CHAPTER 6

- OPEN LANDS DISTRICT REGULATIONS

Section 6.1.- Introduction.

(A)

Preamble/Intent: The purpose and intent of providing open land district regulations (O) is to allow for rural uses within the City of Green River. Property within this district may or may not be served by city utilities.

(B)

Criteria for Zone Establishment: Open lands development within the City of Green River shall be guided, in part, by the ability of the applicant to satisfy or otherwise demonstrate compliance with any relevant comprehensive planning policies.

Section 6.2. - Allowable uses.

Please see the use regulations in Chapter 9.

Section 6.3. - Height and bulk requirements.

The following list indicates the restrictions and regulations for the use and location of all structures permitted in the open lands district:

(A)

Minimum area of zone lot—None.

(B)

Minimum width of zone lot—None.

(C)

Minimum setbacks for structures:

(1)

Front—Thirty (30) feet.

(2)

Side—Fifteen (15) feet.

(3)

Rear—Thirty (30) feet.

(D)

Maximum height of structures:

(1)

Building or structure within one hundred fifty (150) feet of a residential district zone—Thirty-five (35) feet.

(2)

Building or structure more than one hundred fifty (150) feet from a residential district—Fifty (50) feet.

Section 6.4. - Supplemental regulations.

(A)

Conditions for Permitted Open Lands Accessory Uses: Any use which complies with all the following conditions may be operated as an accessory use to a permitted use:

(1)

The use is clearly incidental to and commonly associated with the operation of the permitted use.

(2)

The accessory use is operated under the same ownership and on the same property as the permitted use.

(B)

Permitted Yard Encroachments:

(1)

Belt courses, sills, eaves, lintels, exterior columns, chimneys and building accessories may project twenty-four (24) inches into all yards.

(2)

Open or unwalled porches, terraces, balconies and exterior stairways may project three and one-half (3½) feet into all yards.

(C)

Height Exceptions: Chimneys, flagpoles, antennas, monuments, water towers and fire towers may be erected to any safe height not in conflict with other regulations.

(D)

Conditions for Fences, Walls and Retaining Walls:

(1)

Height. Fences, walls and retaining walls may be erected to a height of eight (8) feet on any part of the zone lot, except that on corner lots no fence, hedge, wall, retaining wall, structure, or landscaping display shall be permitted over forty (40) inches above the adjacent sidewalk, or if none the adjacent street within the restricted sight triangle. This subsection shall not apply to retaining walls in existence on or before June 21, 2005, but shall apply to all retaining walls started or completed after June 21, 2005.

(2)

Hazardous materials. No fence shall be constructed which is hazardous or dangerous to animals or persons. The normal use of barbed wire in security fencing shall not be construed to be a dangerous fence.

(3)

Public health, safety and welfare. No fence shall be constructed which will materially damage adjacent property by obstructing views or shutting out light and air or otherwise adversely affecting the general public health, safety and welfare.

(4)

Open mesh fences. Open mesh fences of any height may be erected.

(5)

Permit requirements. All fences and wall shall be subject to the requirements of the building code and shall require a city building permit.

(E)

Parking Requirements: Please see the use regulations in Chapter 9.

(F)

Sign Requirements: Please see the sign regulations in Chapter 10.

(G)

Landscape Requirements:

(1)

Requirements. Due to the potential variety of uses allowed in this zone, the exact quantity and locational requirements for landscaping will be left to the discretion of the city official reviewing the plan.

(2)

Landscape plan submittal. A landscape plan showing plant and material size, quantities, location and long-term maintenance procedures shall be submitted at a scale where one inch equals fifty feet (1" = 50') or less.

(3)

Screening. Landscape shall screen unsightly elements, including, but not limited to, trash receptacles, storage yards, transmission towers and utility equipment such as sewage treatment facilities and utility boxes.
