For the purpose of this subchapter, the following definitions apply unless the context clearly requires a different meaning.
APPLICANT. Any person, corporation, partnership or other entity who desires to perform work which will require the excavation of any part of any city street within the corporate boundaries of the city.
CITY STREET. Any street, alley or right-of-way which has been dedicated and accepted for public use by the city.
EMERGENCY.
(1) A sudden condition affecting city services, such as water, sewage, police or fire, which must be immediately corrected such that there is insufficient time to obtain a permit.
(2) In such cases, the person or entity who desires to perform the work shall immediately and prior to the commencement of said work notify the Street Commissioner, and shall file the necessary application within 48 hours of commencing the work.
STREET CUT. The excavation of any part of any city street for the purpose of the installation, repair or maintenance of a sewer tap, utility transmission or line or for any purpose whatsoever.

(A) Except for in the case of an emergency, no applicant shall make or cause to be made any street-, sidewalk- or curb-cut on a city street without first having applied for and received the written permission of the Commissioner of the Street Department in the form of a “street-cut permit.”
(B) A street-cut permit authorizes the applicant to excavate a part of a city street under the terms and conditions approved by the Board of Public Works and Safety of the city.

§ 155.03 REQUIRED PERMIT FOR STREET AND ALLEY ACCESS CREATION.
(A) Except for in the case of an emergency, no applicant shall make or cause to be made any access intended to facilitate the entry of a vehicle onto a city street, including an alley, from a private right-of-way including, but not necessarily limited to, a parking lot, driveway, private road, platted road intended to be dedicated to the city as part of a development plan or subdivision plat or any other privately-owned property without first having applied for and received the written permission of the Commissioner of the Street Department in the form of a “street access permit.”
(B) A street access permit authorizes the applicant to create an access onto a city street under the terms and conditions approved by the Board of Public Works and Safety of the city.

§ 155.04 OBJECTS OVERHANGING A STREET, RESTRICTIONS.
No person shall cause or permit any object not properly licensed, registered or otherwise permitted to be operated on a city street to be placed on or along a city street which shall, by its location with respect to the city street, cause any part of the object to obstruct the flow of traffic or parking on the city street or extend out over the street in such a manner that it could obstruct the flow of traffic or parking on the city street.

§ 155.05 PLANTING IN PUBLIC PARKS AND PLACES, RESTRICTIONS.
No person shall plant or cause to be planted in a public park, or in any other location owned by or under the control of the city, any type of vegetation without the prior written consent of the Board of Parks and Recreation of the city.

§ 155.20 DEFINITION.
For the purpose of this subchapter, the following definition applies unless the context clearly requires a different meaning.
ASPHALT STREET. Any city street or alley where the surface has been paved by asphalt, tar or any other blacktop or bituminous material.

§ 155.21 RESTRICTED AND PROHIBITED ACTIONS.
It shall be unlawful for any person, persons, firm or corporation to:
(A) Drive, pull, operate or permit to be driven, pulled or operated upon any asphalt street within the corporation limits of the city any tractor, wagon, implement or other vehicle upon lugs which are attached to its wheels;
(B) Drive, lead or permit any horse shod with calks to walk over any asphalt streets within the corporation limits of the city;
(C) Push, pull or drag over any asphalt street within the corporation limits of the city any sled, implement or other moveable object the pushing, pulling or dragging of which will cut, dig or tear the surface of the asphalt street; or
(D) Drive any stake, stakes, pipe or post into or through any asphalt street within the corporation limits of the city or dig any hole in an asphalt street in connection with the installing, repairing or replacing of a water or sewer line prior to obtaining a permit from the City Clerk-Treasurer. Prior to making a cut in an asphalt street, any person, firm or corporation shall also secure a bond and post with the Clerk- Treasurer, guaranteeing that the street shall be repaired to its original condition.
(A) General penalty. Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
(B) Cuts, access and obstruction. Any person or entity violating the provisions of §§ 155.01 through 155.05 of this chapter shall, upon conviction, be fined a sum not exceeding $1,000 plus the cost of repair or restoration to original condition of any city street, alley, sidewalk, water or sewer line damaged by a violation of §§ 155.01 through 155.05 of this chapter.
(C) Restricted and prohibited actions. Any person, firm or corporation violating any provision of §§ 155.20 and 155.21 of this chapter shall, upon conviction, be fined in any sum not exceeding $100.
