Section 400.360 Zoning Authority - Enforcement And Permits.

The office of the Zoning Authority is hereby established. The Zoning Authority shall be the Director of Planning and Zoning or such other officer or officers designated by the Board of Aldermen. It shall be the duty of the Zoning Authority to enforce the provisions of this Chapter. No building or other structure shall be erected, constructed, reconstructed, moved, enlarged or altered or repaired in such manner as to prolong the life of the building, nor shall the use of any land be changed without first obtaining a permit issued by such Authority under the provisions of this Chapter, except that no permit shall be required for ordinary repairs on conforming use structures. Such permit shall be issued only when the request therefore is in conformity with the zoning regulations. Such Zoning Authority shall act as the Executive Secretary of the Planning Commission and is charged with the administration and enforcement of zoning regulations. Such Zoning Authority shall forthwith refer all violations of said regulations to the City Prosecuting Attorney for appropriate action.

Section 400.370 Municipal Properties.

Streets, alleys, cemeteries, land, buildings, or premises owned, rented, or leased by the City of Greenwood, Missouri, are exempt for public purposes in municipal rights, obligations, or pursuits, but such City land or property as may be re-leased by rental or otherwise to private individuals or corporations must comply with applicable zoning regulations.

Section 400.380 Violations - Penalties.

A. 
In case any building or structure is erected, constructed, reconstructed, moved, altered, converted or maintained, or any building, structure, or land is used in violation of the provisions of this Chapter, or of any ordinance or other regulation made under authority conferred hereby, the proper local authorities of the Municipality, in addition to other remedies, may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, moving, alteration, conversion, maintenance or use, to restrain, correct, or abate such violation, to prevent the occupancy of said building, structure, or land, or to prevent any illegal act, conduct, business, or use in or about such premises. Such regulations shall be enforced by the Zoning Authority or other officer authorized to issue building permits, who is empowered to cause any building, structure, place or premises to be inspected and examined, and to order in writing the remedying of any condition found to exist therein or thereat in violation of any provision of the regulations made under authority of this Chapter.
B. 
The owner or general agent of a building or premises where a violation of any provision of said regulations has been committed or shall exist, or the lessee or tenant of any entire building or entire premises where such violation has been committed or shall exist, or the owner, general agent, lessee or tenant of any part of the building or premises in which such violation has been committed or shall exist, or the general agent, architect, builder, contractor, or any other person who commits, takes part or assists in such violation, or who maintains any building or premises in which any such violations shall exist shall be guilty of a misdemeanor punishable as provided in Section 100.220(E) of the City Code of the City of Greenwood, Missouri.
