CHAPTER 4

SETTING PERMIT

3-4-1: SETTING PERMIT REQUIRED:

Any person or persons desiring to cause or permit the construction, major rebuilding, location or replacement of any dwelling house or mobile home or other building, or undertake construction in use of property shall, prior to beginning said construction, rebuilding, or replacement or use of property, obtain a setting permit to conduct said construction, major rebuilding or replacement or use of property from the city staff. Exceptions to the requirement for setting permits may be established by resolution of the city council. (Ord. 2015-4, 8-5-2015)

3-4-2: APPLICATION FOR SETTING PERMITS:

   (A)   Said person or persons desiring to proceed with construction of a structure as mentioned above shall make written application under oath to the council.
   (B)   Such application shall be prepared in writing and shall contain:
      1.   The name, address and phone number of the applicant and of all other owners of an interest in said property.
      2.   A concise and factual description of the applicant's interest in said property.
      3.   Legal description of said real property.
      4.   Existing use.
      5.   Proposed use.
      6.   Use district.
      7.   Plan, drawn to scale, showing the actual dimensions and the shape of the lot to be built upon, the exact size and location of existing buildings on the lot, if any; the location and dimensions of the proposed buildings or alterations.
      8.   Building heights.
      9.   Distance of building or structure from roads.
      10.   Number of off street parking spaces or loading berths.
      11.   Number of dwelling units.
      12.   Written approval by the health authority of proposed sewer and water facilities.
      13.   Estimated cost of improvements. (Ord. 207, 3-17-1987)
      14.   Such other matters as the city staff may require. (Ord. 2015-4, 8-5-2015)
   (C)   Such application shall be made by the filing of the same with the clerk at the office of said clerk in the city hall, Grace, Idaho. (Ord. 207, 3-17-1987)
   (D)   A filing fee pursuant to a schedule as established by resolution of the council shall be paid at the time of filing by the person or persons submitting the application for setting permit. (Ord. 2015-4, 8-5-2015)

3-4-3: REVIEW AND APPROVAL OR DISAPPROVAL OF APPLICATION:

Upon receipt of such an application the city staff shall endorse the filing date thereon and shall assign a number to said application, which number shall be endorsed thereon, and the city staff shall further file and index said application in some reasonable time, but not more than ten (10) days after the filing date of said application with the city staff, the city staff shall approve or disapprove said application or applications.    (A)   If public hearing is required prior to approval or disapproval, then said time period shall be extended by the number of days required for legal notice. (Ord. 207, 3-17-1987)
   (B)   The city staff shall either approve or disapprove said application for setting permit within thirty five (35) days after receipt thereof. If public hearing is required prior to approval or disapproval, then said time period shall be extended by the number of days required for legal notice.
   (C)   Upon approval of any such building application the city staff shall prepare and transmit a setting permit to the applicant or applicants. Such permit shall be on such a form as may be approved or prescribed by the council and shall contain: 1) a number, 2) a statement identifying the application concerned and incorporating said application into said permit by reference, 3) a statement indicating the fact of time of approval of said application by the city staff, 4) the actual date of issuance of said permit, and 5) the fact that said permit shall expire and may be revoked if work has not substantially begun within one year.
   (D)   The city staff shall sign said permit and file a duplicate original of said permit with the application.
   (E)   If an application for setting permit is denied by the city staff, the city staff shall forthwith prepare and mail to the applicant, the notice of denial of application, specifying in concise language the reasons for denial. Said notice of denial of application shall be on a form approved or prescribed by the council and shall contain: 1) a number which shall be the same as the relevant application number, 2) the fact and time of denial by the city staff, 3) the statement identifying the application concerned and incorporating said application into said notice by reference, 4) the actual date of issuance of said notice, and 5) what action the applicant may take to obtain a permit. In addition said notice shall be signed by said city staff. A duplicate original of said notice shall be filed by said city staff with the application concerned, with the date of filing endorsed on said notice.
   (F)   A copy of any setting permit issued by the city staff shall be submitted to the office of the county assessor of Caribou County. (Ord. 2015-4, 8-5-2015)

3-4-4: SEWAGE DISPOSAL FACILITIES AND WATER SUPPLY REQUIRED:

No setting permit shall be issued to any person or persons until that person or persons has obtained a permit and approval from the department of health and welfare of the state of Idaho or its subdivisions for the installation of sewage disposal facilities and water supply when applicable. 3-4-5: EXPIRATION OF SETTING PERMIT:

All setting permits shall expire one year after issuance unless substantial work has been completed. (Ord. 2015-4, 8-5-2015)
