Section 17.1.- Moratorium on medical marijuana treatment centers and/or licensed dispensing organizations or facilities.

17.1.1. Purpose and authority for ordinance. The ordinance from which this section derives is adopted for the purpose of imposing a temporary, one-year moratorium on the operation of medical marijuana treatment centers and licensed dispensing organizations within Bradford County, Florida and is adopted pursuant to the authority granted by F.S. ch. 125; and other relevant provisions of Florida law.

17.1.2. Definitions for terms. For the purposes of this temporary, one-year moratorium and unless the context clearly indicates otherwise, the following terms shall have the following prescribed meanings:

Licensed dispensing organization shall mean an organization approved by the Florida Department of Health, Office of Compassionate Use, to cultivate, process and dispense low-THC cannabis and medical cannabis pursuant to F.S. § 381.986.

Medical marijuana treatment center shall mean an entity that acquires, cultivates, possesses, processes (including development of related products such as food, tinctures, aerosols, oils or ointments), transfers, transports, sells, distributes, dispenses or administers marijuana, products containing marijuana, related supplies, or educational materials to qualifying patients or their personal caregivers and is registered by the Florida Department of Health.

17.1.3. Imposition of temporary, one-year moratorium. The Board of County Commissioners of Bradford County, Florida hereby imposes a temporary, one-year moratorium [on] the operation of medical marijuana treatment centers and licensed dispensing organizations within Bradford County, Florida.

17.1.4. Application of temporary, one-year moratorium.

During the temporary, one-year moratorium imposed by section 17.1.3 herein, Bradford County shall not accept, process or approve any application relating to the operation of a medical marijuana treatment center or licensed dispensing organization.

Nothing contained within this temporary, one-year moratorium shall be construed to prohibit the medical use of marijuana or low-THC cannabis by a qualifying patient, as determined by a physician licensed by the State Florida, pursuant to Amendment 2, F.S. § 381.986, or any other applicable Florida law.

17.1.5. Termination of moratorium. The temporary, one-year moratorium imposed by section 17.1.3 herein, shall terminate one year from the effective date of the ordinance from which this section derives, unless rescinded or extended, or by an amendment to the Bradford County Land Development Regulations addressing the use of real property for purposes of cultivating, processing, distributing or selling medical marijuana, low-THC cannabis or related activities.
