- BUSINESS, LIMITED, DISTRICT B-1

Sec. 53-295.- Statement of intent.

The primary purpose of the business, limited, district B-1 is to establish and protect a business district that will serve the surrounding residential districts. Traffic and parking congestion is to be held to a minimum to protect and preserve property values in the surrounding residential districts and, insofar as possible, all neighborhood business development shall take place in a limited business district. The minimum area of such a district shall be one block and such district shall only include such activities as are necessary for the day-to-day operations of a normal household. In most instances these areas are not located on major traffic arteries.

Sec. 53-296. - Use regulations.

In business, limited, district B-1, structures to be erected or land to be used shall be for one or more of the following uses:

(1)

Grocery stores;

(2)

Bake shops;

(3)

Drugstores;

(4)

Pick-up laundry and dry cleaning stations;

(5)

Coin-operated laundries;

(6)

Barbershops and beauty shops;

(7)

Gift shops;

(8)

Clothing shops;

(9)

Appliance stores;

(10)

Off-street parking as required by this chapter;

(11)

Public utilities such as poles, lines, distribution transformers, pipes, meters or other facilities necessary for the provision and maintenance of public utilities, including water and sewer facilities;

(12)

Business signs;

(13)

Church bulletin boards and identification signs;

(14)

Directional signs;

(15)

Farming and agricultural;

(16)

Facilities, activities and operations that are provided by a duly constituted unit of government with a conditional use permit issued by the board of supervisors;

(17)

Housing for the elderly;

(18)

Residential human care facility;

(19)

Special care facility;

(20)

Community centers, if issued a conditional use permit;

(21)

Short term rental;

(22)

Short term rental with shared amenities or if hunting is allowed, if issued a conditional use permit.

Sec. 53-297. - Area regulations.

Area regulations in the business, limited, district B-1 are as follows: none, except that the minimum area for uses utilizing individual water supply or sewage disposal systems shall be determined by the zoning administrator in consultation with the department of health.

Sec. 53-298. - Setback regulations.

Structures in the business, limited, district B-1 shall be located 30 feet or more from any street right-of-way which is 50 feet or greater in width, or 60 feet or more from the centerline of any street right-of-way less than 50 feet in width. This shall be known as the setback line.

Sec. 53-299. - Frontage and yard regulations.

For permitted uses in the business, limited, district B-1 the minimum side yard, adjoining or adjacent to a residential or agricultural district shall be 25 feet and off-street parking shall be in accordance with the provisions contained herein.

Sec. 53-300. - Height regulations.

Structures in the business, limited, district B-1 may be erected up to 35 feet in height from grade; except that:

(1)

A public or semipublic building such as a school or church may be erected to a height of 60 feet from grade; provided, that required front, side and rear yards be increased one foot for each foot in height over 35 feet.

(2)

Church spires, belfries, cupolas, monuments, water towers, chimneys, flues, flagpoles, television antennas and radio aerials are exempt. Parapet walls may be up to four feet above the height of the buildings on which the walls rest.

(3)

No accessory building that is within ten feet of any party lot line shall be more than one story high. All accessory buildings shall be less than the main building in height.
