be commensurate with the scope of the temporary use. Examples of temporary uses include the selling of Christmas trees, garage sales, and construction trailers during the construction of a building or structure.
TOOL REPAIR, COMMERCIAL:
A business whose primary activity is the repair of commercial instruments used or worked by hand or machinery.
TRANSITIONAL HOUSING:
Buildings configured as rental housing developments, but operated under program requirements that call for the termination of assistance and recirculation of the assisted unit to another eligible program recipient at some predetermined future point in time, which shall be no less than six months, as defined in Cal. Health & Safety Code § 50675.2.
TRIP ENDS:
A total count of the round trips generated by vehicles entering and leaving a property.
TRIPLEX:

TRUCK DEPOT:
A facility used exclusively for breaking down and assembling tractor trailer transport or for parking of heavy vehicles for short periods of time. Truck depots may include fueling facilities, traffic routing offices, restaurants, wash racks, minor repair facilities and related business offices and motels.
TRUCK YARD:
A facility used exclusively for breaking down and assembling tractor trailer transport or for parking of heavy vehicles for short periods of time. "Truck yard" does not include facilities for the loading and unloading of shipments to or from an individual business.
USE:
The purpose for which a lot, or a building located on a lot, is designed, arranged or intended, or for which it is or may be occupied or maintained.

UTILITY SUBSTATION:
A facility, operated by a public or private company, whose business it is to deliver water, gas, electricity, telephone, cable television, or other public utility services which is necessary for the distribution of the service but in which the service is not produced.
VEND OR VENDING:
Any act of hawking, operating noisemaking devices to attract attention to the vendor, or the displaying, selling, or offering for sale of any displayed goods or merchandise to the public from any carrying device, box, bag, stand, human-powered device, or from a vehicle.
VISUAL IMPACT:
The design, arrangement, and location of buildings or other created or natural elements of the urban environment that are sufficiently consistent in scale, character, and siting with other buildings or created or natural elements in the area so as to avoid abrupt or severe differences. This includes materials, colors, landscaping and screening.
WALL, RETAINING:
A structural wall designed to retain earth.
WAREHOUSING AND STORAGE:
A building or group of buildings in a controlled access compound that contains individual compartmentalized stalls which are rented or leased for the dead storage of customer goods or wares and which may include an on site manager's quarters. May also include a building or group of buildings used for storage and distribution of wholesale goods without direct public access. Warehousing and storage does not include direct sales, offices or manufacturing, assembly of goods, animal storage or the use of flammable or hazardous substances or waste.
WATER TANK:
A tank, which may be constructed below grade or wholly or partially above grade, in which is stored water for domestic consumption or irrigation.
WHOLESALE DISTRIBUTION:
A business whose primary activity is the housing of goods for sale in quantity to retailers.
WINDMILL:
A mechanical device powered by the wind that is designed to generate power either for the lot on which the windmill is located or for sale.
WORK CAMP:
Land or premises which is used or intended to be used, let, or rented for occupancy by agricultural workers.
YARD:
An open space other than a court on the same lot with a building which open space is unoccupied and unobstructed from the ground upward, except as otherwise permitted in section 12.112.040. In measuring a yard, as hereinafter provided, the line of a building means a line parallel to the nearest lot line drawn through the point of a building nearest to such lot line, exclusive of the respective architectural features enumerated in section 12.112.040 as not to be considered in measuring yard dimensions or as being permitted to extend into any front or rear yard. (See illustration below.)
YARD, FRONT:
A yard extending across the front of the lot between the inner side yard lines and measured from the front line of the lot to the nearest line of the building; provided, that if any official plan line has been established for the street upon which the lot faces, then such measurement shall be taken from such official plan line to the nearest line of the building. (See illustration below.)
YARD, REAR:
A yard extending across the full width of the lot and measured between the rear line of the lot and the nearest line of the main building. (See illustration below.)
YARD, SIDE:
A yard between the side line of the lot and the nearest line of the building and extending from the front line of the lot to the rear yard. (See illustration below.)
