The purpose of this article is to provide a set of minimum standards for the maintenance of environmental conditions necessary for insuring the general health, safety, and well-being of the community.

ARTICLE VIII
Environmental Control Standards
§ 40-8-1 General standards.
No rezoning shall be permitted that will result in the serious deterioration of environmental resources. Therefore, a zoning petition shall be prepared to demonstrate to the Commission how the anticipated development may be accomplished so as to prevent environmental deterioration. The following portions of this article will be devoted to the development of minimum standards for the protection of the environment.
§ 40-8-2 Performance standards.
(A)
Any construction, development, or use of land in any zone shall be subject to the additional standards contained in this article. To adequately satisfy themselves that these standards can be met, the Commission may require the following information from a zoning petitioner prior to taking action on his petition.
(1)
General soil maps, interpretative text of soil uses, general slope maps, percolation tests, test well logs, and any other reasonable information the Commission deems necessary to determine the suitability of the site for the uses anticipated, and to show the susceptibility of natural features to erosion and pollution problems.
(2)
A general site layout showing how the site can be developed without resulting in conditions which are in conflict with the standards of this article.
(3)
Specifications and descriptions of any waste treatment system, not part of the Village of Harristown treatment system.
(B)
General standards for the prevention of erosion. No development shall be permitted which would result in a major transfer of topsoil to areas of streams, drainage systems, roadways, or other lands by erosion. The Commission shall consider the erosion susceptibility of the site and the proposals of the developer to contain erosion where erosion possibilities are suspected prior to rezoning a parcel of ground.
§ 40-8-3 Floodplain regulations.
(A)
Purpose. The regulations contained in this article, governing the development and use of land subject to flooding, are established for the following purposes:
(1)
To avoid or lessen the hazards to persons or damage to property resulting from the accumulation or runoff of stormwater and floodwaters;
(2)
To protect the stream channels from encroachment;
(3)
To maintain the capacity of the floodplain to retain floodwaters;
(4)
To provide for the development of floodplain lands with uses not subject to severe damage by flooding and compatible with the other uses permitted in the various zones;
(5)
To permit only uses and improvements on floodplain lands that are not hazardous during flood periods;
(6)
To avoid the creation of new flood problems;
(7)
To prevent the filling of any stream channel or the raising of any floodplain without a written special use permit from the Village of Harristown.
(B) FLOOD BASE ELEVATION FLOODPLAIN STREAM
Definitions. For the purpose of this article and this chapter generally the following terms shall have these meanings:
The elevation of the 100-year flood (the intermediate regional flood) as shown in Floodplain Information, Macon County, IL, prepared by the United States Army Corps of Engineers, latest edition, or in the absence of such record those levels established by the Village Engineer.[1]

The continuous area adjacent to a lake, stream, or stream bed the elevation of which is greater than the normal water level or pool elevation, but equal to or lower than the flood base elevation; also, any land of higher elevation, having an area less than the minimum residential lot size established for the zone in which it is located and surrounded by lands having an elevation equal to or less than the flood base elevation.
A stream is any continuously flowing natural watercourse.
(C)
Building in floodplain areas. No building or structure shall be erected with the elevation of a habitable floor, including a basement floor, lower than two feet above the floodplain elevation. All lands determined to be in the floodplain shall be subject to the procedures and regulations established in this section. However, nothing contained herein shall prohibit the application of these regulations to lands which can be demonstrated by competent engineering survey to lie within any floodplain. Conversely, any lands which can be demonstrated by a competent engineering survey to lie beyond the floodplain shall not be subject to these regulations. All other structures which are permitted to be constructed on the floodplain must be so constructed that they will not be damaged by flood and will not represent a hazard at the time of flooding.
