CHAPTER 3

SCHEDULE OF REGULATIONS

9-3-1: COMPLIANCE WITH REGULATIONS:

The regulations for each district as set forth in this title shall be construed as minimum regulations and shall apply uniformly to each class or kind of structure or land, except as hereinafter provided:
   A.   No building, structure or land shall be erected or altered:
      1.   To provide for greater height or bulk;
      2.   To accommodate or house a greater number of families;
      3.   To occupy a greater percentage of lot area; or
      4.   To have narrower or smaller rear yards, front yards, side yards or other open spaces, than required under this title, or in any other manner be contrary to the provisions of this title; and
   B.   No yard or lot existing at the time of the initial passage of this title shall be reduced in dimension or area below the minimum requirements set forth herein. Yards or lots created after the effective date of this title shall meet at least the minimum requirements set forth herein. (Ord. 341, 9-10-1996)

Notes:
   1.    Uses include additional dwellings for immediate family members and employees, condominiums, interval or fractional interest ownerships, and other similar forms of single-family residential ownerships.
   2.    Mobile home use is permitted only for temporary interim use during times of construction and development.
   3.    This category of uses also includes cabins, boarding houses, inns, and other hospitality uses and facilities.
   4.    This category of uses also includes uses associated with the development, operation, use and maintenance of recreational facilities, including, but not limited to: golf courses, marinas, community docks, lodges, ski and recreational resorts (including all related buildings, structures, facilities and equipment), structured and surface parking and equipment (including moorage facilities, boat storage, water taxi facilities, lodges and day lodges).

9-3-4: SUPPLEMENTAL MU DISTRICT REGULATIONS:

The following supplementary regulations shall apply to the MU district:
   A.   Development Agreement, Planned Unit Development (PUD), Or Special Use Permit (SUP) Required: All development requiring a special use permit in the MU zoning district, as shown in this title, shall occur under the PUD and/or development agreement process. Residential gross densities shall not exceed ten (10) dwelling units per acre. When a property is being proposed for rezone to the MU zoning district, a development agreement may be utilized in lieu of the PUD and/or special use process. If approved by the city council the development agreement shall include conditions of development that satisfy the requirements of the PUD and special use process. Waivers to specific requirements of the PUD may be granted by the city council if they find such waiver furthers implementation of the standards under section 9-14-5 of this title.
   B.   Permitted Uses, Lot Size, Setbacks, And Parking: Permitted uses and lot size, setback, parking requirements, height restrictions, street standards and other dimensional or development regulations shall be specified through the PUD application and/or development agreement, which shall be based on the anticipated uses and overall planning goals for the proposed project.
